Review: I purchased carpet for my client, but they decided to change their mind and opted something else. I paid using my debit card and JFK refused to give my money back. I canceled the order because my customer doesn't want it anymore. In the meantime, they refuse to give me back my refund and we don't have the carpet in our possession. pls. help intercede

We are in receipt of your June **, 2013 letter regarding Complaint ID [redacted] and we contest the complaint in its entirety. Therefore, please accept our response as follows:

We have been in business for over 25 years and throughout such time we have served a countless number of customers, including individuals, small and large businesses and organizations, as well as government agencies. Our customers are what keep us in business and we always go out of our way to be as helpful and respectful to them as possible. On the rare occasion a difficult situation should arise, our only objective is to turn it into one where we gain not only a satisfied customer, but a lifelong one; this is what we stand for and our reputation for honesty, quality and expertise is too important to risk.

The instant matter began as a sale to a highly time conscious customer. The customer states the date of purchase was June *, 2013, but he is incorrect, as the sales invoice and debit card receipt shows it was June **, 2013. Nevertheless, the customer visited our store, selected carpet, provided his measurements, required next day installation and paid in-full, and before the close of business, the carpet was cut and the installation mechanic picked up same for next day installation.

The next day, the mechanic called the customer several times before arriving, but in each instance the customer stated he changed his mind and would refuse installation. Several more attempts were made to discuss the matter thereafter, but the customer has been uncooperative to date.

The customer claims he cancelled his order, but he attempted to do so after the carpet was cut and our store closed for the day. The customer is not entitled to a refund or credit because the sale was a final sale, which the customer was informed of and agreed to, as the debit card receipt states that all sales are final and that there are no refunds.

Specifically, Paragraph 2 of the terms and conditions of the sales invoice states that orders are not subject to cancellation, return, refund or exchange if goods have been cut to size or cut off a roll and that all deposits are nonrefundable. Unfortunately, we are now at a loss with regard to the material, as the carpet cannot be used for a job with larger dimensions.

We take pride in the A+ rating your organization has given us and will do all in our power to resolve matters, but the customer’s allegations baseless, as he seeks reimbursement of money he agreed to pay. Nevertheless, as a onetime goodwill gesture, we may be willing to refund 50% of the customer’s

payment, as we have incurred material and labor costs herein.
