property in question, along with a separate application submitted by her husband. The applications identified a family of five, two adults and 3 children, and also identified a service dog that would be on the premises. The applicants submitted a security deposit of $1225, first month's rent of $1225 and two application fees of $35 each, totaling $70. I am enclosing with this letter a copy of the 3rd page of their 4-page application. The complainant indicated that there were multiple applications on the home, which was true. We ultimately accepted 11 separate applications for this very desirable rental property. The complainant indicated that no one told her that there were multiple applications on the property and that if she had known that she would not have submitted the application. Of the eleven applications that were submitted, the complainant's applications were among the earliest. The agent who showed the property had no way of knowing if other applications had been submitted prior to his showing the property. This is often the case when multiple applications are submitted in a rental market that is very strong. Neither the agent nor anyone else from this brokerage purposely misled or deceived the applicants. The complainant indicated that she was not provided with the rental criteria for this property. Page 3 of her application, in bold print which is also underlined, spells out the tenant selection criteria that we use in evaluating all our applications. This information is available upon request. Apparently the complainant never requested the information, even though she signed the form 6 lines below where this acknowledgment appears on the form. The complainant alleges that we discriminated against her family because of their race and their medical situation. We did not discriminate in any way against these applicants. The rejection of their application was based on the same objective criteria that we apply to all of our rental property applicants. The applications submitted by these complainants were rejected because of their relatively low credit scores compared to the 10 other applications that we received. The owner of this rental property approved the applications of two people, both of whom had credit scores almost 100 points higher than the complainant.The complainants submitted a total of $2520.00 with their applications. After the complainants were notified that the owners had approved another application, we refunded to the complainant a total of $2450.00, which they picked up in person. The difference of $70 is the non-refundable application fee. On the application, under the paragraph entitled "Fees" the complainant left the spaces blank.
