Review: I put a deposit on a women’s ring with the Gauthier store in [redacted] on or about December 2012 and started to make layaway payments. In July 2013, I contacted the store and informed them that I no longer needed the ring and to send a full refund of the money paid to date, which is about $7,000 or half the total purchase price. [redacted] informed me that I would not receive a refund, but only a store credit. California Layaway Practices Act at Civil Code §§ 1749-1749.4 specifically state that a credit can only be authorized if I signed a written layaway agreement informing me of such practice. I never signed any form. [redacted] claims that the receipt for the initial deposit of $1,000 stated that there are no refunds. However, that would only apply if I had paid the full purchase price. I have contacted the business and informed them that I either want a refund or the ring, which I could sell. Otherwise, I will file a lawsuit for violating California law. Rather than put both parties through the expense of the lawsuit, I am contacting the Revdex.com for assistance.Desired Settlement: I want my layaway payments refunded.
