I discontinued service w this company several months agoNow I repeatedly get phone calls in the middle of the night from them inspiie of multiple requests to remove my name and number from their list of customers
They are clearly harassing me!

After my father died of Cancer, my wife and I were forced to move, as I previously
worked for my fatherJM Resources wants me to pay $to end my monitoring
agreement earlyI am trying to tell them that my monitoring agreement with
them assumes that I live in the homeNow that we have moved they are bullying
us to pay the remainder of the contract even though we cannot use their service
anymore

We at JM Resources send our condolences to the

First it should be understood that JM
Resources had already contacted ** *** (last week) and had agreed to allow the
monitoring services to terminate at the time that we received his official notification. Therefore we are not holding him to the
conclusion of his agreement
It should however be understood that our
official agreement of 1/23/was an agreement of years and our services were contingent on completing the payments as agreed upon. ** *** is not correct that he must live in
the house and the agreement does not offer this contingency.
We believe JM Resources has provided proper
services, has been reliable and now agree to terminate our relationship without
further obligations

I am rejecting this response because:
Any publication on alarm law will tell MrK*** that the statute applies to his company. Automatic renewal clauses are no longer unregulated in Pennsylvania. Maybe he needs a competent attorney to explain this to him. Next he'll be hearing from the Pennsylvania Attorney General's OfficeIn a nutshell, JM Resources's position is that a contract signed in is automatically renewable indefinitely, and that they have no responsibility to inform a customer when the next renewal is going to take effect. I hope the details of this case are posted on the Revdex.com website, because no consumer in his or her right mind would do business with a company like that

Customer’s Statement
of the Problem:
I became a customer of JM Resources, a home security contractor, on February
12, 2004. After an inadequate response to a recent request for an upgrade in
service, I switched to a different alarm monitoring service on February 16 of
this year. JM Resources promptly sent me a bill for $562.35, claiming that the
contract I signed in 2004 had an automatic-renewal clause, and therefore my
contractual obligation does not expire until February 12, 2019. I have informed
the company that the automatic-renewal clause in that contract is voidable
under current Pennsylvania law because it does not comply with the stipulations
in 73 P.S. § 517.7(e)(11). Frankly, I think they know this, and simply hope
that consumers do not. I note that JM Resources failed to inform me of any
automatic renewal in 2009 or 2014.

First it should be understood that Mr [redacted]
contacted JM on January 8, 2015 and following his request Ms G[redacted] sent him
a proposal and requested that he acknowledge his acceptance in order that we
may schedule his work.  He never returned
any written response that authorized his acceptance of the quote.  Please note that our representative also
attempted to call Mr [redacted] that same day but the phone “just rang with no
answering machine”.  Henceforth Mr [redacted]
called our office on February 11, 2015 and stated that no one ever contacted
him.  Upon review we discovered that we
had already spoken and emailed him.  On this
date Ms G[redacted] apologized and resent the original proposal that again was
never authorized to have completed.  We
also had Andy S[redacted] call Mr [redacted] and explain that our technician could and
would assist him at deciding what he needed once his was at the residence.  On February 18, 2015 we received Mr [redacted]’s
cancellation of current services. 
It should also be understood that our
official agreement of February 12,2004 was an agreement of 5 years and it is legally
renewing.  Mr [redacted] is inaccurate about
Pennsylvania law and it should be understood that alarm monitoring services are
permitted to renew.  Mr [redacted] was informed
of this obligation and was even sent a copy of his agreement.
We believe JM Resources has provided proper
services, and has continued to meet our professional obligations.  We
expect Mr [redacted] to remit the contracted amount or we we will pursue collection
efforts.

I am trying to tell them that my monitoring agreement with them assumes that I live in the home. Now that we have moved they are bullying us to pay the remainder of the contract even though we cannot use their service anymore.Desired Settlement: I would like to have the contract cancelled and a refund issued on services that were paid for and not used.

Review: They have a fairly detailed contract related to security services which includes an automatic renewal. Though automatic renewal in and of itself is not bad - this is for an additional 5 years. That is shocking for any business owner. When you think about families with issues or elderly - would seem that this length of an automatic renewal period should not be allowed. Not sure if and what PA laws state - this just seems troublesome for a homeowner.

I also have a lawyer reviewing the contract for the sake of other homeowners in NJ and PA.Desired Settlement: Terminate my contract. (Have paid them in full for current year but still have 2.5 years left on contract).

Review: I purchased alarm monitoring in 2005 with initial term of 5 years. When I had compared prices with ADP in the first 2 or 3 years and called to inquire about the ramifications of cancelling the agreement, I was told that I was committed to the first five years only and could cancel at any time thereafter. This confirmed what I was told when I signed my agreement back in 2005; as such I had no concern with sticking with JM Resources. Much to my surprise, when my employer introduced a more sophisticated digital monitoring service recently, I contacted the company about cancelling my service since I had completed my initial 5 year term, and was told that, since I didnt cancel within 30 days of my 5 year agreement (by August 2010) that my service not only renewed , but renewed for another full five (5) years. I was so surprised that I asked for a copy of the agreement reflecting such; nicely hidden in the agreement was the statement about renewing at the existing term (ie. no mention of 5 years and no specific initials to acknowledge and highlight; it absolutely was NOT explicitly stated in the sales pitch when I signed). On the contrary, a 5 year agreement was sold to me. I had thought that I was under a month to month agreement, and was very surprised that I was now under a new 5 year agreement that doesn't expire until 2013. I was told that I would be responsible for paying almost $350 if I cancelled now. I believe this business engaged in deceptive and misleading sales practice, and intentionally failed to acknowledge the renewal policy. The boldly stated the RIGHT TO CANCEL in 3 days, but failed to put the proper emphasis on renewal and also failed to communicate consistently on the renewal terms -- cancel at anytime after 5 years verbally communicated upon sales is very different from what was stipulated/hidden in the agreement/proposalDesired Settlement: I would like to pay for the charge that was due on July 1, 2013 only. I am willing to pay for the full quarter but NOT 50% of the remaining 2 years.

The [redacted] client did NOT purchase the alarm system from JM Resources but rather purchased said system through their builder in 2005. We did go out and activated the system at no upfront fee and signed the attached agreement for 5 years as shown in the terms as #3. Term #4 clearly states that the services are renewable. It appears that the client simply did not understand the commitment that they agreed to. And now they wish to change to AT&T since they will receive a discount?

I hold that JM did perform per our agreement and it is only due to receiving discounted fees that the client is charging us with these accusations. The cancellation fees offered to this client have already been discounted per the agreement. However in good faith JM will consider reducing the discounted fees of $350 to $175 as a fair settlement if the client removes this complaint and agrees to this solution.

My counter proposal to drop the complain (and put this mess behind me) is 50% of $333 which is what I believe [redacted] quoted which equates to about 6 months of service that I wont be getting the benefit of. Please confirm and I will make the payment.

The actual balance of contract is 666.30. Contract allows for 50% payment or 333.15. In the spirit of good faith JM will accept 50% of $333.15 as a fair settlement if this client removes this complaint and agrees to this solution.

Review: We had a security system which proved ineffective since upgrading our phone system to Voice over IP (VoIP). Request to cease monitoring charges until the system was upgraded were ignored. Request for assistance in upgrading the security system were not followed through. Another firm was hired and installed an updated system. Request to cancel account with JM Resources was met with many hurdles, extra charges and unprofessional responses from them. After researching the account, it was discovered that we had paid for 5 years of monitoring which didn't work since the phone system update. JM Resources never tested communications to our system, they claim it is the client's responsibility.Desired Settlement: We expect JM Resources to cancel our account and zero out any balance.
