Mrs [redacted] Paid on her account October 16th in the amount of $and her final payment of $was removed and never processed because we lost the client due to the middleman company we remit to that remits to the clientThe client was paid their money minus our contingency fee and the responsibility now lies with the client to resolve as this has been out of our hands since mid OctoberI challenge anyone who claims we are a "SCAM" which usually is the statement from the ones that know they owe the debt and dont pay the original creditor or client so they assign their debt to us to collect on, verify info with the creditor before you attempt to state our company which is a legitimate collection agency that has been around for years now, that the debt is validAlot of the people that complain about collection agencies being a scam especially on this platform are ones that think stating this gets them out of paying the debtThis was explained a long while ago to Mrs ***, and most likely she either didn't take the steps she was advised to take in regards to showing a receipt to the client proving she paid on the debt or she just flat out did nothing and feel like complaining now that a new collection agency is calling heras far as the rest of her claim ***, she was not threatened with legal action as the debt was only around $She wasn't irate she was very cooperative and stated she cant pay the entire balance so the rep set up payment arrangements with herIf Mrs [redacted] wants another receipt from us all she has to do is call us and we can give her oneWe already have dont this so this is just a baseless complaint
This is in regard to dispute # [redacted] Attached is proof that the phone number this business is calling belongs to my partner, [redacted] , not [redacted] (the person they claim to be looking for)Also attached is proof that I received calls from this business as recently as 10/The response by the business is completely irrelevant, as by Ohio law, if someone requests that someone not continue calling them they must stopRegardless of how I spoke to the agent, every call I received after that conversation was in violation of the Telephone Consumer Protection ActI also never said in my original complaint that this business had been contacting me for three yearsI stated I had been in possession of the phone number they've been calling (##########) for three years [redacted] ***
Demanding the balance when it is not proven that an account is paid is not a violation of FDCPAThe burden of proof lies on the debtor and our client states Miss ***owes this debtWe placed it in a dispute statusbut nothing stated in the complaint is a violation of Fair Debt Collections Practices ActWe encourage miss ***r to provide proof that she paid this otherwise this will still be considered a delinquent bill and another agency will call her and attempt to collect the debt
