Thank you for notifying me about this complaintI distinctly remember this tenant because it was 4th of July Weekend On July 3rd I received a phone call concerning the smell of smokeI went to unit to f I nd all windows open and there was a campfire outsideI asked the tenants if they wanted me to close the windows because they had a babyThey said no and they wanted to look for a new placeI said go ahead and search for one and let me know if they were leavingminutes later I received a phone call stating that they were leavingWith my wife by my side as a witness, I stated on the phone that I would gladly refund any monies that I received in rent for that stay They left at 10:at night so I was not able to rent it that nightLast minute rental the next day brought in $So I refunded $ The Rental Agreement signed by tenant states that there is a day cancellation policy and states that cancellation or early departure does not warrant any refundAccepted by tenant on 5-5-at 1:pm MDT Please see attached copies of Payments, Refunds, and RENTAL AGREEMENT We feel that we went above and beyond the call of duty Thank You, [redacted]

Complaint: [redacted] I am rejecting this response because: My original account of the arrival, opening of windows, and the smell of smoke after a short while is accurate and is conveyed in what the owner said in response about a campfire having been started by other guests outside the windowThe fire was not there when we arrivedWe actually spoke with those guests briefly in that outdoor area when we were initially looking for the unit The owner did offer to close the windowsHowever, the unit was already filled with smoky odor and with the windows closed there was no way to ventilate the unitClosing the windows would only trap the smoke withinThe unit was quite warm when we arrived and staying with the windows closed was not a viable option, especially with an infantWe knew ahead of time that we were to rely on the windows for keeping the unit coolWith this option not available and the unit inundated with smoke, we had to seek alternate lodging As previously mentioned, the owner stated during my original call to him that he would make it right and refund usHe once again told my wife and I this when he stopped by to investigate the smokeAgain, upon leaving I called him to inform him of such and thanked him for his refund offerHe again said he would make it right and said he would refund all money receivedThis was the third confirmation of a full refundOnce on the initial phone call., then in person within the unit, and lastly on the phone when we were leavingThere were never any qualifications made in regards to only refunding money if he was able to rent to someone else In regards to the rental agreement, I am certainly familiar with itThe referenced clause is includedHowever, nowhere in the agreement does it offer clarification for an instance such as the one we experiencedAn instance in which the property is not suitable for habitationFortunately he clarified this in person by making a verbal agreement with me twice on the phone for a full refund and once with both my wife and I in person Lastly, I would like to state that ironically the first line of the rental agreement states "NO SMOKING IN ALL UNITS"Yet the owner has a fire pit right outside the windowIrony aside, we are extremely fortunate that the fire was started outside long before we settled in and went to sleepIt is terrifying to think that our baby boy could have been inhaling camp fire smoke throughout the night! At this time I still request a refund for the remaining balance in amount of $This will satisfy his offer of a full refund Regards, [redacted]

tenants if they wanted me to close the windows because they had a baby. They said no and they wanted to look for a new place. I said go ahead and search for one and let me know if they were leaving. 20 minutes later I received a phone call stating that they were leaving. With my wife by my side as a witness, I stated on the phone that I would gladly refund any monies that I received in rent for that stay. 
They left at 10:30 at night so I was not able to rent it that night. Last minute rental the next day brought in $150. So I refunded $150. 
The Rental Agreement signed by tenant states that there is a 60 day cancellation policy and states that cancellation or early departure does not warrant any refund. Accepted by tenant on 5-5-2014 at 1:58 pm MDT. 
Please see attached copies of Payments, Refunds, and RENTAL AGREEMENT.
We feel that we went above and beyond the call of duty.

The owner did offer to close the windows. However, the unit was already filled with smoky odor and with the windows closed there was no way to ventilate the unit. Closing the windows would only trap the smoke within. The unit was quite warm when we arrived and staying with the windows closed was not a viable option, especially with an infant. We knew ahead of time that we were to rely on the windows for keeping the unit cool. With this option not available and the unit inundated with smoke, we had to seek alternate lodging.
As previously mentioned, the owner stated during my original call to him that he would make it right and refund us. He once again told my wife and I this when he stopped by to investigate the smoke. Again, upon leaving I called him to inform him of such and thanked him for his refund offer. He again said he would make it right and said he would refund all money received. This was the third confirmation of a full refund. Once on the initial phone call., then in person within the unit, and lastly on the phone when we were leaving. There were never any qualifications made in regards to only refunding money if he was able to rent to someone else.
In regards to the rental agreement, I am certainly familiar with it. The referenced clause is included. However, nowhere in the agreement does it offer clarification for an instance such as the one we experienced. An instance in which the property is not suitable for habitation. Fortunately he clarified this in person by making a verbal agreement with me twice on the phone for a full refund and once with both my wife and I in person.
Lastly, I would like to state that ironically the first line of the rental agreement states "NO SMOKING IN ALL UNITS". Yet the owner has a fire pit right outside the window. Irony aside, we are extremely fortunate that the fire was started outside long before we settled in and went to sleep. It is terrifying to think that our baby boy could have been inhaling camp fire smoke throughout the night!
At this time I still request a refund for the remaining balance in amount of $236.75. This will satisfy his offer of a full refund.
