March 17, 2015Dear *** ***:We are sorry that the *** fees the way they doHowever, Merrifield must get paid in full before we go out and perform additional work which might be biliableAs I mentioned in the first letter, while the lighting fixtures have a life time guarantee, any issue involving a tripped GFI or a broken light bulb would require paymentAgain, as was evident in the emails between the *** and our designer, there was never any mention of outstanding plant or lighting issues UNTIL the *** were contacted by our attorney for payment.I would be more than happy to go out to their home and address any issues once their account is paid in full.Sincerely,David W

Dear *** ***:I am responding to the complaint (ID#***) from *** *** *** regarding an outdoor lighting system that Merrifield installed in March Our licensed electrician, *** *** **., went out and fixed a few problems when the issue came to our attention last year, The
invoice for the job was mailed and the *** paid the invoice in full and at the time all outstanding issues had been addressedNot until the *** contacted Sharon Ross this week did we know that there were any outstanding issues with the lighting systemAs you can see from the attached emails between the *** and MsR***, there was never any mention of additional lighting problems.The *** owe Merrifield Garden Center $from an invoice sent to them in September of that they have not paid despite many attempts by our accounting office to get this balance paidI have attached the collection messages documenting this effortIn fact we recently had our corporate attorney send the *** a letter demanding paymentIt was not until the *** received this letter did we hear about this lighting issueMsRoss informed the *** we would be more than happy to come out and inspect the system again but we must have their account paid in full before we can continue to do work for them.Merrifield Garden Center uses quality products and we guarantee all of our work for a specific period of timeMrNelson has reminded me that the lighting fixtures installed at the *** has a lifetime guararitee on the material so if there is any problem with the product, Merrifield can replace the parts at no cost, MrNelson believes that the problem might be that the GFI has been tripped and that the *** have been in Europe for a length of time and might not realize that this could be the problem.The *** have been long standing customers with our companyWe wish to continue to do business with the *** but we must have their account paid in full before going out again to their home.Please do not hesitate to contact me directly if you have any additional questionsMy cell number is ###-###-####.Sincerely,David W

I am rejecting this response because: The remaining balance of $owed to Merrifield Garden is for a different work project in September of The money owed has nothing to do with the poor lightning system guaranteed by the MGC contract. The work for the lights was paid in full in March The lighting system never worked correctly and has been an ongoing issueMGC sent their technician out many times and they still couldn't correct the problemWe informed them over and over. I don't think they knew why the system kept failingTo this day, the system is not working. We have paid MGC more than $60,in and for landscaping and lighting therefore it's not that we just don't want to pay a bill. We feel if we pay this we will never resolve our issues as consumers. We only worked with MGC's designer, MsSharon Ross, and she was the sales person as well as the coordinator for this ongoing problemWe also had trees planted by MGC that were dead and dying that were supposedly guaranteed but were never replaced. Since we spent a lot of our time in Europe, we just paid our gardener to remove the dead bushes and plants as well. He also had to remove a rock wall that was breaking up from the work contract in September that we have paid half for as the down payment. The remaining balance is now used by MGC to refuse to fix the failed lightning system. We also noticed that we were charged and paid in full for a full day of (hrs) work labor cost when their workers showed up at 9am and left at 2pmWe did not make a big issue out of this unsatisfactory service provided by MGC. We are not refusing the remaining small balance owed to MGC for this other minor work. We just feel that once they get the payment, we may never have anything corrected. We no longer trust MGC and their empty promises, we request that they remove all the bad lightning systems poorly installed and demand a full refund. We are selling our home and can not pass on the failed lightning system to the new buyers. They will have the right to demand that the lights are working properly and I don't think we will ever be able to get them to work. I would not recommend MGC to our friends or anyone looking to improve their landscaping.Regards,
