Joe Graham Painting

Review: Joe Graham breached our October 28, 2012 Contract. He represented himself to be "quite good" at wainscoting. The brunt of the Contract involved Joe's manufacturing and installation of raised panel wood wainscoting. Joe deemed the project complete on March 6, 2013, demanding the final payment. However, many of the raised panels are defective (with large divots and gauging), there is severe bowing in some of the panels, with visible seams, open seams, spackling bumps, poor painting (drip marks, different sheens, etc.). Joe also incorrectly installed two heat grills by simply screwing them on top of the wainscoting, rather than recess them into the panels, as is the norm. We have confirmed our concerns with a master carpenter. Not only has Joe refused to return to correct these issues, he refuses to return to even review them in person. Joe also has not responded to our most recent emails/letter. Joe further breached the Contract by refusing to honor the Contract price for wallpapering, demanding an additional $900, not including the wallpaper, when the Contract included "medium-quality wallpaper". We advanced Joe $6,000.00 more than what was currently due under the Contract (prior to completion) and he refuses to return these funds pending completion/correction of the project. We are in the process of obtaining estimates, but based on preliminary estimates, it appears remediation will cost $6,000-$9,000. Photos of the defective wainscoting can be provided.Desired Settlement: We feel that Joe should immediately return the $6,000.00 overpaid to him pending successful remediation of the defective wainscoting. Then, and only then, would any remaining balance be returned to Joe. We would still be open to reviewing these items with Joe in person and possible allowing him to attempt to fix them.
