The retaining wall was installed properly The reason for the complaint of workmanship was the historical rains we received We did not realize the customer had no gutters and the flash flooding that occurred after installation caused our new fill dirt and mulch to wash away (not all of it washed away just some) We agreed to put back just like it was and gave a quote on gutters and offered a reduced rate on the installation on a drain The customer continued to dispute saying that we should have known the material would be washed away We are not responsible for an acts of god We went out of the way to offer to fix the dirt and mulch as it was and offered the additional work at a reduced price We even offered him to get other quotes and that we would beat the prices on those quotes Again, none of this is truly under warranty because it was all caused by an act of god The wall we installed is still there and never moved Only some of the material was washed away.Regarding the change in price, we did originally quote the job for $ 2,but after reviewing our quote, we felt we could do the job at the reduced rate of $ 2,and offered that price to the customer Once the job was completed, it took additional materials, including extra stone and extra fill dirt We had asked the customer to revert back to the original quote of $ 2,due to the extra materials needed that was unforeseen until we completed the job

I have had the retaining wall inspected.It was not installed properly The builder did not follow the material manufacture's specifications regarding the stone that was used.The builder did not install proper drainage behind the wall The anti-erosion fabric was installed from the top of the wall but not applied to the bottom 1/of the wall which allowed the fill behind the wall to escape under the wall when the rains fell Further, there was not any gravel applied behind the wall to facilitate proper drainage and support, nor was there any corrugated pipe installed to deflect the flow of water away from the wall.Also the stone that was used is to small The stone that was installed on my property is suited for flower beds and not large retaining walls Since the wall is eroding away the pressure is relieved from behind the wall it does not appear that the wall is moving However, if there was not any erosion the pressure from behind the wall would push the wall into my neighbors back fence It does not appear that the wall has moved at this time but that is difficult to discern since there is a large amount of sediment behind the wall that was a result of the erosion but I do fear this wall will eventually push into my neighbors fence since the stone used is not intended for projects such has the retaining wall the builder assembled in my backyard Also the retaining wall that was built in my back yard is higher than the factory specifications for the stone that was used further increasing my fears that this wall in unstable and since the wall is eroding from underneath the footing has been compromised and the wall will eventually fall apart.When I contacted the builder to discuss my concerns I was disrespectfully dismissed, and he blamed the weather His was extremely short, spoke in a harsh tone, and when he asked me what results I was asking for I stated that I wanted a retaining wall in my backyard that was functional and his response was "WHAT DO YOU WANT ME TO DO? TELL YOU TO PUT GUTTERS ON YOUR HOUSE!!!"I believed his discounted rate of $for a French Drain that should have been installed initially was completely unacceptable He eventually dropped that rate to $after I expressed my discontent in an email I sent the owner regarding the way he talked to me on the phone, however he acted so disrespectful towards me on the phone that I do not want him back on my propertyI find his billing practices completely unbecoming of a trustworthy business owner To ask for more money when the project is finished without at least a phone call with the customer shows his lack of transparency and further disregard for customer relations.The owner of this company has not done anything to show goodwill towards me in this entire process.It will cost me more money to have this project rebuilt thnt it would to initially build it and because of that I am asking for a complete refund

The wall was not built properly and the owner did not handle his business affairs in a trustworthy manner.The stone used to build my retaining wall is specified to soundly contain enough fill to support flower beds The retaining wall built by the owner in question is over feet long and approx feet wide, over feet high in certain sections and built to sustain a playground surface It is plain to see this is much larger than a flower bed.Further the owner did not instill any basic erosion control measures at the base of the retaining wall The erosion control fabric was installed covering the top 2/of the retaining wall but the bottom 1/of the wall was completely neglected Further there was not any gravel behind the wall to facilitate drainage and buffer the wall from the pressure of the fill it supports This led to erosion of the fill from behind the wall and into my neighbors back yard and settling between the back fence and the wall This erosion prevented the wall from being pushed into my neighbors fence because it allowed for pressure relief Had erosion control measures been applied adequately, the wall would not be able to support the force behind it because the stone used by the builder was not designed to do so and the retaining wall would be pushing into my neighbors fence Another problem resulting from the erosion has resulted in compromise to the footing that is the foundation of the wall and the wall buckle, and drift into my neighbors back fence These dysfunctions will soon render this wall completely non-functional and a nuisance to not only me but my neighbor as well The dilemma I have with the owners answer to restoring my retaining wall was that it did not offer a long term solution and he was asking to be compensated for a service that should have been performed during construction, not afterwards Even with gutters the erosion problem would still exist, (despite happening at a much slower rate) and I would have to continue paying for unnecessary maintenanceFurther there was not an offer to sustain the structural integrity of the retaining wall.The owner did not show any means to maintain good will in his business dealings He asked to be payed more money than agreed upon when the job was finished and did not contact me at any time during the construction process to discuss his reasons for doing so So I payed him according to our agreed upon price, not the $more he was asking for in his invoice His idea of $being a "discount" on a french drain is absurd and appears that he is trying to use his mistakes to to perpetuate his business These suspicions are reinforced by the owner stating that a drain behind the wall is not necessary An attempt to sell customers unnecessary services is indecent of any business owner and propitiates lack of trust between me and the business owner When I attempted to question the owner as to why he did not follow manufacture specifications for this project his only answer was that he believed it was not necessary to do so and further questioning resulted in harsh responses from the owner When I calmly expressed my desire for a functional retaining wall despite his rude demeanor, his insolent reply was "WHAT DO YOU WANT ME TO DO TELL YOU TO PUT GUTTERS ON YOUR HOUSE!".This wall was not built properly, the owner has not demonstrated the ability to perform basic business functions in a trustworthy manner The cost to resolve my problem is larger than the original cost to build this project so I am asking for a complete refund from the owner

The retaining
wall was built within specifications for a wall up to 2’ tall.
It is not
critical on this type of wall to have a drain as this wall is permeable so the
water passes through it
As the
customer has stated twice, the wall has not moved.
We completed
the job around March 20,
During April
we received 5.56” of rain and there we no phone calls from the customer
During May we
received 16.96” of rain and then we heard from the customer around May 29,
If the wall
was defective, the wall would have moved with this amount of rain
Unfortunately,
because the soil was fresh, it did wash out
My belief is
that the historical rainfall during this time is what caused the erosion along
with the customer not having gutters on his home
We have
offered to repair the washed out area and the customer has refused
