Review: We had our home damaged by hurricane Sandy - we had a proposal written up by Jemar Contracting (employee [redacted]) 12/16/12 we signed contract at which time no were on contract did it say anything about refunds if cancelled nor did employee say anything about cancelled contracts. We gave a deposit of 11,544.00 on 1/13/13 at that time I was told work would begin when check cleared. some 2 weeks later we had a meeting with [redacted] and [redacted] I clearly stated project will move forward and be done based on insurance monies as I was not going into debt to make damage repairs. late Feb early March we found (A) we were not getting enough from insurance to fix house (damage was around $115 thousand we got $99000.00 from insurance ) thebn we found it would be another 50,0000 to raise house only to find insurance only gives 30 to do so and only after you do it. we decided then to just sell house and property as is. I advised [redacted] in March and that I would like return of deposit. He put me off for almost 2 months then advised his time spent on project (HIS TIME) was 80 hours His worker spent 40 of his time plus he gave him a 2500.00 bonus which came to a total of 11544.00 now NO work what so ever was done to house NONE. plus he claims he worked in December but no work would start till check cleared which was January ?? I feel he took advantage of us during a very difficult time I ecpected him to keep some money maybe 2500.00 or so. but all of it. He is a crook period.Desired Settlement: I want at least $ 8000.00 back from him ASAP

**. & [redacted]. [redacted] signed our contract on December 15, 2012, without pressure from myself or my representative.

The proposal they executed with us was very detailed and hid nothing from the owners.

Once the proposal was executed we began planning the project for construction. When the owners signed the contract nothing was represented to us about previous bankruptcies by the owners so we immediately began planning the project.

Our planning consisted of

1) managing the project as proposed (and)

2) alternate ways to perform project which would save the consumer monies.

We had change orders signed and paid for as well for structural stability surveys, and structural surveys for the house raising.

I had secured and paid for the structural engineer and provided ground test cuts so the structural engineer could properly perform their evaluations.

We brought in equipment too dig around the property so the engineer could properly survey the site as well as I personally operated the machine.

The amount of homes damaged in the NJ area led to considerable time delays for structural engineers hence the two month delay.

We returned the payment for the structural survey even though we paid the structural engineer in full.

We also ordered and paid for topographical survey's by a NJ Licensed surveyor.

We sent the documents to the [redacted] less the structural survey as their payment was returned for the Structural Survey, less the cost for the topographical survey.

We also had at least 12 different meetings on site with several different subcontractors so we could obtain not only their pricing but also scheduling and procedures to perform the project once the permits were received.

**. & [redacted]. [redacted] panicked when they heard they were only going to receive $99,000.00 from Insurance. So they cancelled the contract without discussion of how we could value engineer the project to reduce their costs.

As far as the home raising we offered our home raising subcontractor to them, but once again their panic outweighed value engineering options. If they would have managed the home raising on their own, they could have easily had this service performed for the $30,000.00 offered by FEMA.

As far as raising the home, the owners could have raised the home within the next three years without additional insurance requirements.

My main office is 1.5 hours from their home each way. With 12 subcontractor meetings alone I had 18 hours in driving time with the cost of fuel, tolls, wear and tear, etc. This does not include the allotted times for meetings with the subcontractors, as well as planning time performed, reviewing estimates and schedules, etc.

I had four separate trip to the [redacted] Township building to meet with code enforcement, as code enforcement was changing daily due to the storm.

It is common practice to receive deposits on projects as these, for planning and scheduling. These deposits are never returned to the owner unless it is within their three day right of refusal. This means that the homeowner has three days from the day they signed the contract, to cancel the contract.

The deposit was received 30 days after they signed the original contract, so their right of refusal already expired. They cancelled the contract which was signed in December for months later in March. This is after misleading us for four months.

I have also been informed that the homeowner gave the home back to the bank which holds the mortgage.

Jemar Contracting, is a fair company. We do not take advantage of homeowners. When deposits are received we do not deposit the checks until the three day right of refusal passes. If the homeowners wish to execute their three days right of refusal within the allotted time period we simply send them their check back.

Two months after the [redacted] cancelled their contract it was asked of me to send a paid invoice for the deposit which initiated our planning and scheduling. This request was performed immediately as I received it form the owners.

I apologize the [redacted] are unhappy, but I did not cheat them in any way. As far as the payment to my representative, it was not a bonus as **. [redacted] states, it was the salespersons commission payment from the deposit.

I am rejecting this response because: [redacted]'s memory is selective at best (just like my insurance co [redacted] insurance) (1) we already had the 99,000.00 from [redacted] in November as well as 40,000.00 for our contents [redacted] knew this when we signed contract. We awaited the funds released from Bank of America who is holding the insurance money. We disclosed at the signing of contract we had filed for bankruptcy and that we thought between the 99 and 40 we could get house repaired we discussed this at our meeting after check cleared again we divulged bankruptcy and said numerous times project will continue as long as insurance monies cover project (at this time I had a Private claims person working on getting more funds) and we were not going to finance any repairs (which he kept pushing) We were not going back into debt (my wife has been out of work 3 years) We did not panic as [redacted] stated nor lead him along. On 2/28/13 I finally was contacted by insurance in regards ti ICC money for raising of house I was told at this time I had to put money out first then submit for 30,000.00 that is all they pay. [redacted] himself gave me estimates (verbal) of 50 + to do this project, This is when we decided to put house on market as is and cancel project. Yes the house is listed with ERA as [redacted] stated it is not in forclosure or "given" back to bank. [redacted] is and has been working through all of this with us we still are the owners of this home . It took [redacted] 3 months to respond to me . I doubt very much he had 12 meeting with different contractors what was his worker based in [redacted] doing ? also he only returned 4300.00 of 4800.00 he was given for engineer. again I feel he owes me as I have spoken to a many of a contractor and they shook their heads in disbelief. I also spoke with my local Councilman who lives on my street were house was damaged and he also feels the same way and will let the the people to be know of this.

Lying will get you nowhere. Any business person who knew of previous bankruptcies would have walked away from you in the beginning and you were smart enough to know this, that is why you did not divulge that information.

With your proposal you attempted to defraud your insurance company by enlarging your Florida room and kitchen. If we were given the opportunity to value engineer the demo and square footage increase of your Florida room, we could have easily come within your budget.

Not only would you have had a brand new home, but you also could have made money selling this home after completion.

I apologize you are not happy and dissatisfied.

When I took your wife and you out to dinner in January you mentioned how extremely competitive our pricing is, and you could not turn it down. We did not perform the demo, you did. The insurance company only covered 4 feet high from the floor, you demolished the entire interior of your home. This was your decision to force the insurance company to cover your claim.

You did not have to enlarge the Florida room and your kitchen. You could have renovated back to the original condition of your home, but you chose not to.

You lead us on for several months, as I ran back and forth to your property, to meet with more cost effective subcontractors. This was so we could reduce he cost of the renovation to you.

We met with several modular manufacturer's as well as manufacturer's of panel construction in case the home was structurally unsound.

Once again, I apologize you are not happy but 100,000 homes were affected by the storm.

Codes changed frequently during the months before you decided to rescind the contract. And they are still deciding on the new flood maps for your area. FEMA came out with new flood maps in February I believe, that shook up the entire area including your Township Engineer.

You could have easily performed all this work in your budget, had you not wished to attempt to defraud your insurance company with the enlargement of the Florida Room and opening up of your kitchen. You would have had to contract the home raising yourself through the subcontractors, to maintain your budget.

You forgot to mention that I sent you a check for $4300.00 for your change order for the structural engineer, after I had paid him in full as well as the topographical survey.

You have seemed to leave all important facts out so people continue to feel sorry for you. I did not have to return that $4300.00 but I did. Please begin to be honest and stop dragging me down with you.

I had calculated 80 hours of my time at $75.00 per hours for planning the renovation and reconstruction if necessary, as well 40 hours for my estimator. That is 120 hours at 75.00 which equals $9000.00. I had paid a commission of $2500.00 to my salesman, once I received your deposit. Now the total is 11,500.00. I paid the structural engineer and the surveyor several thousand on top of that. I could have invoiced you legally for advertising fees to replace the work that was lost when you rescinded your contract, but I did not.

I did not bring the storm that ruined your home, nor did I take advantage of you in any way. You were the one that was trying to take advantage of the insurance company. You mentioned in your complaint that the insurance company already gave $99,000 for the damage and 40,000 for the content. The contract was $115,000.00 which you had sitting in the bank after you collected it from the insurance company. You had plenty of money to perform the renovation, plus you have three years to raise your home to the new flood zones calculated by FEMA.

With three years to save for the raising you had plenty of money for the entire renovation, especially if you would have value engineered the enlargement of your Florida room and kitchen out of the project.

I am rejecting this response because: As I am not lying maybe you should think about who is here, I did mention your return of 4300.00 maybe you should take a closer look. I wonder if we asked [redacted] about all of this and who said what. I would be very interested to hear what he has to say . You seem to be full of explanations of what I should have or should not have or what I said or did not say the bottom line is you spent $11544.00 on what ? seems like over charge to me and many others I have contacted including [redacted] and township officials.
