I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

On April 25, 2016 an estimate was
provided for Tom [redacted] and approx. 2 weeks after Tom [redacted] sent his
deposit of ½ down that is required prior to start along with a signed contract.  We received the signed contract with the down
payment on May 16,2016.  When down
payment is...

received is when it officially becomes a job.  At this point it goes onto a large board and
into a different file for scheduling.  The
first day that we were onsite dong work was June 7, 2016When we went to the site in
December it was to prep the site with good dirt prior to spring runoff.  Trying to think ahead to be able to utilize
the site as soon as possible in spring! 
This step helped us to finish the site in between major weather
events.  In December when talking with Tom about
the mishap with the double top spruce tree, I assured him that we were going to
go over on cost and finish the job right and leave them a great job.  At this time, we were under budget of the
original estimate that was provided to them! 
He agreed at that point to address all of the [redacted] concerns in
agreeing and keeping the project at overages that were discussed prior to
overages and was thoroughly discussed! 
Even when they made the request for a larger pad size.When meeting in the spring we had a
chance in person to look the site over together, and address everything.  From weather, to bad soils to, how I would
complete the job correctly and professionally regardless of what cost was to me
- and only charge them $2,500.00 more above original estimate cost.  This was my word to both of them.  They also asked me at that point if they gave
me only $4,000.00 if that would be ok, and I agreed.  So, all parties walked away feeling good
about the agreement that we had come upon.The 2nd installment had
nothing to do with getting things moving, [redacted] payed it because he owed
it.  So, at this point between
discussions by phone and in person everyone was on the same page.  When statements came out it shows a trail of
payments received and balances due.                From
the very first-time meeting with Tom & Becky [redacted] there was only one tree to be worked around and
I made this clear to everybody on my team. 
The operator I had working on the site accidentally tracked over the
spruce tree, snapping it off where it couldn’t be saved.  My operator reported it to me the very next
day.  Feeling horrible about what had
happened I called Tom asap, and let him know what had happened.   He was very nice about it and appreciated
the phone call but I could tell he was not happy of the loss especially working
around it myself for most of the work performed.  Any other trees- all were poplar and saplings
were the ones we had permission to take, not one tree that was taken or remains
that would never or could never be used in or for building purposes.  We went over this very thoroughly! Any trees
that were left onsite were to be removed in spring – at no cost.  We are talking two to three yards of poplar,
and small grubbing’s.  That’s when they
wanted it for fire wood for the site- we removed the remaining wood debris and
took it to our stump dump being the wood is not good fire wood, and it was
dirty.  We delivered a full-face cord of
dry oak & hard maple that was not found on their site!                The
message that tom had left on my office phone was very rude and not mistaken as
a threat, and very much a surprise after discussing every action throughout the
project.  He gave me a warning that he
would be taking legal action within the week. 
Then he proceeded to very rudely came to my office unannounced demanding
$4,000.00 reimbursement so he could go find other contractors to do the job
that I did for them that is complete.
Because they didn’t like the time it took to do their job properly – which I
get and understand.  That is why I spent
more money and time doing the correct process of making this a beautiful camp
or cabin site.   Again, I went above and
beyond on this job to accommodate them, and their wishes.  The property is ready to go, for whatever
they want to do with it.  Turn Key, for
building or camping.  No footings were
included just pad area!                When
discussing the site work there was many things to discussed!  I do remember Tom asking to make the pad 25 X
25 which we agreed to and we did just that! 
Dug out entire Subgrade and added pit run lifts for the pad area, well
over 3ft.                  The
Equipment issues that we had, had nothing to do with our schedule Other than a
few hours and our inconvenience.  If and larger Equipment needs a major repair
for any reason we rent or they provide a machine while repairs are being
done.  This was only brought up in conversation that is all!                I also
remember letting Tom know we would supply some screened black dirt for his
island area so it wouldn’t hold water after road was raised and finished.  We added 13yds of unscreened black dirt to
raise the island area - to assure no standing water, positive drainage, and
good growing base.  Then placed 4yds of
screened black dirt graded out beautifully and rocks that were found onsite
placed for cosmetic appearances.                We went
above and beyond for the [redacted], I stuck to my word and the companies work ethics
for professionalism.
