My vehicle was involved in a car accident on a Sunday at 4pm. Jarretts towing was contacted by the police department, the driver and passenger of the car were in a rescue squad. As the owner I was not contacted, my vehicle was setting off the roadway blocking NO traffic. No fluid, glass or motor parts were in the roadway the accident involved NO clean up, my car was able to be driven onto the tow truck. I was charged at $375.00 tow bill - $325.00 for "working the wreck" and $50.00 to store my car from 5:30 pm until 8:30 am the following morning. (I contacted the owner within hours of the car being towed and was told he would not meet me until the following day) He immediately offered to accept my car title PLUS $100 in labor to pay the bill and refused to allow me to get any personal belongings out of the car until my car was signed over to him or I paid $375.00. My car was totaled and stolen in the same day!

In response to this complaint, Virginia code requires that disabled vehicles are not left unattended on; or on the sides, of any roadways. We responded at the request of the locality Police Department who had us remove the customer’s vehicle from the side of the roadway. Unfortunately this customer was at fault in a traffic accident. Our understanding is the passenger was injured and transported to the emergency room accompanied by the customer. One point in the customer’s complaint is that she was not contacted about the tow – she contends that that her vehicle was off the roadway “blocking no traffic.” The decision to tow the vehicle was that of the locality Police Department enforcing Virginia traffic codes. Our economy is driven by transportation or logistics of material and products. Obstructed roadways or roadways littered by wrecked our abandoned vehicles would slow down or imped traffic. For this reason the traffic codes are strictly enforced. Towing providers are expected drop everything and respond immediately to the scene of a traffic accident. To provide this service, or any towing service, towing providers have cost and like any business customers must pay for the services. Working traffic accidents can be dangerous, too often first responders such as police officers, wrecker drivers, medical personnel and firemen are killed, when they are struck by an oncoming vehicle. Wrecks are expensive, it cost money to provide towing services, unfortunately many people do not have the right insurance coverage and are charged by the towing provider. In this customer’s case, as with all our customers, we adjusted our bill. The customer paid absolutely nothing. We did request a sign title which will allow us to junk the vehicle for scrap metal, and with todays metal prices it will cost us more in labor and fuel cost to get rid of the junk. In conclusion, this customer was treated more than fairly. Hopefully this incident will be a learning experience for this customer concerning the value of adequate auto insurance, and Virginia traffic codes.

I have reviewed the response offer made by the business in reference to complaint ID, and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below.
I, *** am the customer, I was not involved in the accident AT ALL, the driver did not own the car. Va law states Unless different limits are established by ordinance of the localgoverning body pursuant to 46.2-1233, as to vehicles towed or removed fromprivate property, no charges imposed for the towing, storage, and safekeepingof any passenger car removed, towed, or stored without the consent of itsowner shall be in excess of the maximum charges provided for in this section.No hookup and initial towing fee shall exceed $125. For towing a vehiclebetween seven o'clock p.m. and eight o'clock a.m. or on any Saturday, Sunday,or holiday, an additional fee of no more than $25 per instance may becharged; however, in no event shall more than two such fees be charged fortowing any such vehicle. No charge shall be made for storage and safekeepingfor a period of twenty-four hours or less. Except for fees or charges imposedby this section or a local ordinance adopted pursuant to 46.2-1233, noother fees or charges shall be imposed during the first twenty-four-hourperiod.B. The governing body of any county, city, or town may by ordinance, with theadvice of an advisory board established pursuant to 46.2-1233.2, (i)provide that no towing and recovery business having custody of a vehicletowed without the consent of its owner impose storage charges for thatvehicle for any period during which the owner of the vehicle was preventedfrom recovering the vehicle because the towing and recovery business wasclosed and (ii) place limits on the amount of fees charged by towing andrecovery operators. Any such ordinance limiting fees shall also provide forperiodic review of and timely adjustment of such limitations. again please let me re-interate that I was not contacted AT ALL in regards to the accident. In response to the crazy amount charged for “working” the wreck I can assure you at no time in Grottoes VA. Where the speed limit is 35 mph or less the tow driver was at no risk. The car was not impeding traffic in anyway and the car was able to be driven onto the tow truck. This is a scam that this company pulls every time they get ahold of a car that has only liability insurance. I was not under insured legally, Infact I even had road side assistance that I could have used had I been contacted by police or the tow company!!!

We are picking up car out of recovery, and drive 4 hours to get here. We are having to wait over 2 hours now,when has located 8 miles from here. I don't understand how he can treat his customers like this. Do not recommend! Very poor service. Sad.

This customer's vehicle was towed at the request of the Virginia State Police, apparently the customer fled the accident scene therefore the police towed the vehicle. We were aware the customer was coming from Newport News and it was a four hour drive. Unfortunately we can't shut down the towing business to accommodate one customer as the wreckers are needed for accident scenes and disablement scenes. We were servicing other customers when this customer called and had arrived. We strive to provide services to all customers and apologize for the delay to finish servicing the current customer. In the future we recommend that this customer not leave the scene of an accident, thus preventing your vehicle from being impounded.
