We hired a contractor to do work on our house & he basically took most of the money, did some (light work) & has no money left to complete jobs.

1. We received a grant from the state to finish basement for my bedbound brother. *** received $44,000 & cannot finish.
2. We hired same guy to add a garage for storage, again no money to finish job.

Desired Outcome

Other (requires explanation) Money to finish our project with someone else.

To whom it may concern,

In response to the complaint regarding basement remodel and garage addition; We started the basement project in the spring of 2018 through the HMLP Program sponsored by the State of Ma. The garage addition (which was a separate contract)
was supposed to be started and run simultaneously with the Basement project. The project had many delays partly due to schedule and permitting process with the city. The city required us to have the lot surveyed plot plan and to have rain water delineation drawings completed by a civil engineer.

When the permit was finally issued it was late fall so it was decided at that time by the homeowner to delay both the garage and Basement projects until better weather in the spring of this year. I started the garage in late the spring with a completion date of both the Garage and Basement no later than August which I felt was reasonable. In having the lot surveyed it was determined the original Garage size would have to be reconfigured to adapt to setbacks required by the plot plan. The garage originally was to have a small storage space accessible from the second floor but I expanded on that and built a full upper floor complete with 3 windows as well as a transom window over garage door opening. Rough electrical was installed tO allow for easy finish if they so chose. I should also mention the other items that where completed and they haven't been charged for, a new Bay window in the Living Rm., solving a water issue by running the downspout underground at right side of house, remodeling the hallway from 1". floor to Basement area, Surveying and Civil engineering. Although we had many projects underway at the time we felt we could meet the deadline of August U T.
The Garage was at about 80% complete and the Basement was at a similar position. However when I asked for a progress payment on the Garage I where told that there would be no more payments until the projects where complete. There was a balance of approximately $24,000 to be collected on both projects which is more than enough to complete the work. I went as far as we could in hopes of convincing them to make at least some kind of payment at least towards materials and I would show good faith and finish, but that wasn't offered. Shortly after I received a letter asking me not to return.

My intention was and still is to finish these projects for the homeowner.
I'm willing to have an Arbitration hearing and/or have a Mediator step in to help us negotiate a settlement if possible and comeback to complete this work on a strict timeline of course.

Jericho Builders was hired to do 2 jobs for us, under 2 separate contracts. First contract was a Home Modification Loan from *** for basement for my bed bound brother. And the 2nd was to add a garage with loft, for storage that we were losing from basement, also another $48,000.00 job. *** took $44,000.00 out of a $48,000.00 from ***, within June 2018-Sept 2018. *** was unable to finish basement project cause he had no money for material and couldn't collect the last payment until final inspection. As of Aug 2019 electrical work, bathroom, heating, plumbing, trimming, flooring wasn't done, egress window not dug out. Meanwhile *** also received $19,000.00 towards garage May of 2018. But was unable to start till Mar 2019. He had the nerve to ask me for more money for garage that wasn't even started. I said, no. He had all these excuses about not starting garage. This was Oct 2018. In early June 2019 we gave *** another $10,000.00. By end of June 2019 We received a bill for $14,850.00 from A-Roc for concrete/excavation that *** never paid for work done our garage by them. As of Aug 2019, they were still not paid. They have threatened to put a mechanical lien against us. We told them to not bother us it's between them and ***, which he was already paid by us. When we found out about this, we still gave *** chances to finish work. But, I withheld garage money till it was done and A-Roc was paid.Things that weren't done for garage, no garage door, siding not done, firewall missing, no gutters, electrical work not done and no driveway. *** said everything would be done by Aug.1st 2019, by 2nd week of Aug 2019 I reached out to *** about flooring for basement, he asked if I had a credit card that he could use for materials for basement. *** did say in July 2019 that he was having financial difficulties, waiting for other deals to go through for cash. By the end of Aug 2019,he still had no money for materials, so we fired him. after all this should have been done a year ago per his contract. We had set backs but its been one excuse after another to get these two jobs done. In Sept 2019, when we started to do all the complaints against him, we noticed the permit for the basement was in someone else's name, that we were not aware of. Turns out Jericho Builders license was expired and he asked another contractor for his license number. I have heard that there are 8 other Home Modification Loans in the same boat as me. My question is what did *** do with all our monies?? The Home Modification Loans all has to be paid by us the homeowners when we sell or transfer our homes. *** stole from us. That is why he wasn't getting another penny from me. And the person who suffered the most is my poor brother whose been waiting to have a shower not sponged bathed. He's been in an apartment that's not handicap accessible for many years.
