records of the transaction that occurred in March of 2012 between Jensen Roofing Ltd. and [redacted] regarding the shingle replacement on two guest houses, I find your demand to have the rotten fascia boards, plywood and any other compromised members of the roof structure replaced at the sole expense of Jensen Roofing Ltd. to be unreasonable for several reasons. I am also not willing to embark on any such undertakings until this aspect of the situation is resolved. As per your letters you describe the scope of the contract "was to make all necessary repairs to any damages to the roof structure including replacing some plywood on the roof and the fascia wood that holds the eaves," yet I find no mention of any of those specific items anywhere on the written contract to be included with the price of $14,964.60 including GST. What the contract does say is "Inspect the roof deck for any possible damage or rot," and "sheeting repairs are extra depending on current costs plus GST," which means any costs related to rotten wood replacement of any kind would be over and above the total amount outlined on the contract. As the total invoiced amount on Invoice [redacted] is the same $14,964.60 including GST and the same amount you paid via cheque number [redacted] on April 23, 2012, you have not paid for any such services to date and therefore any such work associated with replacing rotten wood now would also be charged over and above the services that you have already received. Your letters also mention that "there is evidence of water damage," and "This is not a situation that has occurred over night," yet you make no mention of attempting to address these issues prior to April 2016. I also do not have any service records documenting your specific concerns or any concerns at all in the four years after the roofs were installed in March of 2012. Also the type of water damage that you refer to in your letters and the pictures your associate emailed me would have produced other obvious symptoms of a cause for concern about a shingle installation related deficiency prior to the damage that you are observing four years later, and had action been taken at such a time the costs and extent of repairs now required could have been vastly reduced. As the workmanship warranty offered by Jensen Roofing Ltd. states "Nothing in said guarantee shall render Jensen Roofing Ltd. liable in any respect for any damages to said building on/and contents thereof," as well as several other clauses, I am only willing to cover the cost to replace any shingles and underlayment materials only as required to correct the damaged roof deck and any other possible deficiency causing the current condition as said deficiency relates to the installation of the shingles and underlayment materials only (the scope of the original contact). This does not include any deficiency related to insulations, vapour barriers, soffits, or any deficiency found with the building envelope that in Jensen Roofing Ltd.'s opinion is a contributing factor to the described condition. Also, as mentioned I am not willing to cover any costs related to replacing the damaged plywood and other structural members or correcting any other possible deficiencies with the building envelope contributing to the current condition, and that these cost be the sole responsibility of the [redacted] as either the [redacted] has not paid for these services to date, or are a resultant "damage" to which Jensen Roofing Ltd. is not liable as per the workmanship warranty, and until these terms are agreed to by The [redacted], there is little more that I am willing to do at this time regardless of your proposed deadline of March 25, 2017. Regards Tyler JensenJensen Roofing Ltd
