On June 10, the client and I agreed on the scope of work and price, a deposit was received in the amount of $1, Work began as agreed on June 19, Please note the colors agreed upon on June 10, for two rooms were changed twice and finally confirmed on June 26.Since
starting the project on June 19, I have been in constant communication with Mr *** via phone and email and Mrs *** in person each morning my assistant and I arrived on the property to work We spoke of the process, progress and changes to the original work orderThe great room ceiling and baseboards became topics of contention as they were considered additional work (change order) to be added to original agreement made on June On June 25, we noticed a clerical error on the invoice That clerical error was the baseboards were included in the total price of $ My assistant and I noticed the error and immediately fixed it on the invoice and emailed the corrected invoice to Mr *** explaining the error This was then discussed in person with Mrs *** and on the phone with Mr *** I went back and forth with the clients to rectify and come to a new agreement There was also a language barrier in place further adding to the complexity of negotiations Knowing this, I proceeded to document conversations that took place on phone and in person via email I began to lose faith that I would be paid by the client Through all the negotiations for the new agreement, Mr and Mrs *** continued to say they can't pay and could not exceed the budgetKeeping their budget in mind and understanding the clerical error was my error, I continued to negotiate professionally, with empathy and out of good faith During the negotiations, the great room ceiling had been painted for the price of $500, which Mrs *** agreed upon in person, however later stated she didn't understand due to language barrier. I continued to negotiate with Mr *** concerning the ceiling and the baseboards, as I wanted to honor the agreement and have a satisfied client We finally came to an agreement that the ceiling would be painted for $250, that *** *** would absorb the full cost of painting the baseboards and that a progressive payment of $1,would be due along with a signed copy of new agreement With the delays brought on by color changes and contract negotiations, I informed Mr and Mrs *** that I can not proceed with the project until an agreement is made It was at this time I communicated I communicated to resume at a later date with newly agreed contract The negotiations, delay, restart date also became a very big contention The restart date was not agreeable with Mr *** and he decided to end the job and refused the newly negotiated agreement.I apologized through out the process and wanted to make good on the contract and satisfy the client In my years in the business, I have never had an unsatisfied client, nor a cancellation of a project due to quality of work or disagreementThis experience was heartbreaking and I was completely shocked to be terminated and not paid for the work completed. To this date, I am still open for reconciliation, mediation to turn the client into a happy client, honoring the newly agreed upon contract from June 28th or create a new one
