From our standpoint, this is scamWe have phone conversation recording and emails where we have reached out to JEI Director, [redacted] in professional manner to resolve the conflict However she absolutely refused to do so This proves that she intended to scam us on the prepaid tuition fee that not yet earned since her service had not yet delivered, completely and grossly taking the "nonrefundable" tuition policy out of context Ms [redacted] already informed my husband that my son is no longer welcome at JEI, that she does not have to keep my son in their center because they are a private business, and because she felt "threatened" she will call the police if we showed up She made it crystal clear that my son is not welcomed back and that they reserve the right to refuse service She resolves conflicts by making accusations and assumptions, making contradictory statements, gets too emotionally charged negatively, and defaming the character of her customers: she does not handle the matter in professional mannerThere is no process or procedure in place how to resolve disputes when disputes arise This matter would have been very simple if she simply told us she no longer can help my son and reimbursed the tuition This matter, I note again, is very simple and basic There was an agreed upon contract in place by JEI & us We have fulfilled our contract by paying the tuitionHowever JEI violated its contractual obligation to usTherefore they need reimburse us Regards, [redacted]

On August 5, the situation was very differentWhen *** returned to JEI after a long vacation, his condition was not ready at all to stay in a classroomTeachers had a hard to time to keep him on task in the morningWhen afternoon session started after a lunch break, he didn’t want to go to the classroomAfter staying in class for a while, he got frustrated from working then started to bang the table with his foreheadThe more our teachers try to stop him hurting himself, the more he threw tantrum kicking the table and chairs around him and screamingOther students in the classroom were scaredThis was when I called his mom to ask for help***’s mom tried to talk to *** over the phone but he didn’t listenHis mother came to JEI after a while then took him home
On August 6, *** was the first one to come to JEII greeted him as usual and he looked fineHe was active and playful until the class time startedAs soon as the class started, he was not in a good moodDuring lunch break, he was fineWhen the afternoon session started, he didn’t want to do his workWhen he found that he needed to make corrections to his math worksheet, he started to bang the table with his forehead againBased on the advice from ***’s mom on the day before, we had to evacuate other students to another classroom while trying to calm down ***She asked me not to offer any assistance which might instigate him to act out moreThen I called ***’s momShe wanted to talk to *** but he refusedLater his father called us and tried to talk to *** but refused again***’s father complained me about being called while workingI explained that it was my job to let parents know what happened with their childHe insisted that I had to keep *** at JEI until he comes back after his workI informed him that JEI was not a day-care center but an academic enrichment program so that our parents are more sensitive about any child’s misbehavior that might disrupt their own child’s learning experienceI also explained him that parents must be notified and need to make sure that their child understands that one must correct his/her inappropriate classroom behavior when a child poses a physical threat to oneself and othersSchools usually call their students’ parents when a student gets sick or becomes out of control to resolve the concerned situationThis doesn’t mean that the school is asking the student to quit the whole program
When ***’s father came to pick up ***, he asked for a refund saying that his wife wanted it, not himselfHe threw away ***’s study material on the floor then leftWhen ***’s mom called me later in the evening, I reminded her of our no-refund policyShe mentioned that the decision was made because her husband informed her that *** was no longer welcome at JEII never indicated that *** was no longer welcome in my classroomI only asked for their assistance with their son’s behavioral disruptions in the classroom on that particular dayLater ***’s father called me to say that he would retaliate by dropping off and leaving *** at JEI until he gets money backHis words were very harsh and threateningHe mentioned that it would be a MISERABLE EXPERIENCE for all the teachers and students at JEIThis implies that he was well aware of ***’s behavioral issues
When ***’s mother called me again, I mentioned about her husband’s cursing and threatening to JEIBut she told me that her husband didn’t remember any regarding his uncourteous doing and sayingIn likely manner, both of the parents didn’t remember that they were informed of our tuition policy on the first day of registrationWhen I mentioned about this, ***’s father denied that he was informed about this, so I provided (through email) another copy of contract that he signedOn August 12, ***’s mother insisted that she didn’t get a copy of summer school registration, which she needed for her recordI reminded her that I already emailed her a copy as an attachment then she acknowledged the receipt of it in April

I indeed took advantage of the discount given thus the reason why we have paid months in advance. We wanted our son to continue with JEI learning programHowever, JEI's "no refund" policy does not stand in our situation. As I noted in previous response that her policy is grossly one-sided and ambiguous not to mention she specifically informed us that our son is no longer welcome at JEI. When both parties enter into an agreement, both parties are responsible to fulfill their obligation. We have fulfilled our obligation by paying for service in timely manner as agreed however JEI did not and refused to render the services paid months in advance. In the eyes of the law and public opinion, it is indeed unethical business practice to enter into an agreement with its customers promising to provide high quality services only to turn her back on her customers when an issue arise and continue on an emotionally charged accusations and assumptions. We have reached out to JEI via phone calls and emails to discuss the issue at hand rationally however she has absolutely refused
As I said in previous response, this matter is very simple and basic. Was there an agreement between the two parties: JEI and *** family? Yes. Did we fulfill our obligation by paying JEI in timely manner? Yes. Did JEI fulfill her obligation by rendering promised service? No. Her "no refund" policy is absurd given she did not and refused not to fulfill her obligation.

Review: On 8/2/13, we entered a contractual agreement with JEI Learning Center in Irvine, CA to provide a service to our child named [redacted] by enrolling him to an early start program for improving learning ability during his 2nd grade school year 2013 - 2014. According to the signed contract's "ACKNOWLEDGEMENT OF REGISTRATION", the registration fee and tuition explanations are very subjective and ambiguous.

The issue came when our child took a one month break from JEI Learning Center. His second grade school ended in June 2014. We sent him to Oak Creek CDC in July 2014. He re-started attending JEI Learning Center in August 2014 to prep for his third grade school year.

On my son's first day at JEI Learning Center, he didn't listen to his teacher. The director called me up around mid day and demanded to have my child picked up right away. We talked to my child. On the next day, we dropped him off at JEI Learning Center. Around mid day, I received a call from the director demanded to have my child picked up again. I asked my husband to go pick up our child. He called the director and tried to work something out with her. She refused to have my child on the premises. She said her learning center is a private business. She wasn't obligated to keep [redacted] at her learning center if she didn't want to. She informed my husband that our child was no longer welcome at her learning center. He asked if she would refund the balance since the August tuition was paid in advance, she replied she would check. On the following day, my husband called her and asked when she would refund the balance of the tuition, she said no refund.

The whole situation appeared to us like a scam. The director refused to provide a service that already paid for, refused to refund the un-used portion of the advance payment, and refused to allow my child to be dropped off at JEI Learning Center.Desired Settlement: We paid in advance for the August tuition in the sum of $1,052 back in April 2014.

JEI Learning Center only provided services for two half days. Based on the prorated amount, JEI Learning Center owes us $951.20.
