First of all, *** had shutdown the gas on January **,Therefore, there was no emergency situation thereI don't see any emergency situations if there was no gas in the building and *** came on the next day to resolve the problemSecondly, as a condo unit owner, NOBODY has no rights should touch my boiler without notifying meI don't see why I should responsible for this outrageous bill if there was no emergency situation and had any job done in my own property without my permission

their problem. However, this work was poorly completed. Upon information and belief, there was a gas leak at the building from one of the mentioned boilers, on January **, 2017. The Property Manager was informed of the situation by the Building Superintendent after 5 PM. Due to the emergency status of the situation and the immediate attention required to make the appropriate repairs to avoid additional damage and/or danger, the property manager called [redacted]. The company has been used by the Property Manager before and trusts their professional judgment and skilled master plumbers. [redacted] answered the call and attended to the boilers and water heaters on the referenced days. The Complainant - Unit Owner was charged $2,225.00 on their Condominium account, not the $4,450.72 as the Complainant claims. As a Condominium Unit Owner, Complainant should be well aware that all repairs on their units, including boilers & water heaters, are the Unit Owner's responsibility. Due to the emergency nature of the situation on January **, 2017, there was no time to bid out any work proposals and inform the Unit Owners of the estimated charges. The safety of the Complainant and all other residents of the building and the surrounding buildings were priority in a situation when there might be a possible gas leak. Therefore, Complainant - Unit Owner is responsible for the $2,225.00 charge for the emergency repairs completed by [redacted] due to Complainant's negligence in maintaining the boiler and water heater associated with the unit in question.

The reason to filed this complaint is about the unfair practice/treatment of the ABM management corporation. As an homeowner, we pay maintenance fee and we deserve the management company to work with us not against us.

Please see the timeline below for the gas leak reported on 1/*/2017 1/*/2017, 9:06 PM– Superintendent (Mark) was called due to gas odor in my apartment, Mark picked up and said he would investigate.  Superintendent (Mark) did not get back to us that night.1/**/2017, 7:23 AM– No response from Superintendent (Mark) as of yet andgasodor was still present.1/**/217, 8:52 AM– Superintendents (Charles & Mark) were called again and neither picked up.1/**/2017, **:34 AM– Superintendent (Mark) informed me via phone call that he had called [redacted] about the gas odor.  [redacted] arrived later and shut off the gas.1/**/2017, ~1:30 PM– After [redacted] shut off the gas, I was informed by Superintendent (Mark)via phone that the flue pipe on the boiler needed to be changed.  The service was provided by [redacted] same day and the cost was $125 per unit.  The Superintendent (Mark) organized the service by [redacted].1/**/2017– After [redacted] left,the problem had not been fixed.  Superintendent (Mark) stated that he reported the issue to ABM Management Corporation.1/**/2017, Evening – No one from ABM Management Corporation had reached out to us to give us an update on the situation after Superintendent (Mark) had reached out to them.1/**/2017, Late afternoon– ABM Management Corporation arranged  [redacted] & Rice Plumbing Inc. to repair the issue at hand without any notification of the emergency situation.Please see the descriptionof charges for this service below·        Checked the boilers and water heaters and foundall three boilersandthree water heatersto be carbonized due to heavy dust accumulation inburners.·        Completely disassembledall three boilersand brushed and vacuum cleaned same.·        Had to replace two pilot kits and ignitors (Boilers #1 and #2) which were found to be deteriorated during disassembly and cleaning.·        Found piping forwater heaterswas not configured correctly and was causing flue gasses to spill when all appliances operated simultaneously.·        Disassembled flue piping, supplied and installed the necessary new galvanized steel flue pipe and fitting to properly reset flue piping towater heaters.1/**/2017– Heat and hot water service restored to unit #2.1/**/2017– [redacted] returned to finish the job, please see thedescriptionof charges for the services below:·        Started upall three boilers and water heatersand tested.·        Adjusted the manifold gas pressure onall three boilersto thepropersetting.·        Found thatwaterheater#3had a damaged internal flue baffle and required replacement, informed owner. We understand that since carbon monoxide was leaking into the apartments that it was an emergency situation (That we were not informed of) that needed to be rectified immediately in order to maintain the safety of the building’s occupants.  What we do not understand is why the invoice for $4,450.72 from [redacted]. is only being attributed to two of the three units, since the invoice clearly states multiple times that the plumbers did work on all three boilers and hot water heaters.  The only time that only two units were referenced is in regards to the replacement of the pilot kits and ignitors, other than that everyone had an equal amount of work performed on their units.  Please explain why this invoice is only being attributed to two of the three units and why the cost for this type of job, which took place during normal business hours, was so incredibly expensive.  We look forward to your informative response.
