Review: In late February, 2013, we contracted with JEM Fire Prevention, owned by [redacted], to have them do all work necessary, to correct a violation issued by the Fire Department to us. We have a hood and grill in our deli and the Fire Department had issued a violation w/regard to inadequate fire protection systems for the grill/hood. As this is our first time dealing with such a violation,we relied on JEM's expertise and assurances that ANY and ALL work, including filing, associated with removing this violation, could be done by their company. JEM's letter to us describing our agreement states: ....(we) "has hired my company to upgrade fire suppression systems as well as doing the necessary filing". As shown by two checks cashed by JEM, dated 2/**/13 and 2/**/13 (each for $1600) we paid the agreed upon amount of $3200 to have the work done. The check dated 2/** states "Fire system- Fire Department" in the memo area, as noted by JEM; the check dated 2/** specifically says "Fire-Remove Violation," also as written-in by JEM. JEM installed the fire suppression systems they deemed to be necessary; when asked for more money to complete the necessary work, we provided $500.00 for the appointment JEM was to make and BE PRESENT FOR with the fire department; and $210.00 for the Fire Department to come and do a test of the fire suppression equipment. On the day scheduled (9/**/13), the rep from the Fire Dept. arrived and did the test-- but JEM FAILED TO SHOW UP; without the contractor (JEM) to explain and demonstrate the fire suppression systems, the Fire Department of course failed our store. As a result, a worker at our store was issued a summons to criminal court (on 11/**/13) for failing to properly correct the violation. JEM failed us by failing to show up! When we contact JEM, they initially agreed that they would complete the job, stating that it might take a while longer because there was still a concern with whether the installed hood was fully permitted by the city. However, time passed and JEM did nothing. When we stated that we wanted to set up a contract with our lawyer to specify exactly what work would be done (if indeed extra work would need to be done) and what was expected, JEM refused. They would only do the work if we handed over more cash, with no guarantees whatsoever. This was not satisfactory to us, as JEM had already broken their agreement with us. We are now completely stalled. We have outstanding, incomplete paperwork with the city; fire suppression systems which may or may not be good enough, that have never been reviewed by the Fire Dept. WITH THE CONTRACTOR PRESENT, as is required; and now, a criminal summons issued to our worker that we cannot respond to because EVERYTHING HAS BEEN STALLED BY JEM. Simply put: JEM represented themselves as experts with a full understanding of ALL that was required to get this violation removed; they promised to take care of our problem, took our money, but never finished the job.Desired Settlement: We want JEM to finish the job, plain and simple. We want the violation removed, as they promised to do. We want them to make sure, as they said they would, that ALL necessary paperwork has been filed, to RESCHEDULE an appointment with the Fire Dept; to SHOW UP for the appointment, and to see the entire job through until the Fire Department is satisfied and our violation removed. Additionally, so that we have some way to avoid further problems, we would like to set up a legally binding contract, in our lawyer's office, to specify exactly what is further required of JEM and exactly what might be required of us to see this entire process through. Our primary concern is that we get the violation removed, and that JEM should COMPLETE THEIR WORK, as promised.

At this time, I have been contacted directly by Jem Fire Prevention Corp regarding complaint ID [redacted], however my complaint has NOT been resolved because:

JEM sent a representative to meet with me in my lawyer's office (NOT the head of the company, who I'd originally contracted with). However, we became clear that they were still acting in bad faith when

they told us they were holding the check for $210 because they hadn't had the Fire Dept. come and do an inspection yet-- but that check was cashed, as shown by our bank!

we tried to get something on paper agreeing on terms for the work to get done, and discovered that the representative who came to my lawyer's office WAS NOT LICENSED and could only engage in a verbal, not written agreement

they did not bring, and still have not returned, ANY of my paperwork. They have our violation notice and any and all paperwork pertaining to the grill/hood and any associated permits.

So, because they could provide ANY WRITTEN GUARANTEE and DID NOT HAVE A LICENSED PERSON TO SIGN ANY AGREEMENTS when we met, we were completely unable to reach any kind of agreement, THEY TOOK OUR MONEY AND OUR PAPERWORK AND THE WORK IS STILL NOT DONE.

Review: [redacted] the [redacted] of Jem Fire Prevention Corp license number [redacted] was hired to install a kitchen fire suppression system and he commenced the installation and didn't finish he was paid in advance approximately 15000.00 dollars. Consequently, because the installation was not completed to the NYC Fire Department requirements I have been fined several times due Jem Fire Prevention's refusal to complete the work. I have called him several times but to no avail he does not pick up his telephone nor does he return any phone callsDesired Settlement: I would like a complete refund of monies paid in order to contract a different company to complete the job
