We have been in contact with Mr [redacted] through out this processHis damage to his home was part of a very major stormthat went through this areaStraight line winds put many trees through roofs of homesWe have explained many times that we are taking the jobs in orderWe have explained that we can not move his small repair of a few pieces of siding ahead of homes with trees through their roofHe would not except this and wanted his repair done nowThere was no start date or completion date on on his contractWe have completed his repair at the time of this response

I write in response to your correspondence dated January 5, Per your request, I am responding on behalf of
Jim Perrault Construction relating to the above-listed case numberPer your request, I am not including any personally identifiable information in this response
With all due respect to the Complainant, Jim Perrault Construction disagrees with the complaint that we "...failed to replace my windows and wrap my house in drain wrap using correct windows and a specific method." (Complaint)The Complainant identified seven "major issues." Those are listed below
1, Failure to execute commitments and Contract
Jim Perrault Construction disagrees with this statementWe met with the Complainant and reviewed his specific needsThose needs were then written into a job proposal/contract and left with the Complainant to reviewThe Complainant was provided the window manufacturer's name so that they could independently view the manufacturer's website
Following some time, the Complainant executed the job proposal/contract and returned it to Jim Perrault ConstructionThe sizes of the window openings were confirmedJim Perrault Construction met once again with the Complainant to confirm color and the order of the windowsThe custom windows were then ordered as contemplated by the job proposal/contract
The Complainant refused to accept delivery of the windowsJim Perrault Construction remains willing and able to install the custom windows
Lack of Project Management,
Jim Perrault Construction disagrees with this statementThe Complainant states that our employee, Tim Jezierski, was going to be on site during the entire projectThis was not contemplated within the written agreementMrJezierski does not manage or oversee jobsHe is one of our sales staff
The Complainant requested a particular manner to install the window wrap that is not consistent with the updated and approved methodThe Complainant was advised that he would have to meet with the installers
and advise as to the method he wished to have the installer utilize
The job proposal/contract did not specify a particular installation dateThere were not "several delays." Rather, the weather limited the opportunity to install the windows,

Further, as these were custom made windows, designed specifically for the Complainant's home, they cannot be returned to the manufacturer for refund

Please be advised that your notice "to cease and desist" is unwarranted and misleadingWe have no intention to defame MrPerraultWe will continue to share the facts of this matter with third parties involved in the recovery of our down payment and consumers seeking our feedback
Your attention to "educate others about our experience with Perrault Construction to protect other consumers from these types of business practices" distracts from the root issueWe will share the facts of our experience with those interestedWe will advise others to use caution when selecting a remodeling contractor
It is misleading and inaccurate to repeatedly assert that MrPerrault remains willing to engage in meaningful communications to explore potential resolutionHe has continuously refused us our reasonable and justified request and provided no other option but to install the wrong windows using his serviceWe asked for a specific type of window with a continuous nailing flange thus contributing to a continuous and redundant building envelope that provides maximum resistance against liquid water intrusionWe also agreed to a minimum service quality that specified onsite supervision prior to and throughout the duration of the project by your client's selling representativeThat representative promised to deliver on all fronts multiple timesWe as the customer should not bear the responsibility of your client's negligence nor should we have any confidence in the process and practice of your clientWe remain open to engage in meaningful discussion centered on a method to recover our down payment
Jim Perrault Construction, a division of A-Construction in Hermantown, MN, is directly accountable for this matterA threatening letter from his attorney is simply a bully or scare tactic and changes nothingWe will continue in our course to defend ourselves and advocate for corrective action and closure
If we were in the wrong, we would accept responsibility and the consequencesWe ask that your client look with open eyes into his business processes and practices and then do the same
We formally request that your client cease in destruction of any records relating to this matter including electronic records such as but not limited to email and text

Dear Mediation Coordinator,
Jim Perrault Construction, also A-Construction, of Hermantown, MN is correct stating this matter is NOT settledIn fact, nothing has changed other than we've been instructed that all communication be directed to Jim Perrault's attorneyJim Perrault Construction (JPC) is attempting to create the appearance of a good faith effort to resolve this matter but that is not evident to us
It can only be surmised from the preceding response in this dispute that Jim Perrault is willing to make statements or he is misguided by his employeeAlso, it has become painfully evident from our experience that any verbal commitments made by Jim Perrault Construction will not be executed if not written down and signed
The following information remains to be fact and in refute of the preceding response from JPC:
We paid JPC $and our estimates suggest that 40-50% of that is material expenseOur estimates could be high or lowJPC refuses to provide the expenses they've incurred so we can't be certainThe house-wrap and flashing material are commodity products that can be used on any other project and therefore is money that should be returned immediatelyJPC has done nothing to earn any profit nor have they incurred any labor expense therefore, that money should be returned immediatelyJPC states the windows are custom and therefore cannot be returnedJPC did not ever communicate this policy, verbally or in writing, during the transaction or prior to their terminationWe also question the accuracy of the claim that the windows are custom sizesWe believe the patio door is a standard size and there may be some windows that are also standard sizesJPC should return all funds immediately that are unrelated to the purchase of any proposed custom windows as JPC has not incurred any additional expense and ethically should not bank roll that cash when they have not earned that cash
JPC breached our contract when they ordered insert windows with a snap on flangeWe expressly stated that we didn't want an insert window and a snap on flange does not change anythingSimply put, the wrong windows were delivered and contrary to their response to this claim, we were not provided any reference or guidance to the window manufacturer's information nor was that ever suggestedWe asked for windows with a specific nailing flange that is continuous around the perimeter of the window and permanently affixed to the window frame as one single unitThe nomenclature "full frame" replacement windows was added into the proposal for this very reason by JPC's employeeNobody at any time, in writing or otherwise, communicated that the windows were insert windows with a mechanically attached nailing flange that snapped onto the windowWe did not know that such a window even existed and if we had been informed, we would have never agreed to themJPC is clearly negligent in this matter and we should not bear the burden of their mistakeJPC should immediately return our funds for the windows on the premise of their negligence
JPC asserts in their response to this complaint that they remain willing to complete the project with the wrong windowsWe cannot make that compromise knowing now that we cannot trust JPC to follow through on their commitments and the windows are inherently flawedA window with a mechanical connection between the window and the flashing will leak at that connectionThis will result in long term degradation of the surrounding structureAny sealant or caulk applied over the snflange connection is limited to the quality of the sealant application and repeated thermal expansion and contraction between dissimilar materials will eventually break the sealant causing water penetrationThis process of degradation is hidden by the cladding and beyond access for inspection and maintenanceIt will go unnoticed resulting in significant repair costs and potential health hazards from mold and fungi
JPC states that his sales person involved in this project is a member of his sales staff and does not manage or oversee jobs as one would expect of a general contractor and also promised by JPC's employeeThen who does and why was that promise made multiple times by JPC's employee? This again was one of the reasons we agreed to hire JPC
JPC states in their response that their subs were informed on the full scope of workThat's an ill-informed statement if not a lieThere was nobody from JPC at the jobsite when the subs arrived and we verified personally that they had no knowledge of the project scope other than to replace our windowsIt was clearly stated that they planned to flash around the windowsThey had no knowledge of house-wrapWhen JPC's employee was phoned about the house-wrap application, the employee arbitrarily made an excuse and a significant change of plan that had never been communicated to usIt is silly that JPC asserts the subs understanding of the project scope because they confirmed the size of the windowsWe never spoke with the installers when they measured for the windowsBottom line, JPC's employee promised us that our house would be house-wrapped prior to the window installation and we know firsthand that was not communicated
JPC states that we requested an installation method different from the most current installation methodThis is misleading and inaccurateThe agreed upon method of application is consistent with a well-known standard from the American Architectural Manufacturers Association and the Window and Door Manufacturers AssociationIt was NEVER communicated that we as the customer must meet with, instruct and supervise the installersWe hired a contractor to do that!
JPC states that there was an attempt to communicate with us and they remain willing to engage in meaningful discussionJPC has not offered any solution other than to install the wrong windows and deny return of our paymentWe were also instructed to deal with JPCs attorney instead of JPCJPC attempts to create an image of someone that wants to compromise and do the right thingWe haven't seen it
For anyone seeking a contractor, be advised to do thorough research so you don't end up regretting your decision

Yhe owner talked with the workers a few minutes after they got there. The workers were unsure of what to do since their workorder was different than the contract. The workers left because the owner was ranting and raving.The salesman was dealing...

with another customer and he left his phone in his vehicle. He called the owner back within 25 minutes of her call to him. The salesman told her that the crew would return but probably not today because they went to another job. The owner did not like that the men would not return that day and demanded her money back. We told her she could have it back and she wanted it today. I was not availble to sign a check that day. She went on facebook and badmouthed us. We told her either to take off her comments or we will inforce the contract. She threatened to get attorney. We sent her a check the next day. It has been cashed.

I did speak with the subcontractors after work had begun. Their work order did not match the details of my contract. They called their boss. I called the 'salesman'. At NO TIME did I rant or rave about anything. I simply asked for the job to be done correctly - according to the contract I had signed. When the salesman finally returned my call, he was incredibly rude and told me that I had 'overreacted'. I asked him for an example of what I had said or done that was inappropriate. He could not give me one. He did say the subcontractors would not be back that day and could not tell me when the work would be completed. Due to his horrible attitude and the way he was treating me over the phone, I demanded my money back. First he refused and hung up on me. Then, he called and said he would send me a check. I DID post my personal experience on facebook. Then, he called me back and attempted to censor me by holding my check until the post was removed. At that point, I said I would obtain an attorney if my money was not refunded. I also left a message for the OWNER to call me so that we could discuss the situation and I never received a call back, even though on this company's website the owner says he "stands behind their work". Eventually I did receive my money back and I did cash the check. I'm still very upset about the way I was treated by this company. For them to say that I was 'ranting and raving' is completely dishonest. All I wanted was for the work to be completed as we had previously agreed. I was mistreated by them and sincerely hope no other female customer has the same problem.

Since the compaining person has cashed the check their should be no more issues. That she has contacted our subcontractor to come back to work for her shows that our workmanship was good. That she continues to complain anyway she knows how,shows her unhappy nature and need for attention. I feel that the case is resolved and hope to never hear of her again.
