This letter is in response to a complaint received from [redacted] on 8/18/The assigned ID is [redacted] .In reading the complaint from [redacted] ***, l am noticing many discrepancies between what is written, andwhat actually occurredThe first discrepancy in her letter states that she asked for copies of my business receipts whenshe first signed the contract to have the sidewalk installedThis never happened, and l would not have agreed totuming over ANY of my business records to herHad this actually occurred, would have stated this at that time.The main problem seems to be her recollection of the border of tile sidewalkl had originally brought up andstarted to install the border that she had pickedAfter receiving a phone call from her that she did not like that color, lstopped the work on the projectI made several trips (or 4) to her residence with other colors, and she did not like anyof themIn frustration, I finally told her that she would have to go to a stone supplier and find a color that she likedIgave her some choices of places to trySeveral days after that, she called and told me that she now wanted the originalcolor, but a different shape of stone (round instead of square or rectangular)I told her that these would be a specialorder itemand would be additional moneyShe agreed to pay the extm amount, and we finished the walkAfter shereceived her bill, she did ask for a copy of the invoice for the special order stonel did provide her with that, and itshows that the amount l charged her was my wholesale amount, not the retail amount that she would have paid if shehad bought them herselt; and that I did not try to cheat her in any wayI did charge her an additional $fordelivery, as the stone was in [redacted] , and we had to pick it up and get it to [redacted] She would have been charged$for it to be delivered.There was an issue with the pin to hold the gate, but it was corrected, and she checked the finished repairwork and was satistled with the new pin, and the way the gate closed on the day that we did it.Her next discrepancy is where she is stating that the pavers were not cut with the measurements, and left gaps.I had explained to her in the very beginning, that when you want curves and non-symmetrical lines in a walk, there willbe cuts and gapsI showed her exampks of this in the books that we were looking at to pick out paversThere is no way to perfectly align a straight paver edge to a curve, and the gaps will look different than just using the straight linesthat the pavers were made forl have enclosed a picture (that she sent me) of where the paver meets a curve (picture#2)The gaps are not excessive, and this is a amount of gapThere are also no chips that were made in the paversl never saw any at all in the installation of the walk or in my visits there with additional stonelf there are any at all, it is in the way the pavers were madeThe edges do vary in the pavers to give them a more natural look.The next discrepancy is in her statement that she was told that J would be installing a trench dug out of her flower bedIn the original bed, there were bricks placed along the edge to hold the bed, as it was much higher that the ground around itI told her that those would have to be removed, to install the walk, and that I would lower tbe bed to make the grades matchNever did l say anything about any trenchThis was done, and the bed was lowered for the new walkI have enclosed a picture (that she sent me), showing the edge of the walk along the edge of the bed (picture#1)As you can see, there is not any difference in grade between the two areasand there is no mulch being washed onto the walkThere are some leaves on the walk, but the mulch is staying right where it is supposed to be.In picture #(also that she sent me), you can see the sand in the walkThere are no excessive amounts, and it has not spread anywhere, and is exactly where it belongs.Her last discrepancy is with her statement that l am charging her 20% interest fee on her unpaid amountMy contract (the one that she signed) states that there will be an interest charge of 1.5% charged monthly on any unpaid amountsThat is the amount she is being charged, as her bill is now overdue[redacted] has stated to me through email that she wants the original stone that was purchased for the borderI would be happy to bring it up to herl will not do it unless there is a check waiting there for the unpaid amount of her bill.From the pictures that she has sent me, there are no problems that need to b e addressed, and nothing that needs to be fixedl feel that she is making these comments to withhold payment, and nothing elsel have tried to be very patient and professional with her throughout this whole job, but these complaints are unjust.Thank you,Lynn [redacted] President, Jim Tubbs Landscaping, Inc
