Dear Ms***, This email is to directly respond to the complaint filed by [redacted] , complaint # [redacted] This home was sold and closed on or about April 15, to Mrand Mrs [redacted] The [redacted] ’s have been difficult clients from the beginning We had change orders/addendums to this project during the construction of this home, which is far more than we have ever experienced in the twenty plus years we have been building Even though it has been over two years since we sold the home to the [redacted] ’s, Jillian Homes offers a three year warranty on all of our new homesMuch longer than any other homebuilder in the local markets we serve We can do this because we are very confident in the quality of our homes I am attaching the third party certifications showing the quality and efficiencies of the [redacted] ’s home These certifications were performed by a third party engineering firm who inspected the home and performed different quality control testing at various phases of construction As shown by all of the certifications attached, this is a very well built, energy efficient, beautiful home His home is so well built that his heating and cooling cost are estimated to be $per year (see attached)As far as the no communication claim by Mr [redacted] , this just simply isn’t true The very first point to make is that our Senior VP that manages this subdivision actually lives in the subdivision less than five houses away from the [redacted] ’s Not only is he there every day and the [redacted] ’s know his address, we have construction crews and superintendents’ in the subdivision working daily We also have numerous work orders where we have actually had repair crews in is house as well as emails and text messages showing communication almost on a weekly basis Also, Mr [redacted] has my direct cell number The last communication I personally received from Mr [redacted] was in regards to him asking me if I wanted to purchase his house back as he has bought another home Absolutely no mention of warranty issues or not being able to contact our SrVP, [redacted] Even though Jillian Homes has repaired many items that we believe were wear and tear under warranty, I do believe there is a legitimate issue with both his cabinetry and his stucco Even though I’m sure the workmanship is above industry standards, it does not meet Jillian Home’s standards We have twice scheduled our cabinet contractor to address his issues and both times received no reply to our emails regarding specific times to be able to work inside his home We are in the process, as Mr [redacted] is aware, of getting his stucco repaired to our quality of standardsIt has come to my attention that Mr [redacted] has his home under contract to sell Mr [redacted] understands the balance of his warranties transfer to the new ownerI can’t help but wonder if his sudden issues have something to do with the home being soldCurrently, we have fifteen homes sold in this particular subdivision and have not had any problems in resolving warranty issues with any of our other clientsWe will continue to work diligently and in good faith to address Mrand Mrs [redacted] ’s concernsPlease contact me if there are any questions or concernsOur A+ rating with the Revdex.com is important to us and we will work hard and strive to maintain the level of integrity to keep that rating in placeBest Regards, [redacted] President ###-###-#### office###-###-#### cell [redacted]

In response to the rejection we submit the following: It seems that Mr [redacted] is now bringing up other issues than was not in the original complaint, DVR etcWe have numerous work orders, emails and text trails that do not coincide with what Mr [redacted] is professingWe have worked with Mr [redacted] and will continue to work with him until we are confident that no warranty issue exist.As far as his electric bills are concerned I am very confident in the engineering firms calculations and the energy efficient certifications the house receivedThe heating and cooling ONLY calculations are derived using degree day temps averaged over the last years that does not include other household energy used for computers, TV's, hair dryers etcThe fact is, there are have been no less than six people, ranging in ages from 2yrs, teenagers to adults living in the house at any given time I am sure there are many activities that affect the household energy consumption in their house.The stucco contactor Mr [redacted] is referring to has had a federal tax lien in excess of $125,filed against his company, and we have received notification that if we owe his company any money we are to send it directly to the IRS Not to mention, there are many problems with their construction licenseThis company is not a reliable company to receive any advice fromAs far as Mr [redacted] attacking the competency of our employees, I will let our year reputation of doing business in New Mexico with absolutely zero complaints filed with the Revdex.com or the New Mexico Construction Industries Division record speak for itself That is with literally hundreds of projects completed.Again, our senior VP of operations is in direct contact with Mr [redacted] working to bring a resolution to these issues.Best Regards, [redacted] ***PresidentJillian Homes

I am rejecting this response because:Mr *** states that I am bringing up other issuesWhich is not the case Look at all of the month walk through and the year walk through All the items are on these list which still have not been repaired As far as the DVR yes you had someone come look at it and they said it needed to be replacedThat was a year ago and still have yet to have it repaired and operational The stucco contractor that I referred to is very knowledgeable and I am unaware of any tax or license issuesSince Mr*** says this company is not reliable My attorney had a different contractor come inspect it and he brought up the same issues So if two different contractors can see the issues and your SrVP has seen the issues over two years ago Then why has it not been fixed? We were told it would be two years ago.I have not spoken with your SrVP in person since I cornered him at the home in garden show and stood there until he spoke with me over a month ago Then I did not hear from him again until my attorney sent you a letter So don't tell me he is in direct contact.All I want is for ALL the issues to be fixed so I can try to sale this property Unfortunately the reputation this subdivision has in ClovisI am not sure I will ever be able to sale it

I am rejecting this response because:Ms. [redacted],Let me address the Response from Mr. [redacted] by paragraph.First:Yes the home sold on April 15, 2013, Mr. [redacted] claims we were difficult clients.  We were not difficult, we just wanted the house built like we wanted it.  Most of the issues with the house were noted and reported to them with in the first couple of months of us living in the house. We have had issues with the alarm and security system since we bought the house.  It has never worked properly and the DVR for the camera system went out and we were told it would be fixed. As of yet Nothing.  The list goes on and on.  They have the punch list of items that should have been fixed after the first walk through at six months and we are at over two years.Second: 
Three year warranty - If they actually would come out and fix this items this would be a great warranty. Unfortunately we can never get them to show up. The estimated heating and cooling cost of $361.00 per year. Is no where close to being accurate.  I electric bill is over anywhere from $350.00 to $500 a month.  Yes I do have Mr. [redacted]'s cell phone number but he never answers it when we call. Also have Mr. [redacted] cell phone but he never answers when we call either.Third:The claims of us knowing that Mr. [redacted] lives in the  housing development is news to us.  We never see him at the housing addition.  specially since the office (trailer was Moved).  The last time I actually saw Mr. [redacted] was at the home and garden show when I cornered him to inquire about the work to be done on the house.  Who is the superintendent after the last one quit we have no idea if they had replace him.  The only worker we have seen is a so called handy man.  This handy man's work is pathetic yet they have him working on the last unfinished home in the area.  As far as the exterior of the house being above industry standards that is false.  I have had a stucco contractor come look at it.  He noted several discrepancies in the stucco and said that water getting behind the stucco is the cause of the rock face and stucco cracking.  His estimate for repair is $10,300.00.Fourth:We thought we had a buyer for the house, unfortunately they chose not to purchase it.Fifth:Yes there are fifteen homes in that area and I will let the other home owners respond. This way it is not hear say or just me saying things.

We are attaching the primary contract less the addenda between Jillian Homes and the [redacted]'s.  If we had breached this agreement, I'm sure Mr. [redacted] would have contacted the legal department at [redacted] where he is currently stationed.This home is absolutely built to New Mexico Build Green...

(NMBG) silver standards.  The original HVAC unit we installed is compliant to these standards, however it was not the same unit as was in the model home that Mr. [redacted] toured before his purchase as that unit has been discontinued by Trane.  Even though we were not originally obligated contractually to change out the unit we installed, we agreed to upgrade the HVAC unit.  Mr. [redacted] did not agree to the unit we chose to replace the discontinued model, therefore we took the time to find a unit he did agree to.  This unit has been on order with Siglar's HVAC supply out of Albuquerque for quite some time.  Once they have received, we will change out the units.  We understand Mr. [redacted]s's frustration, but we have no control over discontinued product. If Mr. [redacted] had accepted our first replacement this issue would have been resolved months ago.  We absolutely plan on changing out the unit once we have the product.  Jillian Homes prefers to go above and beyond our written agreements to satisfy our customers and we did agree in writing to change out Mr. [redacted]'s unit, even though contractually we were not obligated as we were in compliance with all BGNM Silver standards. Unfortunately, we have no control over the manufacturer's delivery.  Once we have possession we will install.  We are happy to give Mr. [redacted] the distributors contact information for follow up.
