Complaint: [redacted] I am rejecting this response because:Even though Mr [redacted] and Mr [redacted] did come over (after I had emailed them and after logging in another complaint with Revdex.com) on May 25th and put a horizontal cut of about ¼ “deep and ¼ - ½” wide this is not a control joint What they did was to put in a cut to resolve the drainage problem that was the result of a dip that they had originally put in the driveway (we have been complaining about it ever since).At about 3:April 2016, after I had contacted [redacted] to resolve the issues we have (noted in the original complaint and was told to wait weeks) they finally decided to come over I took time off work to meet with them and I went over all of the problems with the drivewayI asked and was given a verbal additional year on the warrantee because of all the problems by Mr [redacted] They were to seal the cracks, add two horizontal control joints to help relieve stress and improve drainage off of the concrete, I believe it needed vertical control joints as there are no vertical one’s in the drive way (horizontal control joints were initially installed), check into water problem on the left side of driveway where there is a dip in the driveway (they asked us to up in a small trench for the water to drain to, which we did, but that did not work)They were also to provide a generator for and electrical use as our outlet needs to be repaired When they left they told me they were going back to work on the Contract During the 2nd week of May I still did not have a contract for the work that needed to be done when I was finally able to contact [redacted] he emailed me he would try to have it to me my Monday May Which never happened They also never extended the contract like they said they would.His remark “We installed control joints to help guide the water away from the driveway (no charge) as stated above they did not put in additional control joints as any Control Joint must meet the code for a Control Joint these are just cuts in the concrete that they put in to supposedly cure the standing water problem in our driveway which do not work as the water is still going into the dip just as it has since they put it inTheir warranty states that all materials and workmanship will be warranted for a period of one (1) full year from the date of completion, June 12, We agree to repair or replace any work which has been proven to be defectiveWell the dip on one side that retains water and the poor quality of cement used has not been taken care of We have tried since June last year to get him to honor the warranty, but was always told wait for a few weeks to see if it gets worse in Aug of he told us they would be by every month to check on its condition this did not happen As to his remark about the current condition of the other driveways in our neighborhood these driveways are almost years old and our neighbors never had any problems for at least – years’ afterword’s The new houses driveways, that were put in about years ago make ours look like it should be at least twice that age.Also he did not put in a police complaint he put in a report of an occurrence (I have a copy of it) and he listed the event location as [redacted] which I believe is their business address, our address is not listed on the report and we have never been to their office It was also closed the same day If he ever mentions this police complaint again we may have to look into putting in a harassment complaint.All they are doing is stalling until the warrantee expires next weekThe contractor has both my cell number and email address there is no reason that this could not have been resolve last year Especially for a customer who paid in full the day the job was completed Is this any way to treat a customer? Mr& Mrs***,We, Lovell Construction, filed an official complaint on the same day the incident took place, August 10, at 3:00pm, SAPD case # [redacted] - From the front of your house to the street there was very little slope for the water to drain & we were trying to come up with a solution that would be the most efficient- We are allowed to remove your driveway without a permit, the permit is for the removal & replacement of your approach.(the part the touches the street)- The french drain would have been a more efficient way of carrying the water to the street, as you mentioned, we followed YOUR requestAny piping under a sidewalk or driveway will cause stress on the concrete, even though we installed 3/8" rebar 16" on centerI believe this is part of the problem- no response- Your driveway approach does hold water at the street, we cannot change the elevation of the streetThe City continues to add asphalt to the streets with out raising the curbsThere is no need to apply sealer to concrete, sealer is more decorative than functional- Hair line cracks will happen, we cannot control movement of the soilKeep in mind we used solid, 3/8" thick rebar inside the concrete & it was inspected by the City of San Antonio before we poured the concrete.I am willing to come out & meet with Mrs [redacted] ONLY, any site of Mr [redacted] & I will leave immediately[redacted]

Complaint: [redacted] I am rejecting this response because: If a police case was opened on my husband he would have been notified by the police (he was not notified) Also although my husband can be loud verbally he would never actually hit anyone (as he is not capable of doing so) My husband who is a diabetic with high blood pressure is also subject to involuntary movements with his arms and body when agitated When we last talked last week I advised that I would be home from work until Feband that it would be ok to come and look at the condition of the drive way and walk way You were advised that you would only be talking to me, and that my husband would stay inside, but you never sent anyone out to investigate the problem.There were several things that arose that increased my husband attitude toward your company When we first met the Saturday before to go over what I wanted to happen verses the proposal that was given to my husband on the 3rd of June I had drafted up a design showing the Channel Drain and drain to be sloped and placed under the sidewalk it also showed the placement of the Catch Basin for the Drain Pipe and joining it drain with the main drain which was to continue down to the street and under the sidewalk at the street if that would be permitted by code.You told us we would be better off with a French drain that would carry the water along the side of the side walk and have a gravel top After some discussion I finally won and convinced you to have the pipe put in At this point we only had the initial proposal and no contract for any on the workWhen the work on removing the old driveway and side walk work initially started on the 8th of June (2015)Work was started before you even had the permit My husband told your crew to stop work until the permit could be posted as he did not want us to get into trouble with the city You were contacted by be boss on the work crew and you (or [redacted] ) told them to continue working The permit was not picked up from the City until 3:PM on the 8th it was then not posted until the evening of the 8th We received the second proposal on the 9th and after reviewing it sent it back on the 11th of JuneDuring the work on setting up for the new walkway which I had them make wider then the original I received a call from my husband one day at work to let me know that the work crew was going to be putting in a French drain I advised him to let them know that it was not going to be a French drain but a pipe which they would have to dig and slope a trench for Had he not stopped them they would have put in something that we did not want [redacted] (or you) came out to talk to me and I had to again specify that we and agreed on the under the side walk pipe and again was tried to be convinced to put in a French Drain My husband was outraged that our request was not being followed You eventually agreed and said you would have to get the pipe for the job, we had also found out that the drainage with a channel drain had not been considered yet also The next day I was contacted again about how the side walk was going to be put in I made arrangement for us to meet and was advised that since we would be putting in a drain that the side walk direction needed to be changed to about 15-feet at a degree angel away from the drive way to obtain proper drainage This is an area that is slightly higher then the current sidewalk and made no sense at all They were and advised to stick to the original plan as there was sufficient down hill slopping there After them rechecking the slopping it was found to be okWhen the job was completed we pointed out the hump om one side of the drive and the dip on the other side of the drive (which now retains water for several days after it rains) we also showed you that the pavement was brush swept instead of patting it down smooth to get out excess water I told you that I would have preferred it smooth and we were told that we could sand down the ridges easily with a hand held sanding block There was also no sealer placed on the driveway We were left to feel that we had to agree that the job was ok even though in my mind it was subpar After the first cracks started coming in within a couple weeks we contacted you and were told that cracks will happen We contacted you several times as more and more cracks started appearing, but was told to wait until the cracks were wider The two big cracks by the channel drain and the other one running diagonally from corner to edge of the sidewalk by the front of the house are wide enough for a quarter to fit in It is not only the cracks that worry me, but also the washing away of the top layer of concrete to where the gravel is exposed You were also told about the hump and one side of the drive and the dip on the other side of the Drive way several times, but we were told there was nothing you could do about it We had several disagreements from the beginning with your company on the design of the sidewalk and drain We were constantly told that there was nothing you could do, but send someone out every month or so to see what the condition of the drive and side walk looked like We have never seen anyone from your company checking on the condition of the mess you made of our driveway.Now you will not come out because you say my husband threaten you well if you had fixed the original problem of a poor concrete mix in the first place we would not now have multiple cracks, many little holes, concrete that has washed away to reveal the gravel, small washouts of the concrete and gravel mix (at least 2x3" and about 1/4" deep), and of course the hump and dip in the driveway all of which are shown in the pictures sent to you.We feel like we have had all of the things happen because your company did not like being told to do the job my way and not the way you all wanted to do it All we are asking is to be treated with the respect due to us which means not lying, doing things the way we want them done especially when it comes to drainage and sidewalk design The drainage is working great as all the water is now draining away from the house like it should and without the French Drain you had wanted to put in We hope that all of this can be fixed and the Driveway sealed like it should have been to begin with You will only be working with me as my husband will be restricted to the inside of the houseI apologize if his language offended youIt can sound threatening because of the loudness of his voice when he is upset about not being told the full truth If we can come to an agreement on how to proceed in the mentioned wks time frame and get the job completed before the warrantee runs out in JuneI will then remove my complaint and not We visited the home of Mr& Mrs*** on Wednesday, May We installed control joints to help guide the water away from the driveway(no charge) We are willing to install self leveling caulking if the hairline cracks if they get any widerDue to the current condition of the neighboring driveways & the garage foundation it is evident that the soil in this area of town seems to move a lot we will not extend the warrantyWe hope that showing our commitment, even with the police complaint, Mr& Mrs*** are satisfied

inspecting the steel & depth of the concrete before we poured any concreteWe do NOT use any wire mesh, we use 1/2" & 3/8" rebar in all our jobsAs you know, we past inspection on the first visit Your husband was physically on the job every day we were thereHe was also very verbally abusive to me, my brother-in-law *** *** & my workers, including the foreman *** ***Once the job was completed he got so angry that he would have struck me were it not for my brother-in-law & *** stopping him from striking meWe immediately filed a Police reportI have no desire to be on or near your property With that said, the photos you sent me are truly hair line cracks, none of the photos you sent could fit a dime let alone a quarterMinor hair line cracks do happen from time to timeSan Antonio has a reputation for ground movement beyond our controlI can assure you the with the steel in the concrete & the thickness your concrete is & will be structurally sound I would recommend waiting another weeks & monitor the concreteI would be willing the apply self leveling caulking at that time if the cracks persist or get widerMy only stipulation would be that your husband cannot be on the property when we arrive

We are in receipt of your email and have the following to report: "We went to the ***'s home on the morning of May 25th, and installed 2(two) control joints on the driveway(side to side) She mentions in her complaint that they do not drain the water from the driveway as expected We explained to the ***'s that they need to remove the dirt on the side of the driveway that is blocking the water from running off the drivewayUntil they do that, the water has no where to go We did not discuss installing additional joints(front to back), but we are willing to go to their house and install an additional control joint (front to back) At this time, the size of cracks in the driveway are still considered "hairline"....and do not compromise the integrity of the concrete driveway If the ***'s want us to come out to the house, open the hairline crack with a "crack chaser" and fill the crack with self leveling caulking--we can arrange to do that at our expenseAs far as extending the warranty, it appears that someone(not our company), attempted to grind down the concrete with some type of grinder.(see attached photo) This action prohibits us from extending the warranty as requestedWe are here to help, but if we go out to their house, we request that Mrs*** be present so we can show her what we are doing. I am rejecting this response because: There are several things that me and Mr*** will need to go over prior to resolving this ComplaintI would like to meet with Mr*** hopefully on Monday as that is my day off (as it is a holiday). We need to cover the areas listed below and in the attached so that we can start correcting all of the issues with the driveway and sidewalkIn all of the responses that have been entered by your company, it was brought up over and over about the police case that was put out against my husband. This is considered border line harassment on your part as nothing ever came of it no police called or came out. The only thing you will address are what you are calling hair line cracks, nothing is being mentioned about fixing the hump on one side of the drive and the dip on the other side of the drivewayThe driveway was completed with the hump and the dip in it, and you concern was mentioned several times. It is not a result to pour drainage as the drainage from the sidewalk to the street, had not been put in until a day or two after the driveway was pouredAlso nothing is being said about my concern many little holes, concrete that has washed away to reveal the gravel, small washouts of the concrete and gravel mix and chips in the concrete all of which are in the pictures that were sent to youPlease read the attached I would like to go over them with you as they will be additional issues that we need to talk aboutSince I am now back at work please contact me in the evening after 5:PM if you are not able to meet with me on Monday. Once we have come to a written agreement on what is to be done I will resolve this complaint
