While Inspecting my house for the buyer [redacted] Moved my Refrigerator and ripped my kitchen floor while doing so.I am selling my house on [redacted] st [redacted] I had a buyer request a home inspection, when the inspection was done I came home to my refrigerator pushed about a foot away from the wall. I looked down and noticed my floor had been ripped from the foot of the refrigerator about 8 inches in the shape of a "V". I called Him and spoke on the phone he said he had moved the refrigerator while checking the electrical outlet behind it and stated the tear must have been there. There was Absolutely no rip in my floor prior to the inspection. He took photos of the rip and put them as part of the inspection to cover himself.Desired SettlementI remodeled the kitchen 3 years ago and put a new floor in, It was in great shape. Now I have a rip in the floor from the inspection. I would like the floor replaced or the value of the floor roughly [redacted] and I will replace it myself.Business Response Sorry to hear of the concern. On [redacted] 2014, we conducted a home inspection under contract to the purchasing clients of [redacted] XXXXX. While inspecting the kitchen a tear was observed in the thin vinyl floor covering. Further investigation by moving the refrigerator (which also allowed for inspection of the receptacle behind the fridge) showed the flooring had been previously hooked by the right front refrigerator foot, pulled and torn. The loose flooring section was lifted to provide clarity for the record. This was photographed, recorded and reported. This freeing of the caught section did present a more visible exhibit of the condition that would have been previously hidden by the refrigerator cabinet, and what made it known to the plaintiff. However, the floor's binding on the refrigerator foot and the tear were previous conditions. The refrigerator was left away from the wall to allow repair of the floor and the receptacle.The plaintiff did not contact me until [redacted] at [redacted] PM, ten days later, to inquire about the floor. I agreed that I had observed the tear in the kitchen flooring at the time of the inspection, and further noted that this was photographed, recorded and reported in accordance with the state Standards of Practice. I asked if he could evidence that the tear did not in fact exist prior to our attending the inspection as claimed, and that it was in fact caused by activities of the inspection. The plaintiff stated he was unable to document this and has not offered any confirmation hence.The tear itself should be repairable with a ** quart of flooring adhesive and a [redacted] floor roller if done gently by a flooring specialist. I would suggest the plaintiff contact a flooring company for further evaluation and estimates for repair, or visit the local home repair store for advice if he plans to do this himself.
