As is written in the attached contract, the total price of the remodel is $4,with a $1,allowance for materials, leaving a labor price of $3, Of that, $2,was paid initially as a down payment on the contract, which means that customer has paid for approximately 65% of their project.To date, here are the tasks that have been complete - Demolition of bathroomInstallation of new bathtubInstall new exhaust fanInstall new tile on bathroom floorInstall new tile on bath wallsRepair walls (in process)Here are the items that remain to be completed -Finish repairing wallsInstall toiletInstall vanityInstall mirror and wall accessoriesPaint wallsInstall new trimWe estimate the job to be at least 75% complete The tile work that has been completed represents a significant portion of the labor agreed upon in the contract and it can be valued at $2,alone That being said, per our calculations, more work has been completed than what the customer has paid to date At closing of the contract, we did estimate the job to take 2-weeks for completion of the project, however we did not guarantee that time frame Due to the nature of the remodeling business, we do not guarantee time frames because things do tend to take longer We had guys working on their job site every day once the job was started, and at the time of dispute, we had been working there for weeks and days I had expressed to the customer that we could possibly go over weeks by a couple days at that time Our company decided to pull off their job due to repeated rude communication and harassment Customer would repeatedly contact the office and our cell phones, and make demands to talk immediately, despite a lack of emergency They would yell at our receptionist for no reason apart from the fact that they felt the job was not progressing quickly enough, and they would leave aggressive voice mails The final straw was when the customer attempted to contact Jeremy, the owner, at 8pm repeatedly and left messages demanding they talk that night We do approximately projects per year, and have an opportunity to work with many people, to whom we always communicate professionally and successfully We refuse to continue to service a customer that does not treat us with respect We feel as though we have provided more service than they have paid for, and we feel as though they are receiving the better end of the deal after this dispute, and that is fine with us.The Revdex.com dispute is misleading, as the purchase price is listed as $2,500, but the actual purchase price was $3,after the material allowance

JM Design Build's preferred method of resolution is to complete the said project in a workmanlike manner, which includes pulling a permit and addressing any quality concerns the customer may haveSince the customer is not allowing JM to return and finish the project, and given the severity of the accusations being made against us, JM Design Build feels the next appropriate step should be a neutral 3rd Party MediationJM Design Build feels the customers' current demand for settlement is unreasonable and inaccurate, and we are more than willing to submit to the decision of an official MediationJM Design Build has requested Mediation to the customer without responseWe sincerely hope this matter can be resolved in a fair and reasonable manner

I have reviewed the response made by the business in reference to complaint ID [redacted] , and have determined that this does not resolve my complaintWe want to pursue a refund of the project costs paid to date of $17,which had already been agreed to by Jerry on the morning of 10/(we have it in writing from him that he was going to his lawyer to draw up paperwork) He backed out of this agreement on 10/ We had reached out to contractors to get pricing to complete the project with JM’s materials We only received a response form one contractor and they said they would be unwilling to take on the completion of the project as they would not pull permits for work already performed and they do not install materials not purchased by their company (field measurement issues, potential for materials that do not fit) It will be very difficult for us to find a contractor willing to clean up the JM Design’s mess and complete the project with their materials There are issues that JM Design fails to take into consideration in their offer (or any of their other previous offers/negotiations):Substandard work (i.eunacceptable drywall repairs (already tried to repair once), damaged door installed at recessed cabinet)Incorrect materials: the trim installed at the shower was not the originally agreed upon design, and additionally, Shower head is not flush with wall with added trimHoles in solid surface wall cladding due to removal of unapproved shower door changeContractor’s failure to pull a permit and have the work inspectedAccording to information received from the Building inspector, there may be code violations as well.We still have to procure shower doors and towel bars.We have to assume that the remaining materials were properly field measured and will fit without modification or need to be reorderedSince there had been mistakes made by JM Design regarding their field measurements (incorrect and materials had to be removed/replaced), we do not have any confidence that the materials that they ordered will fit.This ordeal is now in month #and now the we now need to solicit bids from other contractors to complete remaining work and fix JM Design work.We have expended countless hours on this to try to come to reasonable and good faith efforts to settle, only to have JM Design back out of every offer at the last minute We feel that return of money paid to date is a fair and reasonable offer, due to the fact that “making us whole” would ultimately involve additional costs to for us: permit costs (and removal of any necessary materials to allow for inspections), removal/replacement of the damaged and incorrectly installed shower wall surround and trim, replacement of the recessed cabinet door, refinish/repaint all walls and purchase of new shower doors and towel racks per the original contact If we find a contractor to take on this job, it will likely cost more than the original JM cost due to the fact that the job now required removing materials already installed.For all of the reasons outlined above, we feel that a total refund is an appropriate and reasonable resolution to this matter.Regards, [redacted]

WE just finished the bathroom on 8/6/15! Due to this situation we had to find someone to complete the work which is why it took me a little longer to get back with you in a timely fashionSORRY WE HAD TO WAIT UNTIL SOMEONE COULD COME AND WORK US IN TO COMPLETE THIS JOB! I have the bills from the electrician,and tile people. I will fax those tonight to make sure you have some of the documentation to let you know WE ARE SERIOUS ABOUT OUR BEING REFUNDED IN THIS SITUATION. I will forward the remaining bils from the painter, and plumber hopefully by no later than next week. They needed to write up all the issues and documentation for me. If you need to reach me please do not hesitate to contact me direct ***. WE are still pursuing this for a full refund. WE have spent and additional $because of them, and been without a bathroom for months

We would very much like to resolve this matter, however we can not accept the Owner's request for a reimbursement of over $17,which they have paid for the following reasons: $12,of this money was for products, all of which have been ordered and are non returnable, and half of which have already been installed in their first bathroomThe customers are only claiming a few of the product items (shower doors and towel barsapprox 10% of total product) are not what they originally selected, all the other products are correct and what they ordered (vanities, tops, fixtures, etc90%)Further, concessions have already been made regarding decorative strips in the shower which JM has absorbed (approx $1,800)Therefore, for the owner to request all of the money paid towards products which have been selected, ordered, and installed in the home is unreasonable. Here is our settlement offer: JM will re-imburse all money paid towards the labor contract, $5,300, and have the remaining product which is currently sitting at our supplier warehouse delivered to the homeowner at no additional charge (even though there is a substantial balance due on the product over their $12,paid)This is a very reasonable offer, I hope the owners will consider it

First, as we read through the customer's rejection, it is surprising to us that the first complaint was requesting $1,000, and now $3,000 is being requested.  The proposed settlement numbers seem to be based on feelings rather than facts.Here are the facts -The labor costs of the project are $3,795, and below are the completed tasks and their values:Demolition of bathroom - $300Installation of new bathtub (including rough plumbing & installation of shower valve) - $400Install new exhaust fan - $150Install new tile on bathroom floor - $700Install cement backer board & tile on shower walls - $1500 Repair walls (in process) - $200In regards to this issue and response to the complaint, here are more facts - Complaint says [redacted] never once came by after deal was sold.  Fact is that [redacted] was there on day 1 of project to get the workers started and go over the project as is customary.  The homeowner was present and they communicated at this time.  [redacted] also stopped by on other occasions and was communicating with on-site workers throughout the duration of the project.The customer states that they were not rude or disrespectful but admits to contacting [redacted] directly, which isn't an issue as all customers contact us directly.  However, they repeatedly demanded to speak to [redacted] immediately including the night before the decision was made to pull off.  This last night of contact was after 8pm.  Our office manager can also attest to being yelled at by the customer several times without just cause.The emotional, accusatory tone of the rejection by the customer is a good example of the tone taken with JM Design Build during the project.We are sorry that the customer is not happy with our work, however all tasks that we did complete were completed in a workman like manner.  There are some loose ends that did not get completed as listed in our previous response.  We are very comfortable with the professionalism in which we attempted to handle the situation and communicate with this customer.  We stand by our decision to walk away from this job, and we do so respectfully.  We are confident that the customer received more intrinsic value than they have paid our company at this point.  We hope they can move past this and enjoy their new bathroom.
