customers with the work that has been agreed upon.While it is agreed that we were hired to do excavating and were aware of a pool to eventually be put in, our job was not coordinated through a pool company and our job was large rough excavatingThe hillside was excavated with levelsDirt was dumped from top to lower level next to driveway expanding the landing areaThe top was rough graded for a 17’ poolThe work was approved and *** *paid usWe were requested to come back to make the area larger (possibly a misunderstanding of the actual pool size - seeing that she says it was a 24’ rather than 17')Typically we charge a minimum of $to take machine somewhere for workWe went back and excavated the top area back more as requestedWhile there, we were also asked to move sand that they had someone else deliver from the lower area up to the topWe did the requested excavating and moved the sand and were only paid $for our time and service.After several months, we received another callCustomer wanted re-grading and large stones on bankWhile we were not contracted to provide, we recommend that customer do some type of planting to prevent erosionThis was not doneWe agreed to deliver large stones and see about cleaning up the areas were the bank slidUnfortunately, the day that we were requested to work (*** *was off work), it was rainyWhile it was explained that it needed to be dry, it was insisted that we come at this timeThe stones were delivered and while grading was done, it was difficult and not the best due to the conditionsWhile there, we provided additional services of lifting shingles up to his roof and grading an area where a swing set had been.While the customer states that they are being asked to pay for the same services again from the pool company, this is clearly a misunderstanding of the different servicesThe cost for our large rough excavating was a fair priceFinal leveling and finish work from the pool company costs are beyond our responsibilityThese things were explained in a phone callAdditional calls from customer were a demand for additional work for free or a refundAgain, it is my desire for customers to be satisfied and I am truly sorry for any misunderstanding.Sincerely, Tina S*JDS Precision Industries, Inc

Date Sent: 6/26/12:00:AM*** ***Revdex.com*** *** *** *** *** ** ***6/23/2015Dear ***:I have received your second letter regarding a complaint assigned # ***Sad to say, I'm sure even Disney has had some people walk away unsatisfiedI'm not implying that everything we do is perfect, I'm just saying that over the years of business the majority of our customers have worked with us to resolve any concerns.Unfortunately, both the customer and my company failed in a big way with not having a specific written agreementThis is not our usual procedure and no doubt this led to where we are nowTo further complicate matters, communication was not always made while both of the homeowners were thereThere was always one party present, who approved the work, prior to our leavingIn an effort to satisfy and keep peace, we continued to work with this couple whenever they called for changes.We understand that customers work within the constraints of a budgetSo do weI'm not sure how much the customer thinks it would have cost for the pool company to do the entire excavation that was doneThe job of digging out a bank, re-contouring, and moving many tons of dirt is much different than a final level for putting in a poolThis type of prep is typically done right before installation - not months laterMost pool companies will charge between $and $for that part.According to the customer, apparently the result of helping with the sand and shingles was negativeObviously, there was a more labor-intensive plan for the shingles; but as for the sand, I'm not sure what plan there wasI am certain that every effort was made to not scoop any gravel; however scooping sand from a gravel driveway without getting any gravel would be an incredible task.After several months, winter, and a rainy spring, clearing out areas where the bank slid was needed.This is not so much an issue of work being done incorrectly, but rather the need for some type of planting to prevent this type of erosionThis was not something we had been contracted to do and had not been done by the customerBefore returning, we did communicate with the customer that it needed to be dry to deliver stones and re-gradeWhile the weather looked questionable, the customer assured us that it was not raining at their location and that the ground wasn't very wet It was raining and extremely wetDelivery of large equipment is different than just making and changing an appointmentMisunderstanding and breakdown in communication.Communication is meant to be two ways - sending and receivingI think of the times when I must, as politely as possible, tell a telemarketer that I am hanging upIt doesn't seem right, but when there is no real communication, it just has to stop at some point I do feel that we provided the service that we were called to do at a fair price and I am sorry that the customer is unsatisfied.Sincerely,Tina S*JDS Precision Industries, Inc

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.
 In response the company was hired to excavate for a 24 ft pool there was never a mention of 17 ft pool it had always been 24.  He did not excavate big enough the first time out and was called to come back and fix it, also he never once said that it was a "rough" excavating for a pool, because if that was the case we would have just paid one time to the pool company for the excavation.  John stated more than once that the area would be "pool" ready and he was an engineer and that would be level enough for them to install a pool.  He also stated that he would grade the yard so the water would flow down over the hill and we would not have any type of build up in the yard. The second call came after winter when we had a pond in our yard because it was not excavated correctly and the water did not drain, the hills were falling and the area for the pool was not big enough.  John never once got out of his machine and measured area, looked at a leveler, etc.  So as for being a professional and engineered license excavator we trusted that he "knew" what he was doing. When we had John out to discuss the job he said he would be able to grade the yard and the hill so we would not have to install retaining walls, as mentioned all the hills were falling so he was asked to come back out and look at it.  He did and then recommended we get some boulders he would come back out to grade some more and place boulders if we got them.  We received a call from John saying he found boulders for us and he would deliver them and place them for the fee of $700 which was agreed and paid to him.  When he came out it had rained the night before, again he is the professional and could have said when he saw the yard that it is to wet and I can not do it today and rescheduled.  However he decided to try it and was not able to complete the task instead he tore up our yard even worse.  Came back another day to move the boulders and place them.  He offered to move the shingles to the roof, that was not requested he said he would do that while he was out there, no one requested that service from him.  However again he should know the weight of his machine and what he is carrying, in doing so he crushed our patio that we had just put in place last year.  We did not ask or expect him to replace or fix that, we our doing that on our own, which is costing us another $500 in block, gravel, and sand to fix what he crushed.  Again he should know the weight of his machine and said it would be to heavy and damage our patio.  He offered to carry the sand up that was delivered the first time because he was going up to excavate for our pool.  However the sand that he did move up to the yard we were not able to use because when he picked the sand up from the driveway he picked up lots of rocks from the driveway so the sand was unusable for the pool which in turned cost us another $150 for 3 more tons of sand!!!!  When Mr. S[redacted] was called regarding the issue the first time while we had the pool guy there telling him what was not done Mr. S[redacted] hung up on my husband.  Then he ignored several calls to try and resolve this, when he finally answered again he in no uncertain terms told my husband that he would not come fix it without being paid and hung up on him again. If that is how Mr. S[redacted] responds to unsatisfied customers and complaints I am not sure how he continues to have any sort of reputable business reputation.  Sincerely, [redacted]
