*** *** again engaged us to complete exterior work at the same property in SeptemberWe were clear that several jobs were open ahead of his but we would complete his work before the snow hit
Our crew worked hours at ***'s to compact the sub grade and set forms so we could determine the correct amount of gravel to achieve positive flow from ***'s homeThere were several weeks of rain and ***'s property holds water as it sits down by the riverOur hourly bill rate for our crew and machinery is $235/hour.
After several emails and calls from ***, where there was some heated exchange, *** told us that he wanted us to not step foot on his propertyWe refunded ***'s deposit less $for work completed at his property and the materials that he forces us to leave behind which included steel stakes and concrete forms.

were change ordersWe ended that contract in JulyWe spoke about other work in the fall but he didn't have the budget for itWe spoke again about it in September at a trade showThe last week in September he gave us a partial depositI told him we had several projects in front of him but we would be there before winterAfter two weeks, me and two of my crew went out to the job and started setting grades and formsWe had almost the entire back side set and ready for fine gradingWe had to pull off the job for a few days because of rain and *** then told me he wanted to cancel the job until springI said ok and would send him back the deposit less the work and materials already completedThe deposit was $3000, we refunded $less hours of work and the steel stakes and lumber he keptThere were several exchanges of words with himHe's is now trying to tarnish our reputation because in his words, he who owns *** contracting, has been sued numerous timesWe have copies of all of the signed contracts and agreements for your review if needed

Complaint: [redacted]I am rejecting this response because:. In the original in the original contract he promised me stairs and walkway to my garage which is about 30 feet I never received that  also he took additional money for an additional contract and kept my deposit a portion of it without even doing any work the proper way so basically I would just like this cleared up and settled I believe it was me the stairs and my Pathway to the garage and my portion of the deposit back is the only rightful thing I'm asking for because  the stairs in the pathway or never done and I paid in full for that  also he kept my deposit a portion of it with no rights to he also is the one who just suggested to terminate the contract for the portion  of the deposit he's trying to keep. And for the record my Foundation was supposed to be four to five feet above land because I live in a flood zone and put it for 5 feet below at that point I would just Add 3 feet and get a full basement which I did not wantSincerely,[redacted]
