I hired JCS construction to do repairs on a bathroom caused by a fallen tree. My insurance company paid a large claim for the roof to be replaced and for the cost of the bathroom repairs. A bid was submitted from JCS construction to the insurance co for approval. The insurance adjuster contacted [redacted] several time to go over the figures he submitted in the original bid. After adjusting the bid the amounting submitted for the work was 10,444. I upgraded the bathrooms tile and it was an additional amount as seen in the emails. I paid JCS construction in full, When I didn't receive the depreciation money from the insurance company I called the adjuster and was told that I was over charged by $3,000 from JCS construction. I went with a lower quality roof and expected a larger reimbursement from [redacted]. I could never get a straight answer from [redacted] regarding the final break down that [redacted] was requesting. I told [redacted] up front that I was told by my adjuster that I could use the money in any way I wanted as long as the repair was made. I wanted a ceiling in my kitchen finished from skylight removal. I even spoke to [redacted] about doing the work. [redacted] will not return the $3,000 overpayment nor take steps to provide a breakdown of what exactly was completed by his company so I have something to submit to [redacted] for more depression reimbursement. I will be forced to take him to small claims court.Desired Settlement$3,000Business Response [redacted] hired our company (JCS Construction) as the General Contractor to handle her project associated with an insurance claim arising from damage caused by fallen trees. Our signed contract with [redacted] was for $60,482.00 and we also had an approved Change Order #1 from [redacted] Insurance for an additional $3,246.00. The document that was submitted by [redacted] to Revdex.com in her complaint is a Word document that has been altered and has no signatures. [redacted] went with a cheaper roofing system so that she could keep more of the insurance money. What she did not understand is that the insurance company depreciates the work and they only have to pay the actual cash value. Depreciation is only paid if the customer actually uses the money to return the property to its original condition. She chose a cheaper roof system and when the insurance company found out and refused to pay the depreciation she wanted us to cover the difference. Unfortunately she did not discuss her decision with us and refused to provide us with any written documentation from the insurance company so that we could advise her on how to proceed. When I finally spoke with her insurance representative, [redacted], she could not release any figures to me without [redacted]'s approval, which [redacted] would not give. We still do not have any written or verbal verification of what she was or was not paid by her insurance company. I told her repeatedly that I would be more than willing to sit down with her and her insurance representative to review the figures and try to work on a resolution. She told me that her insurance representative refused to meet with us, however, when I talked with [redacted], her insurance rep., she said that she would be more than willing to sit down with us and review the case. [redacted] also told me that her insurance rep. said that we owed her this $3,000.00 figure that she is claiming. When I talked with [redacted], she said she never said that to [redacted] and that she told her that this issue was outside of the insurance companies involvement and that is was between JCS Construction and [redacted], however she again stated that she would be willing to sit down with myself and [redacted] to review the case. The bottom line is that we had a signed contract with [redacted] and it was her responsibility to make sure that her insurance company would cover the work she signed for, and they absolutely would have had she not changed the scope of work in an attempt to keep more money. We had no control of what happened between her and her insurance company and we could not even advise [redacted] because she purposely left us out of the loop so that we would not be privy to what she was doing. I am truly sorry that she feels she did not receive what was due her, but again I cannot even verify what she did or did not receive. All I can do is verify what was in my contract and that we successfully fulfilled our portion of the contract and should therefore be compensated. She did ask us to not perform certain portions of the contract and she was credited for those portions of work in our final billing. I will forward a copy of the signed Contract, a copy of Change Order #1, our final invoice, as well as the [redacted] claim and insurance rep information so that they can be reviewed. We will also be sending this response along with the aforementioned documents via e-mail to Terry Schiller off the Revdex.com at [email protected]. [redacted]Final Consumer Response (The consumer indicated he/she DID NOT accept the response from the business.)There are flat out lies in this response! The State Adjuster had a hard time getting figures form JCS! She call him up front twice to get him to correct the bid because the first she knew wouldn't cover the amount of work to be done. I have documentation from [redacted]. I never altered any bids and have others I could upload if the system would allow. The numbers that JCS submitted to [redacted] and what I was charged does not match. Even with the extra he got from the insurance company I still over paid by $3K. I will be going to the contractors board and to small claims to get it back since [redacted] is not willing to make it right. I thought I would start here first. This had nothing to do with the depression amounts. [redacted] has never given us a break down of what work he did and the amount he submitted to the insurance company only the master bid that included the roof. I want to see what he bid for the only work he did which was the bathroom. Final Business Response As stated several times verbally and via email, I am more than willing to sit down with the insurance adjuster [redacted] and [redacted] to go over the numbers and come up with a solution. I confirmed with [redacted], for the third time, again on Monday, November 11 at 12:04pm that she will make herself available to meet with [redacted] and myself to go over the numbers so that we can come up with a resolution. [redacted] also stated that she is more than willing to confirm this with the Revdex.com. She can be reached at [redacted]
