Feb 2014 Loaned Money for investment opportunity. He now refuses to reimburse mnonies. Feb 2014 Provided $20,000 along with another investor thru Melvin Malone for investment opportunity for a return value of $27,000. After multiple attempts, promises, and lies Javier Bailey has not paid out. Desired SettlementPayment of funds in the amount of $27,000Business Response Ms. [redacted] is correct that she put up funds that were involved in a property development. My understanding is that the principal amount she injected was $10,000. She has a friend that invested an additional $2,500. However those funds were funneled through a gentleman by the name of Melvin Malone. Her expectation of return was indeed $16,000 to Ms. [redacted] and $4500 to her friend; at least this is my understanding from my conversations with Mr. Malone. There were several cash injections and each was paid back with promised net returns. wever Mr. Malone received additional capital from these ladies while I was in the hospital. I ended up in surgery and was out of commissiopn for several months. Upon my return to the project, Ms. [redacted] informed me that she still had a payment due her. I went to the lawyers involved and asked that they release some monies to her. Mr. Broughton Initially I disputed that claim, but later agreed that the project could cover it. At one point, I offered to return the exact amount she injected, but was told that she wanted all of it (including her nterest) and did want just the principal. The project ended up in a major Chancery Court and Environmental Court lawsuit. The general partners involved in this action wanted to bankrupt the project which would have wiped out Ms. [redacted]'s interest. However I vetoed that idea, because of my promise that I would not allow her to lose her money. It is my intention to make sure that she does not lose her principal investment or her promised return. Mr. Malone has not been involved in assisting me in getting this done even though he was the person that brought her into this project and he was the person who seemed to have confused the payouts. I have been involved in major developments of this nature in Indiana, California, Louisiana, and Michigan. This is the first time that I have ever had an actual private placement investor to complain as a result of her / his inability to get paid. Most investors know that sometimes return on investment takes longer than anticipated. I am certainly open to any suggestions or remedies . Otherwise I continue to be committed to Ms. [redacted] being made whole. Consumer Response (The consumer indicated he/she DID NOT accept the response from the business.)His account of the occurrences is incorrect. I spoke directly with Mr. Bailey on this deal. Mr. Melvin Malone was the person to collect and deliver the money. Yes $15,000 (myself $10,500 and friend Miranda Allen $4,500) was given in the second account with the carryover of $5,000 from a previous deal that he also never paid out. The total submitted was $20,000 with an expected payout of $27,000. I was never offered a payout of the original amount. We were offered a very small amount in mid to late of 2014 because he felt that was all owed. We met to discuss after several phone conversations with myself, Miranda Allen, Mr. Bailey, and Mr. Malone and was promised a full payout. I have been told the multiple means of securing money for a payout: accounts from his current employer, cash in on 401 account, from his credit card. I was given a check dated 6/19/15 in the amount of $19,870.00 to cash and the banked noted insufficient funds.(See attached) I am unsure of the relationship between Mr. Bailey and Mr. Malone, but the responsible party for whom the deal was with is Mr. Bailey and this is who is held accountable. I understand that deals of this nature can be prolonged. But professionalism includes honest communication and this has not been displayed in this transaction. If Mr. Bailey feels Mr Malone has not been truthful with the amount, then he should handle that, but I spoke to Mr Bailey directly about the funds I was interjecting. These funds were counted, witness verified by Ms Allen and delivered to Mr Malone for delivery to Mr Bailey. If he did not received expected funds as we discussed, it should have been dealt with at that time in March 2014. The expected outcome should be full payout as promised on multiple occasions by Mr Bailey and Mr Malone. At this time Mr Bailey has not accepted any of my calls , nor has he called me since 8/4 on which he promised to call back. My last communication has now been with Atty. Zack Morris who is also a part of this deal.Final Business Response
