Response:

Please be advised that I am responding to Mr. [redacted]’s (ID [redacted]) complaint later than I normally would due to the fact that I was on vacation the last week and a half and only returned to work today.

Mr. [redacted]’s statement is in conflict with the facts of this matter. Under no circumstance did we offer to repair the section he refers to under the repair order for insurance related damages. We painted the left side panel of his pickup truck. We did offer to touch-up some unrelated marks on the right side of his truck as best we could at no charge. Touch-up is not the same as refinish and will not yield the same results.

The following is the e-mail I sent to Mr. [redacted] in response to his e-mail regarding this matter:

I am really trying to be reasonable with you and am sorry for my inability to communicate with you.

You state the job was incomplete because we were to repair both sides of the truck. This is inaccurate. We were only paid to fix the damaged left side. The other side (which was scratched previously) we offered to touch up, at no cost. We did advise the difficulty of matching a white pearl by brush touching. If we were to sand and paint the right side correctly it would have cost $454.92, which was the cost to paint the left side.

Hearing that you were unhappy with how the touch-up turned out, we attempted, again at no cost to you, to cover it with a black vinyl tape. Upon picking up the vehicle, your wife was told that if you didn’t like the tape, we would gladly remove it and any residue for you. She seemed pleased with it. I am sorry you were not, and I will gladly remove it for you. Please let me know a good time to do this. It will only take a few minutes and you can wait while we do it.

We truly feel that we offered to help you touch up chips (that were not caused by us) as a courtesy. We further tried to please you by hiding the chips under the vinyl tape. These courtesies are now being used by you as a means to recover your $250 deductible.

Again, you were not charged to “touch up” chips on the right side. They were done as a courtesy. If you can’t appreciate that, there is nothing I can do to stop you from doing what you feel you need to do.

The e-mail from Mr. [redacted] was the second e-mail he sent. The first e-mail (which said nothing about the paint chips or tape) asked for $100.00 because he was unhappy with the time it took to complete repairs. This was our response to that e-mail:

Good morning [redacted],

I am sorry that our services were not to your expectations. You should know that we guarantee the quality of our repairs 100%. However, we do not guarantee the time it takes to achieve quality. This is true for individuals, insurance companies, and rental companies. Most insurance companies recognize that there are too many extraneous circumstances and do not hold us to a guaranteed time. In your case what appeared to be a good color match in our paint booth changed when we viewed it outside. Having recognized that, we knew we would have to bring your truck back in to repaint the bedside and correct the color match problem. We did attempt to limit your inconvenience by scheduling the repaint at a time that a free loaner car would be available, and would fit in your schedule to allow you to have the truck for your Wednesday night fishing commitment.

It is our policy to do everything we can to limit our cus[redacted]er’s inconvenience for collision repairs, but as stated, we do not guarantee completion times. Therefore we cannot reimburse you the requested $100.
