I (Joe B***) would like to respond to a claim made by *** *** against me or JB LiquidationThis is an abbreviatedor estimated timeline of the transaction details based on my recollection.I believe sometime in late August or early September of I was contacted by *** *** by phone who
wasinterested in purchasing a used copier from me on behalf of her organizationWe exchanged information I believemostly by phone where I explained the equipment that I had available & the basic terms of sale & I offered her discountpricing based on her non-profit statusA short time later, *** contacted me & said that her organization had approvedthe purchase of a used Bizhub ccopier with a finisher/stapler optionI sent her a purchase agreement & invoicethrough Paypal so they could pay for the transaction onlineThe Payplal purchase agreement ( See Attached) has veryspecific terms & conditions listed stating that the copier is used & sold as is with only good faith day limited warrantythat would cover parts only & only in the event of a defective partThe purchase agreement states that uponcompletion of the online payment the buyer agrees to adhere to the terms & conditions as listed on the invoiceWeserviced & prepped the machine prior to shipment & ran test documents, prints, copies & stapled samples through thefinisher & we have those test results on fileAfter the buyer or their associates paid the Invoice online & agreed to theterms & conditions, we packaged the copier & the finisher in two big protective boxes, packed in Styrofoam & shippedto them through a third party freight carrier (UPS Freight) Pro# *** & it was delivered to themIt is stated in thepurchase agreement that the buyer is responsible for inspecting the copier upon delivery & note any damage in writingdirectly on the delivery slip prior to signing offThe freight carrier has provided a scanned copy of the delivery slip signedby the buyer or their staff, stating that the copier & finisher arrived in good condition with no damage notedAs statedin the purchase agreement, it is the buyer’s responsibility to unpack the equipment, move it into their building, set it up,make any adjustments or correct any errors at their own location & expenseIt is noted that the buyer chose to performtheir own set up & adjustments & they did not hire any professional copier technicianSometime later they reported aproblem with the finisher after they moved it into their building themselves, installed it themselves & then theyattached it to the copier themselvesThen later they contacted me & stated that the finisher apparently had sustainedsome sort of internal damage & was malfunctioning but they had not reported any damage at the time of delivery thatwould allow it to be covered by the shipping insuranceI tried to assist them remotely by phone but I was unable todiagnose the problem without personally being on location so I recommended that they hire a copier technician todiagnose the copier at their location as stated in the purchase agreement & I could provide the replacement parts onlyas stated in the purchase agreementThey stated that they would like me to send them a complete replacement finisher& I stated that I did not have a complete finisher in stock but I may consider sending them a replacement if I was able toobtain one so I recommended that for the time being, they should remove the finisher & the transfer section & use thecopier with no finisher & no paper transfer sectionSometime later within days of the transaction, the buyercontacted me stating that the copier appeared to have a problem with the magenta color on their printing & they sentme image samplesIn this case I was able to remotely diagnose the problem based on their print samples & I sent thema new Magenta imaging unit valued at $at no charge to the buyerI shipped the part by USPS tracking number*** It is my understanding that they buyer installed the part themselves & it corrected theprinting problem but I never received any diagnosis or onsite trouble shooting of the problem with the finisher & I toldthem that I still did not have availability to a replacement finisher only partsAt that time I had the parts for the finisherin stock but I do not have the entire finisher & the entire finisher is not covered under the day parts only warranty onthe purchase agreementOnsite service & labor is not covered under the purchase agreementAll maintenance of themachine based on usage of the machine is not covered under the purchase agreement; only defective parts are coveredfor days as stated on the purchase agreementI never received a list of required parts from the buyer needed torepair the finisher because it appears that the buyer intends on maintaining the equipment themselvesTypicallymachines like this are professionally maintained under a service contract but JB Liquidation does not provide this servicewe only sell used equipmentSo assuming that the buyer is not a professional copier technician, they have no businessperforming their own service & maintenance & I would suggest that they hire a professional service providerJBLiquidation does not provide onsite service at the buyer’s location & we never claimed that we would do soThe buyerhas been using the copier for many months now & this can be documented by the internal meter counter on themachine & we have records of the meter counter reading at the time of the original shipment if the buyer would like toprovide verification of the current meter count readingSo at this time in brief summary, the buyer bought a used copierfor $that was originally valued at over $24,000, they bought it as-is, we made every attempt possible to remotelyassist them with any issue, we made service recommendations, we sent them replacement parts, but apparently thebuyer still thinks that they can provide their own service & maintenance which is most likely not possible or practical.We have documentation that the copier & finisher were tested & working at the time of shipment & we havedocumentation that the buyer verified that the machine was delivered in good condition with no damage & anythingthat happened after that point was at the hands of the buyer & due to their mishandling while moving it or setting it upthemselves or their own usage of the machine which can be verified by the internal meter readingI have been servicing& selling commercial copiers at my Ohio location for over years, I only sell quality working equipment, I am an experton these machines & I ship them all over the country to buyers who are not experts on these machinesObviously I cannot fly all over the country to service machines that were sold for $on the dollarIf the buyer would like to produceevidence that I caused the damage to the machine that they signed off on & provide evidence of the current meterreading showing that they have not been able to use the machine then it will be apparent that they have no claimagainst me as the seller & they have no claim for a refund based on the terms & conditions that they agreed to on thepurchase agreement & invoiceThey can either repair the finisher or remove it all together & use the copier without anyfinisher as the finisher is optional & they should understand that commercial copiers will always require periodicmaintenance without exception & the buyer should contract a professional service provider in their area.Thank you,Joe B***JB Liquidation
