Complaint: ***
I am rejecting this response because:Dear Ms. ***, In response to MrSmith's response to our complaint and in particular his comment that his company, "conduct business in a highly professional and upstanding manner", I wish to point several of the following contradictory facts outThese are ALL specific facts surrounding my project and experience with his business and, that for anyone reading this much less seeing the results of JC Smith's so-called "upstanding & completed work" in my master bath would find, casts a serious doubt on MrSmith’s delusional opinion on his company and in particular their service and quality of workTo the contrary, I don’t find it even remotely close to being of a professional level of quality work, and likewise his Company’s degree of service and nor do I consider the end results of their work as acceptable much less pleasing even to look at … to be quite frank. 1. For starters, it would seem to me that any professional Company or business owner would willingly provide as this customer had multiple times requested, a copy of their fully ratified contract (meaning not only my signature but that of the Company’s too)But, all I ever received that incidentally just recently came from MrSmith's attorney after I wrote him asking for it, was a copy that included only my signature and remained empty as far as a "Company Representative signature being present on it"MrSmith's attorney just said they (JC Smith LLC) "don't sign their own contracts" though mine (meaning my CT) was considered as legit, being MrSmith had proceeded with the related work. But having asked of JC Smith, to provide me specifically with a copy that reflected a company’s signature, why wouldn't they just give it to me rather than respond in such a ludicrous and "unprofessional" manner as this? What professional business would consider this as a respectable and professional practice anyway, I ask? Besides, why would their Contracts include a Company signature line on it to begin with, if their practice isn’t to provide one??2. Though my wife and I were told the day I signed the contract (June 30) and gave our $6,deposit money, by our initially assigned Project Manager, Jim B***, that not only would the project start on August 1st and to be completed within two(2) weeks time (though ultimately taking a total of weeks), but that, ALL of our jobs materials including our new Vanity, the tile, etc., would be ordered ahead of time during the -week lead time until its start date, none of it happened in such a way except for the jobs actual start date which did occur as committed to.Sadly though and for "ALL reasons caused by JC Smith, LLC and its employee's own doing and not by us the homeowners, who suffered throughout the additional weeks that followed beyond that initial committed 2-weeks for completing the job that JC Smith gave usWorse yet, as you will see more so below, we have continued suffering through this matter since Oct3rd as a result of all this. The contractor's inexcusable project delays all began with this actual fact:The so-considered, by MrSmith's as a highly professional business that conducts business in an upstanding manner ... did NOT order ANY projects materials prior to the job's start date as we had initially been informed would occur, but worse yet were not even ordered until sometime around the beginning of the 3rd week after the job startedAs a result, we were forced to change our first choice of tile to a secondary one, supposedly because the initial tile was no longer available without a 6-week wait on itBut later we learned it had been available up through early if not mid July even, if only JC Smith had done as they were supposed intending to do as MrB*** had told us, would be ordered by then. IMPORTANT NOTE >>> “ the secondary tile we wound up settling on following JC Smith’s failure to order materials before the job began, was in actuality, a "RECTIFIED" tile and to the contrary of MrSmith latest response to our Revdex.com complaint saying it was a "not rectified tile and therefore leading to our troubles"Well, obviously this was wrongfully stated and assumed by MrSmithI'm including a picture file showing a description of the tile as depicted directly on the tiles shipping cartonMoreover, as you will see further below and/or on the attached letter from our recently retained Certified Tile Work Inspector and Expert Witness's letter from MrDavis L***, the specific tile JC Smith installed is a "rectified tile" and has little or no warpage in itBut you will also see, MrL*** also went on to point out and detail many other “unacceptable” findings he noted as being outside industry standards in his letter that followed his mid-November inspection of the actual tile work. a) So is conducting business in this sort of manner considered by anyone as “upstanding” and “highly professionally conducted” work much less as acceptable work ethic I ask of anyone? b) Is this doing me as JC Smith’s customer, an upstanding or even respectable sort of service much less should be considered as acceptable I ask?? 3. Tim C*** … who John Smith referred in his response here as being a 30-year seasoned professional, actually caused two (2) separate event floods in our homes MBTH while performing plumbing work he obviously was not qualified to do and even commented to me didn’t like having to do. After the first of these two flood events occurred and MrC*** had made that comment to me, I specifically asked the Operations VP at JC Smith, Bill M***, that MrC*** no longer perform any remaining plumbing work but obviously this did not happen and is why we again a week or so later experienced a second and even worse flood. THERE IS NO EXCUSE FOR THIS COMPLETELY IRRESPONSIBLE OCCURANCE AND ESPECIALLY SO, FOR THE LACK ON THE PART OF JC SMITHS MANAGEMENT TO PROPERLY ACT ON THEIR CUSTOMERS ADVANCED REQUEST THAT MRTIM C*** NOT PROVIDE FURTHER PLUMBING WORK FOLLOWING THE 1st FLOOD EVENTWho wouldn’t agree?4. Tim C*** was responsible for relocating certain electrical wires while preparing the connections for two(2) new sconce style lights located above and to the right and left sides of our new vanity instead of the original removed center located single strip light fixtureIn the process of doing so, he disconnected our Jacuzzi tubs electrical wire located in the same light switch boxThat wiring to the Jacuzzi tub was never properly reconnected properly as the tubs jets have never functioned since as was discovered later on and reported to JC Smith who had done nothing about it since. Also, it should be mentioned to, we have since discovered that both of the installed sconce lights that JC Smith installed are extremely loose and can even be moved around on the wall when touched. They aren’t properly installed either. In fact, we have had serious doubt on whether or not MrC*** was properly licensed to even do our electrical or plumbing work and though have asked about this of MrSmith have never received a proper response backIs he?5. As for the grout: we followed MrC***'s and JC Smith’s V.Pof Operations, MrM***'s recommendationsAfter MrB*** consulted over the telephone and us present, with someone else who supposedly was an expert tile installer (and who was outside of JC Smith I believe was mentioned) decided on and recommended to both may wife and I that a 3/inch wide grout width size be used throughout all areas of the job (floor, shower walls and tub surround) and after we stated it was fine by us so long as this was typically considered in similar jobs as ours and considered within industry standards (as we relied on them to know as the “experts”) and even with that asked, they agreed and proceeded to install thereafter with the 3/32” wide recommended grout size.6. As to MrSmith's reference and comments regarding the so called the punch list he also mentioned was created on September 23, 2016, that situation and in particular that document I wish to clearly point out here and as I've previously stated to both MrSmith as well as his attorney, MrPetersen in writing, was NOT ever (then or now) construed nor considered by me and nor was it presented and/or represented to me in any sort of way by Dave L*** of JC Smith LLC, as representing not only my final expected walk-thru document, but it had NOT either depicted of any of the new detail information and concerns that were existing on the final day JC Smith was here as both me and Dave L*** who acknowledged so, discussed and knew would come later as I was still expecting and awaiting would later be our Final "END OF THE JOB ONCE COMPLETED" walk-through inspection that was to come and had much earlier been promised to me (as Dave Lknew) in writing (by email dated 5:PM or thereabouts on 9/23/16) from and by John Smith himselfMoreover, MrL*** also knew my wife and I had already met earlier that same morning (10/at AM) with MrSmith who we called to our house in fact, to discuss all of the concerns we still had as of then and especially those regarding the "still poorly considered tile work" as we put it to him and explained later to Dave L*** to that afternoonSo Dave already knew we had continuing concerns and needs when he asked me to sign the document he said was only a working list of items he initially listed out for his own purposes back on Sept23rd but wished me to acknowledge along with him as still needing attention then and having been worked on since when it came to my 10/signing he had asked for before agreeing at my request to follow up with me as to when exactly MrSmith would arrive for the final inspection and walk-thru documentation as was stated.Furthermore, MrSmith had promised me in a Sept dated email, to provide the final walk-thru as I had earlier asked for, "in person" himself "but once the job was completed" as he put it to meBut, Dave L*** absolutely knew this final walk-thru inspection to come from MtSmith was still wanted and expected by me and in fact, before leaving my house that last day, agreed to me at my request (on 10/03), that he would follow up the next morning with John Smith about this fact and to provide me a timeline when it could or would be provided (the final end of the job walk through inspection this meant)And with regard to MrSmith comment that Mr*** (and only individual who signed and therefore read his contract) had tried to hire MrL*** at the end of the job, DID NO SUCH THINGI (Mr***), never discussed any such thing possibility or made any attempts to hire MrL*** away from or for that matter, on the side if you will, to do other work for meThis is simply a LIE.7. In conclusion to this counter response to MrSmith of JC Smith, LLC response to our complaint, and as previously referred earlier to here, I direct your attention to the details that follow and that appear in the attached letter from MrDavis L*** who is a highly respected, nationally and internationally recognized Expert Tile Installation Witness on such matters as ours, furthermore also happens to be a nationally certified tile installer and related business owner himself I wish to point outIn this letter and report that followed his onsite inspection, MrL*** clearly points out in his report as you can see, where he found several areas within our Project, where JC Smith’s tile installation work falls outside of industry standards and are considered by he, as “unacceptable” and, requiring correction for the noted reasons.Simply put, this work needs to be redone whether it’s by JC Smith or otherwise by another chosen contractor once JC Smith has properly and adequately reimbursed us accordingly and that would clearly exceed well beyond the little all considering $2,referred to by MrSmith as owed him still. Sincerely,*** and *** ***Total of attachments including MrDavis L*** letter that also appears below along with nine (9) additional picture and the one video file that are ALL in support of that which MrL*** discusses in his reportThe first eight (8) attached files including the video one, came from and were made by MrL*** himself and forwarded later to me by himThe other (last 2) files, are my own pic files made of the above referenced tile box label showing it was a RECTIFIED TILE USED and not Unrectified as MrSmith wrongly claimed it was in his response seen earlier, and the last of another poor quality installed tiles that clearly could have not existed if only a skilled and upstanding worker had considered doing so or knew what he was doing in the first place.
Regards,
*** And *** ***

meeting or exceeding our customer's expectations.Tim C*** was the Project Leader assigned to the *** project, MrC*** has over years of experience in the construction industryTo summarize, this was a bathroom remodel project that included a tile shower, The *** selected non rectified tile, which means the tiles themselves have natural, uneven edges from the factoryThey initially requested no grout line and had Tim tape up each piece of tile so they could approve its appearance and placement prior to installing it, JC Smith installed it to their specifications, once it was complete they decided they did not like it, so we ripped it completely down and reinstalled it, again to their specifications. At the time the punch list was created September 23, (copy attached) they identified the tile as needing fixedDave L*** our Punch out Carpenter went back and fixed the items that were identified as a concernOnce the items on the punch out list were completed Mr*** and Dave L*** had another walk thru which was signed on October 3, indicating that "I agree that the items from the walk thru demonstration have been completed'Mr*** complimented Dave on the job and tried to hire him for other "side work” they wanted done.As always we have gone out of our way to accommodate the customer's requests which is demonstrated by the signature on our walk thru formMr*** owes a balance of $2,We have been in contact with our lawyer and will escalate this to whatever level is necessary until this account is paid in full. Please feel free to contact me if you have any further questions.Sincerely,John SmithOwner
