Initial Business Response /* (1000, 5, 2015/11/17) */
Subject: Response to case #XXXXXXXX
In response to Mr *** and his account of his experience with us at Jay Feder Jewelers
First, and most importantly, I would just like to publicly apologize to Mr *** and his family for
the loss of the two carat round diamonds that were treasured family heirlooms given to him by his grandfatherAlthough our account of the entire situation varies greatly from what Mr *** wrote, the fact that we were entrusted by him with his cherished stones and they went missing under our watch is not under disputeAs the current owner and son of the founders of Jay Feder Jewelers, I am deeply saddened and heartbroken over this situation, but at the same time, also keenly aware that it pales in comparison to the inconsolable anguish that it has brought about to Mr *** and his familyAs I have explained in detail to him, the video evidence is all but conclusive to the fact that the diamonds were removed from the shipped package in transit from Denver to New York by an outside party
From the moment I became aware of the situation I was in constant contact with Mr *** and working towards a satisfactory resolution to this most unfortunate of circumstancesWe first spoke on Thursday, October 8th and then again the following morning of the 9thHe asked that I propose two options for resolution and I have attached the email that I sent to him with that proposal the very same morningI did not hear back with his decision so I reached out again to him on Monday by phone and again via textWhen he called me back he said he was still considering my proposal, but would like me to provide additional diamond replacement options as well as an increased payout amountAlthough the original proposal offers were considerable upgrades from a dollar value standpoint to what was lost, I considered the distress and anguish this had caused him in deciding to further compensate him with even higher quality replacement stones or an additional $if he chose the payout optionWhich amounted to a check for $I also gave him the option of purchasing the ring he had ordered for the deposit amount (approximately half the price of the ring) or taking a full refund of the deposit if he was uninterested in that ringSince I did not have a diamond of those specific new specs in inventory, we agreed that I would have one diamond of the higher quality option sourced and sent to Denver for his approvalUpon inspection, if he was satisfied with that stone, I would then purchase another of the same quality for him as the second replacementI contacted him on Thursday of that week informing him that the one stone was in the store for him to inspect along with an email of the GIA certificateHe told me that he was leaving town the next day and may not be able to make it to the store until his return on Tuesday of the following weekTo further accommodate him and expedite resolving this, I offered to have the diamond sent to him that evening via courier and even picked up if he was uncomfortable having it in his possession while he was awayHe declined my offer, but expressed his recognition and awareness at the lengths I was going to remedy the situationHe also acknowledged several times throughout this my complete and full attention to him and the situation as well as my willingness to accept responsibility for what had happened
The next correspondence from him was a text on Tuesday of the following week at 6pm saying that he was still in Vail and would like to come in on Thursday evening instead
Mr *** came to the store on Thursday and was immediately upset by the fact that I was not there to meet with him in personHe texted me asking me "where are you?"This was unexpected and surprising since he was always aware that I live on the east coast and work out of my New York officeAt no point in time was there ever any discussion or mention of him meeting with me that dayAdditionally, when my employee attempted to present him the diamond I had sent for inspection, he told her that there was supposed to be two diamonds for him there and declined to view itAgain surprising since we were clear on the plan for him to approve the one stone before attaining the secondThis plan did not changeThe only single correspondence we had since the previous weeks' discussion was the texts saying he would not make it in until that ThursdayHe left the store minutes later, making an obscene gesture to my receptionist when she politely offered to validate his parkingI tried to call him to discuss what had transpired, but he did not answer or return my callHe just texted me demanding a checkThe next morning (Friday) I had my bookkeeper cut a check for $13,plus the full refund of his deposit on the ringI had the check delivered to Mr *** via same day courier by midday
These are the details, accounts and facts of the situation that occurred
Again, there are no adequate words to make up for the loss of an heirloomI can only say how deeply sorry I am to Mr *** and his family and wish nothing more then to be able to return these stones
Sincerely,
*** ***
Initial Consumer Rebuttal /* (2000, 10, 2015/12/02) */
(The consumer indicated he/she ACCEPTED the response from the business.)
The diamonds were originally dropped off at the jewelry store the afternoon of August 24thThe diamonds went missing the same day or next day based on the how they were supposedly stolenThe fact it took an owner/manager over weeks to get involved and know of the situation shows how unorganized the company is
