August 26, 2015Dear [redacted]:I represent JK Home Improvement, Inc. and I am writing in reference to complaint made by Chad Mahoney against my client referenced in the case above.My client disputes that any work on the premises were done incorrectly or incompletely. On July 13, 2015, my client...

entered into an agreement to make improvements/repairs to [redacted]'s house for estimated amount of $14,111.00. My client started work on the house and completed certain portions such as plumbing and electrical work on the second floor bathroom as well as tile work on the bathroom in the master bedroom. See Exhibit A, Sales Contract, with check marks indicating work performed.While the work was proceeding, [redacted] asked my client to make changes and repair areas he thought needed more work. Despite the fact that he was making these change requests while the work was in progress, my client agreed to Correct or change the work to his specifications. In fact, during the work in the two bathrooms, for every action taken my client gave full explanation to the owner and received permission before continuing his work. However, before my client had a chance to finish, [redacted] stated that he no longer wanted my client to work on the job and asked for a full refund.My client disagreed that the work was not performed correctly. However, to amicable resolve any differences, my client offered and [redacted] accepted a full settlement of work performed and any issues related to the project, with my client refunding [redacted] $1,000.00 and also leaving construction materials at the house. In fact, that was a condition that [redacted] insisted as part of the settlement and he even wrote in the sales contract at settlement those terms of settlement. See, Exhibit A, 5econd page, handwritten marks and signature. Not only did my client perform the work as promised, but agreed to resolve any differences when dispute arose by refunding $1,000 and leaving building materials on the residence. At the time of settlement, my client's work on the project can be itemized as follows: material costs $2,170; labor for staff $2,120 (paid out of pockets), and [redacted]'s estimated labor costs of $3,200 according to the 8 days of work on this project which was not received. See Exhibit B, receipts and invoices showing materials purchased for the construction on the premises. Thus, the total of cost of my client's expenses on this project was $7,490.While [redacted] states in his letter that he had various contractors review the work and reported deficiencies, my client has not seen such reports and ask that [redacted] produce them. My client feels that he also suffered loss on this project and cannot understand why even after the settlement of disputes [redacted] is continuing to pursue this course of action.If you have any questions, do not hesitate to contact me.
