The feedback that our office received from the contractor who inspected the original complaint was that the toilet did flush but the handle needed to be held down for a moment in order to get the water to go down.  The owner did not want to replace the toilet, as it was replaced just 2 years...

ago.  However, after repeated complaints from the Tenant, we did convince the owner to replace the toilet in hopes that it would solve the issues that the tenant was experiencing.  The toilet was replaced on Monday, 6/27/16.

When Mr. [redacted] came into the office to pay his January rent on 1/04/16 he requested his late fee be removed from his account ledger because the office was closed on the 1st.  He was given a response based on the terms of his residential lease agreement (see below and lease attached) that he...

signed on 9/02/2015.The residential lease agreement states (Page 1, Section 2. Rent): "Tenant shall pay Landlord Five Hundred Fifty Dollars ($550.00) per month due and payable on the 1st day of each month.....Rent...may be paid via the following avenues: -ePay via the [online] Tenant Portal...-Paypal via www.IndianaRealtyPartners.com...-Mail delivery (Must be postmarked on or before the due date...)...-In Office (Payment may be brought to the Office ON OR BEFORE the due date during office hours.  If office is closed, and payment is left under the door, payment will be received and posted on the next business day, incurring a late fee if payment received date is after rent due date....)"The residential lease goes on to state (Page 1, Section 2. Rent, B. Late Fee):"If the rent in its entirety is not received on or before the due date, a late fee will be assessed to the Tenant Ledger in the amount of Ten Percent of the monthly rental rate.  The Late Fee amount is Fifty Five Dollars ($55.00)."We have reviewed and discussed Mr. [redacted]'s complaint and recommendations regarding adjusting our late fee practices and we have removed the late fee from Mr. [redacted]'s tenant ledger as a one time courtesy.  However, moving forward, it will be our practice to follow the agreed upon residential lease agreement terms, as stated above.   Please keep in mind that if the rent due date falls on a weekend or Holiday, we would encourage Mr. [redacted] to make arrangements to either pay rent in the office before the first or pay rent via another avenue (through the online Portal, via Paypal or by mailing w/ a postmark on or before the due date).
