Business is withholding security deposit for reasons (Air conditioning repair and normal wear and tear)Business withholding security deposit for A/C repair to rental property and for normal wear and tear (minor dirt or spotting on carpet - no distinct stains or heavily soiled areas; few small tack or nail holes in wall where pictures were hung) The property manager states that the bedrooms need to be painted. NOTE: bedrooms were not freshly painted when I moved in. I had to request that nail holes be repaired. These areas were "Patch" painted leaving noticeable areas above my bed and on the bathroom wall that did not properly match the existing paint.Desired SettlementI am seeking refund of my security deposit. I left the apartment much cleaner than it was when I moved in. The property manager is withholding money for air conditioning repairBusiness Response This case was resolved, and the remaining security deposit was mailed to the tenant. The tenant violated the lease by not replacing the air filter, and causing the unit to "freeze-up" and stop working. A full diagnostic was performed on the air conditioning unit, and no issues were found. Once the filter was changed and the unit "thawed out", the unit began working once again. The conclusion from our HVAC repairman was that the unit stopped working because of a clogged air filter. Therefore we charged the tenant for the diagnostic fee and time for our tech, which came to $125. This was pursuant to the lease document they signed for their unit.
