Deceptive pricing on “free promotional items”

You will see in clearance section the free items. You can input the quantity in your cart and the total will be $0.00.
You can pay $0.00 and your invoice will show $0.00

HOWEVER
You wont know that free promotional items cost money if you don’t spend a certain amount.
you will not know this until your credit card gets billed additionally without your authorization! Even though your invoice shows $0.00 and your authorized payment will be including that $0.00.

When explained This to them, they will keep you money and say if you read the description They say no refunds or returns… But you don’t need to open the description to purchase the items so you will never know this if you just entered the quantity and went to the cartto pay the $0.00 for “free promotional items”

We offer Free Promotional Hats & Towels to our customers as ways to not only drive sales but also to promote the ability of customers to personalize their items with their boat name if they wish. Putting these items on our site with a $0.00 price tag is the only way for us to let customers choose the color of their product and also for them to communicate the name of their vessel to be personalized on the gear.

In the complaint the consumer asserts we have deceptive pricing and business practices because there is no requirement of opening the descriptions of the items to place an order. Nothing could be further from the truth; I am including the URL’s as well as screen captures below to our promotional items.

As you can clearly see, the description and ordering page are one in the same and further, our description begins with a line in all caps asking consumers to read before ordering and ends with a line in all caps that all promotional items are non-returnable and non-refundable. Many customers like the promotional items so they order more on purpose, knowing, because they have read our description, that they will be charged for the extras.

The consumer in this case filed a dispute with his credit card company for the charge for the extra items ordered and due the clarity of our offers and their terms that dispute was closed and decided in our favor.

What really happened here is he thought, for some reason, he could order a $13 T-shirt and receive almost $300 of free items because he did not read the above descriptions. When he found out that was not the case, he wanted to blame anyone but himself for the situation.

Once he (I am using pronouns because your letter asked not to refer to the consumer by name) reached out to me directly and sent a rather lengthy email sob story about all the issues he’s had with his vessel since he bought it and the issues it has caused with his wife I felt sorry for him and thought I was doing him a favor when I offered that he could return the hats and towels to us and we would provide him with a 50% refund on that portion of his order. After I received your letter today and saw his complaint was made up of nothing but fabrications and outright lies intended to hurt my business, I sent an email retracting that offer. I am happy to forward a copy of that email to you if you would care to see it.

In my rebuttal to Jester Promotions response I will once again state that a CONSUMER does not need to click on the description in order to see they’re disclaimers. A CONSUMER can purchase from the home page in -closeouts free promotional itemsEnter quantity and the checkout page shows $0.00No matter how many you enter the price is $0.00Check out page will show $0.00Choose shipping it will be $0.00+shippingEnter your credit card and you pay that. No notice or disclaimer that you will be billed later with out authorization for the “free promotional “ items. If you follow these steps as I did, you will see the what I did. When I see “free promotional” I see what dictionary.com says Free= provided without, or not subject to, a charge or payment:free parking; a free samplePromotional = furtherance or encouragement.the act of promoting.the state of being promoted.something devised to publicize or advertise a product, cause, institution, etc., as a brochure, free sample, poster, television or radio commercial, or personal appearance.A CONSUMER can interpret “free promotional items as they wish. For me I assumed it was and advertising angle to SOC members, or and overstock from a rendezvous that was cancelled. Never the less I saw free and thought I would partake. I didn’t just order free items I did purchase a shirt. So once again I am hearing what Jester has said about the “description page” BUT you don’t need to click on descriptors to see this disclaimer My suggestion is for Jester to fix the home page so other CONSUMERS don’t make the same mistake I did. It is confusing if you are quickly ordering. As a resolve to this complaint I am 100% willing to return the merchandise in perfect condition as it was sent and not removed from the box. For a 100% refund of $278.50. The amount that Jester charged me without my authorization for the “free promotional” items. I am including this YouTube page of me showing how I ordered without clicking the description page which again, you don’t need to do. And the invoice pages showing what I authorized to pay. What I didn’t authorize was the $278.50. The only thing that will make the consumer happy is a full refund and that is not going to happen. We have operated the site he ordered from for almost 13 years. We took our first order on 10/12/2007 and in that time have taken and processed 1122 orders for Silverton Merchandise and this is the first time we’ve ever had this type of issue. That is the definition of an isolated incident.

I thought I was doing him a favor by offering a 50% refund as any return or refund on these items is against the T&C’s he had to agree to at checkout. That offer of good faith on my part was met with a rather blunt, sharp worded email response where I was told I was “pouring salt in the wounds created by this situation.” I chose to ignore the email and leave the offer in place until he reached out to you and at that time the offer for a 50% refund was retracted.

If you need me to keep responding to his requests I guess I will comply but my stance on this will not change and as a means of establishing how and why I feel correct in that stance is the credit card charge was disputed and the credit card company found in our favor and the charge reinstated to his account.
