Review: Contractor did not deliver the sound system or cabinets that were promised. Both were of inferior quality. Contractor promised to refund the $5400 cost of both items. Wrote a bad check. Check cannot be cashed.Contractor asked in writing to borrow $3800 to finish the project and start another project. Promised in writing to repay by March 8 2013. Review: There were many problems with this contractor; the only ones I am focusing on are his failure to refund the cost of cabinets and sound system that were returned. both were not what I ordered; he promised me a refund and wrote me a bad check. He also owes me $3800 which he borrowed in February and promised to repay by March 8. I submitted this complaint earlier and received an email back from you. The complaint number is #[redacted]. However, I was dealing with family health issues and did not notice the email until after the information had expired. Is there any way to retrieve it? The contractor still has not repaid me for the cabinets, sound system and loan, all of which amount to approximately $9000. He also does business under the name [redacted] Construction LLC.Desired Settlement: At a minimum I want a refund in the amount of $5400 for the cabinets and sound system that I paid for, he returned, and did not refund

Dear Revdex.com Representative,

We have received your complaint letter referencing complaint ID: [redacted].

The complaint submitted is not a correct account of the ongoing dispute between JM Construction and [redacted]. We have issued her several emails in response to her allegations and have received no response for a satisfactory solution.

JM Construction provided **. [redacted] with services for a finished basement that ended up well exceeding her original proposal due to her desire for upgraded materials. Her complaints are unfounded and we have expressed our interest in settling the dispute in a court of law.

I have outlined our response to each of her allegations below:

1. Her allegations regarding wet bar cabinets are incorrect. She did not express concerns about the cabinets until after they were half way installed. The cabinets sat in her garage for over a week prior to installation. She could have had them returned prior to installation if she really believed that she received the wrong cabinets. In addition, I have an email that states that she clearly understood that she was not receiving the exact cabinets she desired because the cost would have been well over $7800 not including labor. She had desires for more extravagant purchases but did not want to pay the extra costs associated with such materials. We also have pictures of the sample cabinet she wanted and the cabinet she received. There was not a significant difference in style or color. She could not afford the other desired cabinet and it was agreed upon that JM Construction would find her a more affordable option. The cost for the installation and uninstallation is owed by **. [redacted].

2. The sound system that she is speaking of is also something she expressed a problem with AFTER it was installed. The purchase of the exact equipment was approved and decided on by her and her son. Her son was present for the installation and even had the wiring moved again for the surround sound speakers. Her son desired a BOSE system which would have cost them over $7000 if purchased new. Both herself and her son viewed the potential systems on a website that sold refurbished systems. JM Construction did not take it upon themselves to purchase a system that was not approved in advance. Again, if the equipment was not satisfactory, it should have been expressed prior to installation. The cost for the return shipment of the equipment was significant due to the several pieces of equipment that had to be shipped separately. The cost of the labor, installation and uninstallation are still owed.

**. [redacted] will be charged for the labor of installing and disassembling for both items as well as all shipping & restocking charges that were incurred by JM Construction. She received an email regarding this fact several months ago.

3. The final allegation about a loan is also misinformation. She was well aware that she was getting a lot of things free of charge and was informed that the project was way over budget due to her change orders and scheduling conflicts. She was asked for a loan against the last draw of her project. As a courtesy, she had not yet been charged for the extra labor for the upgrades because she expressed her inability to pay any additional charges. She has an unpaid balance of $3265 which was due upon final inspection as well as additional labor & shipping costs associated with the return of the cabinets and sound system. She was notified of that through email as well.

At this point, the only resolution is for us to settle this matter in court. She has distorted all conversations and her allegations have been hurtful to JM Construction’s business.

She has also made allegations to [redacted]’ Broker which has caused her to lose a substantial amount of business which she has been in for over 10 years.

We will seek to defend all of her allegations as well as prove that she has sought to destroy a business that provided a professional service to her and respected her personal issues throughout the entire scope of the project. Her basement should have cost somewhere around $70k. JM Construction charged her less than $50k.
