all of which include extensive work. The first contract, signed on April 24, was to do interior work remodeling the existing kitchen, including removing a dividing wall between the kitchen and the living room, skim coating the living room celling from a texture finish to a smooth finish, and Installing a hardwood floor in the first floor living room, hallway, and kitchen, as well as new cabinets. The second contract, signed May 3, was to do exterior work, including soffit fascia, a new roof, new windows, and removing and replacing all siding. Both of these contracts have been completed. The third contract is for a 16' X 2O' addition. The customer was unsure at first about requesting this, because she needed a variance, but after she managed to obtain one, the contract was signed June 20. Before we could begin work on the project, we also needed to submit drawings of the plan to the Bureau for approval. We were approved In July and began work then.On September 30,1 met with the customer and her father, Vice Chairman of the Board of Directors at [redacted]. The three of us signed a paper that I have attached for your review, agreeing that the 15 tasks listed on It were the entirety of what I still had to do from the contracts and that I would complete them in a timely manner, Ideally in the month of October. By October 16, upon finishing the addition itself, we had only two remaining items to complete, both from the third contract: a small retaining wall and a concrete pad.Poor weather prevented us from finishing the retaining wall until the middle of November, at which point we scheduled to pour the concrete for the pad on Monday, November 20. However, on the morning of the scheduled date, the customer called and said we had to forgo pouring it that day due to visiting family members, forcing us to cancel the concrete delivery. Since then, she has not acknowledged any of my messages regarding the concrete pad.The only tasks that we have otherwise been asked to complete by this customer are punch list/warranty items, pertaining to any corrections she wanted us to make to the work we've done. I have asked her to name any such items she's noticed throughout This entire process, In the beginning of November, t met with her, and she listed the following items: From the interior contract she wanted us to replace a pantry door with a mark on It and fix a drawer that didn't roil properly. From the exterior contract, she wanted us to replace aluminum trim she didn't like around 4 of the front windows and fix an issue with the flashing {where the brick meets the siding on the side of the house). From the addition contract, she wanted us to replace a window that didn't seal properly.I attempted to Inspect the drawer as she was pointing It out to me, but she then said she did not have time for me to look at It and hasn't brought it up since. Immediately after the meeting, I ordered the new pantry door and the new window, both of which were under warranty. The following week, we replaced all of the aluminum trim and the flashing. After she cancelled the concrete pad, I attempted to contact her all throughout December and January to ask when she wanted us to replace the window and the pantry door. She never responded to this. Eventually, during an unrelated call on January 22, I asserted that we still had the replacement pantry door and window In our possession. She said that we could drop them off at her house the next day, which we did, but in her messages to me since then, she continues to not acknowledge that they need to be installed.Apart from the items described above, the customer has made the following complaints: First, she has complained that we caused damage to her furniture, during the kitchen work. One of the agreements listed on the kitchen contract states that the customer was supposed to remove all of said furniture In the living room, by the time we arrived to start the remodeling project. This was because, in addition to being a major inconvenience for us where It was, the work we had to do could potentially damage it. All of the furniture was stit! in place when we arrived. When I expressed our concern about this, she told us multiple times that the furniture was no concern to her, because she was going to replace it with new furniture, after we finished remodeling,Second, on Sunday, January 21 at 7:57 AM, she left me a message, irately and aggressively claiming that due to an electrical panel we installed, she had a massive power outage, leaving her house with no power. Once she finished said message, she Immediately added a text making the same claim, except now saying that she had 50% power In her house. 10 minutes later, she sent another Irate voicemail and a text, both saying she was very upset at not having received a response in those 10 minutes. At 8:25 AM, I called to inform her that I was sending my electrician to her house. 30 minutes later, she called and said not to bother, as she had already called someone else who had fixed the probtem. However, our electrician was already in route, and he arrived at 9:10 AM, 1 hour and 13 minutes after her initial call. Upon arriving, he spoke to two men who said one breaker tripped and felt that it was best to replace the breaker to her living room receptacles (she has over 30 breakers), because it had tripped and gotten stuck.finally, on January 23rd, while one of our employees was dropping off the cabinet door and window at her house, she claimed that a kitchen shelf we set up had collapsed and broke dishes, Our employee checked and saw that the shelves were moved from where we had placed them, and the clips were now upsfde down, which gives them no support. This was done by someone other than our company. I have gone out of my way to resolve all punch list/warranty items. We told the customer to bring any such items up to us, but other than the aforementioned instances, we've had no contact from her regarding items for us to repair. Even now, we're offering to repair or replace any items under warranty, but we've gotten no response. She claims that I've held onto the payments I've received from her for 8 months, without completing the projects they were for, but even disregarding the delays she has caused herself, she has no uncompleted contract with us that was signed that long ago. There is no Instance in which I have broken any of our contracts, nor have I been unreasonable, or unaccommodating.Sincerely, James J[redacted]
