Revdex.com: I have reviewed the response made by the business in reference to complaint ID [redacted] , and have determined that this proposed action would not resolve my complaint For your reference, details of the offer I reviewed appear below.My response to merchant's response:Discount Tires, Costco Tires informed me that the tire size purchased at Joe's Tires 245-65-105T were unsafe for my vehicle and they would never have installed the tires size due to the load capacity requirements for my vehicle, proper load capacity is (lbs) and tires purchase were 105vBoth tire shops have stated that due to insurance liability and safety issues they are not allowed to install tires that to do meet the load capacity requirements, both Discount Tires and Costco Tires stated that a reputable tire shop would not risk the liability issues with installing a lower load capacity tires Mercedez Benz Service Advisor, [redacted] signed a company letterhead (letter attached) stating that the tires load capacity 105v would not support the weight of my vehicle in an event of an emergency, the tires "do not provide proper traction and contact patch on the road, the tires are too thin" and I provided a copy of the letter to Joe's Tire Shop and the visa company Joe's Tires statement that the only reason I chose to purchase a different size tire is because they were cheaper, that is not true; as I stated before, Joe's Tires Shop did not have my correct tire size 275-55-109V in stock in Februay and it would take 5-business days to receive and install the tires I told the sales person I could not wait and I was about to leave and Joe's Tires salesman then convinced me that the tires they did have in stock would "work for my vehicle" and they were lower price I was unconvinced but he insisted they would work just fine I am sure the sales person is telling the owner differently in order not to get in trouble with the tire shop owner.Joe's Tires sales person never informed me of the safety problems with purchasing tires that have a lower load capacity, if he had informed me of the potential problem, I would never have purchased the tires As I already told the tire shop owner, if the salesperson had been honest with me and told me the truth then I would never have purchased those tires My research after this incident confirms that a lower load capacity is unsafe, a higher load capacity is ok to install but never a lower load capacity.On 07/28/15, the day that I had a flat tire and discovered the safety issues with my tire size, Joe's Tire shop DID NOT HAVE MY CORRECT TIRE SIZE 275-55-109v IN STOCK on 07/28/ I tried to work with the owner of the tire shop and salesperson, but the owner just yelled at me in Spanish and kept say "no, no, no", the situation escalated when I tried to write down the business license # to document the business owner's name, he basically yelled and block my view When I asked how much credit they would give me towards the purchase of the correct tire size, they would not confirm how much credit they would give me I was driving my only vehicle with "donut" tire and lower load capacity tires, I could not continue to drive the vehicle under those conditions as I need to think of the safety of my toddlers and myself I require my vehicle to work, I needed to find a tire shop that had my correct size tires in stock immediately I tried to explain this to the salesperson and the business owner but they were not interested in listening to me and I feel that I was taken advantage by the Joe's Tire salesperson because I did not know the potential issues with smaller load capacity of tires Yes I did know it was a different size however I thought they were still safe for my car, because it never occurred to me that a tire shop would sell me unsafe tires for my vehicle.To this date November 09, 2015, I am still waiting to receive a refund from Joe's Tire and I still have the tires they sold me and I would like to return to Joe's Tire Shop If they would like me to return the tires for a refund then I would return the tires and accept the refund In an event that we cannot reach an agreement, the credit card company encouraged me to pursue other avenues such as small claims court, which I am considering if I cannot reach an agreement with Joe's Tire ShopIn addition, if I don't read an amicable resolution with Joe's Tires Shop, then hopefully my experience with Joe's Tire Shop would help the general public to advise them of the problems I experienced this this shop, the unprofessional customer service (owner yelling & blocking my view of the business license) and hopefully help another consumer avoid the problems that I experienced with this shop I would also like to encourage other customers that have experienced problems with Joe's Tire shop to come forward and make public their issues or problems with Joe's Tire Shop Regards, [redacted]

Mrs***' statement that she didn't receive the tires as we described is falseOn February 16*, 2015, *** *** bought tires 245/65/for $Mrs*** not only received the tires she paid for but the tires she choseShe decided to buy a different tire size based on the priceBetter
than to buy the recommended size for her vehicle and pay $each tire ($for tires)We clearly described to her that the cheaper tires were of a different sizeThat was the main reason why the tires were much cheaper.Originally we quoted $each tire for a total of $final prices after taxes, labor and other feesShe said it was too much moneyThis price was extremely competitive and we couldn't offer a better price for the tires of the size she originally askedTo assist her, we offered her different tires that were cheaper but of a different sizeShe decided to get the cheaper tires in a different size than to pay the price we quote of $For what I read in her declaration you have in records, she claims that we didn't have the right tires in stockWe don't know what the purpose of her lying is but we are a busy and very well stocked tire retailerand we had the tire size she needed when she came to buy the tiresShe decided to buy the tires that were of a different size because the tires were cheaper tires and not because we didn’t have them in stock.The lady came back months after to fix her flattire and we told her that we don't fix tiresFor what we understand, she went to other place to get it fixAs you can imagine, we are not responsible neither have any control on how other business operateIf this other tire shop refused to fix the tire for whatever reasons, it doesn't pertain to us what their repairing policies are or how they conduct their business,Mrs*** later comeback “acting surprised as she didn’t know that she bought a different tire size”She was requesting to change the tires she bought from us and get the tires size for which we originally quoted her $Our answer was that she can exchange the tires but she still has to pay the difference between the $she paid for the tires she bought from us and the $($eatire) for the original sizeShe didn't accept our offer and she left without getting the right tire size because again, she didn't want to pay $500.Apparently the lady went to another place and end up buying the tires for a higher priceIn a final time, the lady comeback with brand new tires, tires she bought from another dealer, and we the tires she bought from us on her carShe came to ask us “how much do you offer me for the tires I bought from you? I'll take anything; I'll set the credit card company to refuse the purchase anyway.” We said that we can give her only $150, then she thought about it and left without selling the tires back to us.At Joes Tires we offer very competitive prices and we pride for our customer serviceWe were very accommodating to the lady since her first visitIn one of her visits to our shop she was acting very confrontational and suspicious and she went inside a private office taking picturesWe explained to her things of value) and take pictures, that if she needed something we will help her.As for the size of the tires, you have no idea of the many people that buy different tires sizes based in personal preferences, looks, prices, stiles, and other reasonsThe recommended weight capacity gives the maximum weight pertire but in actually, particularly in non commercial automobiles, this maximum weight capacity is almost never meetWe offered to give her credit toward the more expensive tires, buy back the tires so she can have some cash back but neither consideration was satisfactory to her
