Dear Ms*** *** ***Thank you for your quick response to this matter I would first say that we totally reject the claim that ElderNet has properly completed the Medicaid Application and the Pooled Trust for *** and *** *** The application process to establish Medicaid eligibility started July 31, At that time Elder Net was given $to to begin the process We did not hear back from any representative of ElderNet until January when I contacted the agency and talked to *** *** and was told that *** *** was no longer there and that the company was restructuringShe stated that she had thought that we had received the letter of eligibility from Oneida County, and at that time I told her that we had received nothing She letter contacted me and stated that she had found the letter in their files and that the letter was dated September 1, Attached is a copy of that eligibility letter which I received from Janene in January via email As you will note the letter is dated September 1, This agency failed to notify us of this letter and we continued to payout thousands of dollars for the care of my Mother.With that being said the process requires that NYSARC Trust Services needed to establish a trust account for *** and *** ***This never happened because the correct procedure was not followed by ElderNet In the response from ElderNet, Becky D*** writes that NYSARC contacted her on March 10, at which time she states that they argreed to accept a signature that they had previously rejected on two different occasionsAttached you will find Invoice from NYSARC dated March 7, and a Western Union money order that was attached to the invoice/letter in the amount of $ This money was the fee required by NYSARC to setup the Trust, which of course was never doneBeing that ElderNet failed to setup the trust over several months NYSARC sent the money back to usTherefore, Ms*** must be mistaken on her statement that NYSARC called her on March 10, agreeing to setup the TrustIn her statement she states that the Trust is ready to goHowever, there is no money funding the Trust so there is no Trust This is an unfortunate situation and it could have been avoided if ElderNet had shown more due diligence They imply now that everything is in place However, that reassurance rings very hollow considering how this agency has failed to properly proceed, properly notify me of any issues that would cause delaysThis agency did not conduct itself in the spirit of the goal To say at this point after numerous months of no contact and continued failures to form the Trust is disingenuous at bestWe continue to ask for a refund of our $5000.Thank you for your continued efforts on behalf of consumers.*** ***

Medicaid Application and Pooled Trust Joinder for the client referenced above and we did. The problem occured when NYSARC took issue with accepting the signature we submitted to open the pooled trustThis issue was completely outside the control of ElderNetThe problem was with the Pooled Trust Company, NYSARCThe work done by ElderNet had nothing to do with this situationEach time we asked for a signature from the client it was explained to the client's daughter *** that NYSARC would not accept the signature we had submittedWe were as frustrated about this situation as the client is. We let the client know that we completed the work we were contracted to do and offered to come to their home again to have the signature re-done in compliance with the NYSARC requestThe client refusedIn keeping with our goal of customer satisfaction, I wrote a letter to NYSARC on March 3, explaining our efforts to get this signature approved and they, in turn, called Thursday March 10, and agreed to accept the last signature we submitted to themThe NYSARC trust is now ready to go. I have attached a copy of my letter to NYSARC for your review and plan to notify the client that the Trust is all setIf you have any other questions, please feel free to contact me.Sincerely yours,Becky D***Director of Operations

In response: 1.  The Department of Social Services mailed a copy of the Notice of Decision dated September 1, 2015 to [redacted] directly.  (I have requested a copy of this document from DSS)  It is not ElderNets practice to send a copy simply because we are sent the copy from DSS.  The client gets the original.  And so their application was approved effective August 1, 2015.  In the meantime, 2.  The NYSARC Trust was established in a timely fashion.  From the time all required documents are sent to NYSARC until there is trust approval can takes little time.  Once we had approval of the submitted signature on the document the trust would have been established.  I have contacted NYSARC and found out that [redacted] called NYSARC on two occasions including March 10th, canceled the pooled trust application and requested the $300 be returned to her.  This is the only reason this trust was never approved.  It was canceled by the client's daughter.3.  Reading all notes on the file will show that due diligence was maintained by ElderNet throughout this entire process.  The Notice of Decision for [redacted] clearly states that his income is over the allowable Medicaid income limit in the amount of $1,254.36.  These monies had to either be turned over to the Department of Social Services each month or go into the pooled trust where the client has use of the funds in order for Medicaid services to be available to Mr. [redacted].I do not know why Ms. [redacted] decided to cancel the pooled trust, nor do I know why she chooses to claim that NYSARC took it upon itself to cancel the trust because that is simply not true.  NYSARC has record of Ms. [redacted]'s request to cancel and her request for reimbursement on file.  Ms. [redacted] contracted with ElderNet to get Medicaid approved for her Father.  We did that.  She also contracted us to have a NYSARC trust set up for him and we were in the process of doing that also, until she, herself, canceled the application.  Honestly, I do not know what more we could have done.I truly do not know what else to say.  There are some cases that take a year to come to fruition, through no fault of ElderNet.  I apologize to Ms. [redacted] for her continued dissatisfaction with the process, but like all Government Agencies, these things take time.
