We represent *** ***d/b/a ***'s ***, and have been asked to reply to your letter dated December 8, relating to the *** home, located at *** *** *** **in GeorgetownI understand that your clients wish to resolve the issues raised in your letter in an amicable mannerand I assure you that our client does as wellI will attempt to respond to the issues in the order that you raised them in your DecletterOur client will provide a detailed receipt, as is customary in the industryAs of this date, the outstanding balance due to our client is $The simple breakdown of this amount is $contract amount LESS total payments to date of $21,636, PLUS $in contract adjustmentsThe adjustments were for an added round extension and legs for a desk in the office ($873.83)and for a substituted counter top on the wine bar ($195)Both of these changes were ordered by Mr***While I doubt our client has any documentation relating to the contract that your client does not already possess, we will provide copies of any such documents in our client's possession& 4. Any further work to be completed at the house will he scheduled with the homeownersWe require the sameRelating to the -Open Action Items- listed in your letterI would first point out that our client requested permission to complete these items verbally on or about October and again by certified mail dated November The certified letter was never claimed and was returnedThat asideour initial responses are:
(a) Type of wood and staining: The statement that elm was used in place of maple on the fireplace and other areas is simply falseMaple was used, and to our knowledge remains in placeThe cabinets were all hand stained for the first coat, and were finished by spraying per industry standardThe stain was put on by hand.
(b) Claims of measurement mistakes: All cabinets were approved by Mr*** at the time of installation, and the second progress payment ($6.900) was made by Mr*** at that timeNo claims were made that the cabinets did not fit or were the wrong sizeWe require that our client be allowed to inspect these issues with the homeowner and be shown exactly which cabinets are alleged to be incorrectAll cabinets were built to the specs in the planswhich were provided to the ***s prior to installation(c) Missing Shelves: The shelves have been built and have been ready Ibr installation since OctoberAs stated above, our client requested verbally and by certified mail to be allowed to install the shelves but no response was received from the ***sThe shelves are in our clients' shop and can be delivered as part of the resolution of all issues(d) Clear vsSmoked Glass Inserts: I'm told that Mrs*** approved these inserts when they were installedI'm sure this can be resolved(e) Punch list items: Upon our client's inspection and final delivery, all punch list items will be completed as required by the ContractUpon final resolution, we will require full payment of the outstanding amount duePlease feel free to call me to discuss this matter and final inspection and completion of the projectOur client is ready and willing to complete the contract upon reaching a mutually acceptable agreement as to all remaining issuesWe would like to schedule a meeting at the house to discuss and document all outstanding items
