On 10/18/2019 JD Lawn Service came to my house to install sod. We made an agreement before contracting this work that they were under no circumstances to operate any vehicles or equipment on our recently poured concrete driveway. Upon arriving, JD Lawn immediately backed their vehicle and trailer into the concrete driveway and began using a bobcat repeatedly in the driveway. I called my husband, who was home at the time, and he went outside to ask them to stop. My husband was outside and present when a crew member from JD Lawn set a pallet of sod down on the corner of the driveway and broke the driveway. I also have several neighbors who witnessed JD Lawn operating machinery on my driveway and placing a pallet on the corner. He called a representative from JD Lawn who said they spoke with the crew at our home and that the crew said they never drove any vehicles or equipment on our driveway. My husband showed video footage of the crew using a bobcat on the our driveway. The president of JD Lawn met my husband and I at our home about an hour after the driveway was broken by his crew. During this meeting, JD Lawn's president took full responsibility for damaging our driveway and offered to take the cost of repairing the driveway off of our bill. He asked that I provide him with a quote from a concrete company. I supplied him with a quote and he told me he would not cover the cost of the repair ($2630), but would offer $1500. He then began to state that maybe his crew didn't damage our driveway at all and that $1500 was fair and that I could take it or we could go to court. Jd Lawn's President argued that it took me too long to supply a quote, as if I have control over the scheduling of estimates from a concrete company. I have photos, videos, and eye witness accounts of JD Lawn operating machinery on my driveway after we specifically made it clear not to and of them placing a pallet on the corner and breaking it.

This correspondence is to inform you of our response from the complaint regarding Sod service on 10/18/19. Contact was made by phone with the homeowner on 10/29/19 to inquire if they had received an estimate for driveway repair. The reply was a no, but they would get back to us. On 11/18/19, as we had gotten no response, we invoiced the job and showed on the invoice a good faith credit of Eight Hundred dollars until such time as a competitive estimate could be presented by the homeowner. On 11/19/19 we received an estimate from the homeowner, However, there was only one estimate, of which the estimate was obtained from the Concrete Company the Homeowner works for, and it took thirty-two days for us to receive. Once the estimate was received, the homeowner was again contacted and informed that we would split the difference of the estimate as we did not crack the concrete, however we did drive the machine on the concrete, but not in the area where the crack was. Having discussed what had happened, we then stated that we would allow a discount of One Thousand Five Hundred Dollars to clear up the situation, as we felt the estimate was inflated and a conflict of interest on the homeowner’s part, giving the fact that they were an employee of the estimating company. We stated that we would contact a concrete company in the area for an estimate, which we did, and on 11/24/19 we received an estimate from said company in the amount of One Thousand Nine Hundred Dollars and No Cents. We emailed the costumer on 11/25/19 and stated we would have our contractor repair the driveway and we would pay him and the homeowner would be responsible for the original invoice, or in good faith, if the customer wanted their concrete company to make the repair, the customer would receive a credit for the estimated amount of $1,900.00, and would owe One Thousand Six Hundred Dollars and No Cents for the sod work performed. As of 11/26/19 we have not received a response from the complainant.

As was stated in earlier response we have done everything to make good on the situation. As far as the proposal goes it was sent to the homeowner on 12/2/19 that shows proof they are Insured and licensed. The company was referred to us by another concrete company *** that we use for concrete. We have never used this company so they are not a friend as the homeowner stated. The company came with a good recommendation. The homeowner has made no attempt to take the option on having us fix the driveway or take a discount of $1,900.00 off the invoice of $3,500.00. As of 12/13/19 we have not got a response back from the homeowner. We are taking the position that the homeowner is now trying to get out of paying any part of the $3,500.00 Invoice. Let me remind you that the job was completed on 10-18-19 and we have responded to the homeowner by email no less than one day after received. Thank you for your review and assistance in this matter.
