In response to claims from [redacted]: The problem occurred date of 10/*/2013 is incorrect. Home was purchased in October of...

2013 and [redacted], the person that purchased the house did not contact me personally until the spring of 2014. As a home builder, I do not complete all work on the homes that we sell, I do as much as I am able to and the use a handful of experienced contractors to complete the home. All of the contractors I use on my jobs have years of experience. In all my years of building homes, I have never had a dissatisfied customer. I have been working with the Building Inspector to make sure that any of the concerns listed by [redacted] are addressed that are identified as being under my obligation. All requirements as per contract of sale with [redacted] have been met. Specifically, as per contract of sale, lawn washout is not seller’s responsibility. The concerns about the lawn were not on the punch list at closing. It is important to note here that [redacted] specifically requested that the lawn be hydro seeded and we obliged. As for the roof, as per the Building Inspector it was at code. But again, at [redacted]’s request, I had the roof redone as he wanted. This was done for the customer, it was not required that I do it. Any concerns with the HVAC were taken care of immediately; the electrical circuit went bad and was also replaced in a timely fashion. The allegations about cracked tiles have been an ongoing issue. I have been to the house numerous times and [redacted] cannot identify the tile. There is a cracked tile that I am aware of and am still waiting for [redacted] to let me know when he has located the extra tile that was left in the home for such occasions as this. If there is extra tile, I have already told [redacted] that I have no problem sending a tile installer to replace it. On many occasions I have sent contractors to meet with [redacted] for her to identify specific issues that they were having. I have been a trusted home builder for many years and have many, many satisfied customers. Also, please note that I have been currently working with [redacted] and [redacted], who bought a house in October of 2013, to rectify any concerns that they have that I am obligated to do.

Review: [redacted] ( jms01 reality llc and [redacted] of the lots that are to be built on [redacted]) didnt follow our contract in which he agreed to meet or exceed standards of workmanship and materials relative to the industry and build our house in a skillful manor. He sold us a NEW home which is not new home quality. He also isn't following ny code-section 777. Our what was supposed to be dream home isn't what we expected. Since day one we have had nothing but problems which would include and not limited to a poorly constructed roof, property was sold to us with medical syringes/nails/not clear of rocks (which was stated to be done in contract) etc, hvac issues, cracked tiles due to [redacted], sheetrock bowing, electrical panel...... The list goes on and on. He contracted most of the work out (which we were under the impression he was going to do it all) to businesses that aren't or shouldn't be qualified to work on homes. All my husband and I wanted was to have a nice house built and be able to come home from work and relax and enjoy our home. Because of the poor craftsmanship all around we can't.Desired Settlement: We want everything that was stated in the certified letter we sent him fixed to our expectations and our verbal conversations in which he agreed to give us soil, fix the tiles he broke when nailing in the room dividers, and fix the paint job that wasn't completed and wasn't done properly. There are several things on the certified letter that he attepnted to fix a second time but still wasnt done properly. He needs to follow through with all this broken promises.
