Review: I am being harassed over a [redacted] I received which I am not supposed to be charged for. Even my doctor agrees that there should be no charge as it's been for the many years I've been getting them from him. This law office is threatening and harassing me and my wife. I want it to stop immediately. [redacted] are preventative care and are not billable, even for a co-payDesired Settlement: To be left alone and not be harassed and threatened by this immoral unethical law office.

To Whom It May Concern:

A letter of representation concerning this account was forwarded to [redacted] on February *, 2014. On February **, 2014, our client instructed our office to close out this account, whereupon our file was closed. There was no further collection attempts made, as the file is considered closed.

Sincerely,

Consumer

I have reviewed the response made by the business in reference to complaint ID# [redacted], and have determined that my complaint has NOT been resolved because

The fact remains that this supposed lawyer was willing to ruin my credit rating because his client was trying to get me to pay for a [redacted] when no payment was due. This supposed lawyer is corrupt and immoral for going along with such unethical tactics . He should be punished. I was able to convince his client to drop all the charges due by several phone calls to a person with an actual conscience and a brain. Something that this supposed lawyer truly lacks. Others inquiring about this supposed lawyer should know how corrupt he is and my complaint should remain with the Revdex.com for all to see. This is not Russia, this is the USA where fairness in business is supposed to flourish. I will not accept their lame excuses or replies .

Response:

On March **, 2013, North Shore-LIJ sent a delinquent account for patient-debtor, [redacted] (presumably the spouse/relative of the complainant, [redacted]), for an outstanding balance of $268.00 for services rendered December **, 2012. Our client indicated that an insurance payment was made to the patient and not forwarded to satisfy the bill. A collection notice was sent to [redacted], dated March **, 2013. Our client reported posting a payment of $268.00 on April *, 2013. There was no other communication from my office to [redacted].

Based upon the facts set forth above, there was no error on the part of our client in submitting the account for collection nor any improper conduct on the part of my office in pursuing the account for collection. Accordingly, the demand by the complainant (who is not even the patient-debtor herein), was not only unnecessary, but irrelevant. Moreover, there was no duty on my office's part to respond to such request.

Please note, this response presumes reference to the above matter as there was no identification in the complaint as to the creditor in issue, the date of service and so forth. There is, however, another account with North Shore-LIJ that remains past due involving the same household.

[redacted] was acting as a debt collector when he contacted my wife, who I can speak for regardless of what he says as per the FDCPA. I disputed the debt, knowing full well I sent in my payment information to the hospital after receiving payment from our insurance company because it was out of network. When the debt was disputed I am entitled to a verification of the debt amongst other things. This never happened as [redacted] knows. In the same letter I also asked for proof the debt was paid ( which it was ) which is also my right as I quote, " It must validate the debt by obtaining a verification of the debt or a copy of a judgment from the creditor. A copy of documents that verify the bill should then be mailed to you. When you send the collector proof that the debt is not yours or has been satisfied, ask for written confirmation that the collector is not holding you accountable for the debt. Some accounts, even though properly disputed with one collector, may be sold to another. This can happen years after you have successfully disputed an account" . This never happened because when [redacted] did his homework and found the bill paid he just pushed everything aside. As for [redacted]'s contention that there is another debt for this household, I now demand proof of that as well and consider this slander as my wife made one visit to the hospital and we have received no other bills. You are now on notice I wish to file another complaint. I want a letter from [redacted] or his client or I will pursue this matter further. My next complaints will be to the Federal Trade Commision and the Consumer Financial Protection Bureau

To Whom it May Concern:

This response shall serve as a supplement to my previous response of July **, 2013 as well as a reply to the complainant's rejection to said response. It appears that the complainant is objecting to the fact that verification of the debt was not forwarded per complainant's request. As noted in my prior response, my client reported the posting of the payment satisfying the delinquent account on April *, 2013 (approximately 3 weeks post my letter of representation to the debtor). As the payment was reported by my client, there was no need for further collection activity, including no need to verify the debt. Moreover, my response of July **, 2013 acknowledged receipt of said payment by my client and the date it was posted, April *, 2013. Per the complainant's request, I am attaching a statement reflecting the payment, posted on April *, 2013.

With respect "another account with North Shore-LIJ that remains past due" as referenced in my reply of July **, 2013, said account has been closed and returned to my client. Thus, this office is no longer attempting to collect such debt.

Sincerely,

[redacted], [redacted]
