[redacted] and I had a conversation over the phone on 11-5-at 11:a.mafter he arrived home from California, as this is where he told me he was going to with his trucking businessHe did call, and told me he was happy with the job, what was done, and that he would be sending the balance due of $On 11-5-at 6:p.mhe sent me a text stating the following: Jerry, Please send me a stemized list of the work doneIt seems to be a little more than a just workThx [redacted] (His words and spelling exactly) My response that I text back to himI am a bit confused with your messageCan we meet tomorrow to talk about your concerns? His response was: No, just send me an itemized list of work doneIt seems to much400$ too much My response was: I will send a list tomorrow of the work WE agreed upon for $After our conversation you stated you were happy with the work that was completedNow you are saying it is too much moneyI am sorry you feel this way, however you made a legal agreement by sending me a down payment of $and the balance of $upon competition of the job His response was: - Legal is an itemized statement of work doneAn oral agreement is muteSend me proof of your estimate and of all costs My response was: I will NOT be sending an itemized list of material cost, I will only be sending a itemized list of what was doneIsaved before and after pictures of what was done, and what you wrote on your list of what you asked me to doIf it takes going to court to resolve this, no problem, I have all the time I need as I am selfemployedI do not want to go this route, but will if forced to- Their is more to this conversation, and I would be happy to share with you (Revdex.com) The Main problem I have with this conversation is that he asked for, "Send me proof of your estimate and of all costs." I do not have any problem with sending him a final receipt of the work preformed and what was completed, but to send him a list of what everything cost me, is where I do NOT agree with at all, nor do I know of any contractor that lists the cost of everything that they purchased for a particular job I received his check today (11-24-2015) for the balance remaining of $Check #I will now send him a final receipt of what was done and that his account is paid in fullI will be sending this by certified mail so I know he received it The only reason I told him that we would have to settle this in court, was because he refused to pay the remaining balance of $The only reason I did not send him a final statement was that he was being extremely rude to me and did not want to talk in person so we could resolve this in a professional mannerI did not want to Stir the hot coals so to speak, so I thought it best to end our texting conversation ________________ ________________ Page Along with this letter I will be sending you (Revdex.com) copies of what he asked me to do in his own handwriting and his letter he sent me with his final paymentPlease look at both sides of the pages I sent with, as I tried to save shipping weightThank you In closing I would just like to say that I would not have been in business for years if I did not treat my customers with the respect that they deserve!!
