On 11/Mr [redacted] purchased a New GM ZF Speed Transmission and a rebuilt NP 261XHD Transfer caseInvoice #The rebuilt transfer case came with a yr unlimited miles WarrantySoon after his warranty expired he called told us the transfer case went out and he needed one immediately shipped out and was told according to out warranty policy we needed to receive his old unit to determine if it indeed was a defective unitMr [redacted] was told that a Deposit was required in order to ship another transfer caseOn 11/11/Mr [redacted] did give us a deposit in the amount of $Invoice # [redacted] The Replacement unit was shipped on 11/12/It was received 11/17/We did receive Mr [redacted] 's original transfer case and on 11/25/he was refunded the $Deposit via Pay PalAt some point over the Christmas to New year's Holiday Mr [redacted] Did Try to contact us We were however in fact Closed during this timeAs soon as we resumed business hours we did in fact contact Mr [redacted] He advised us that he had a problem and that he wanted us to send him a check for his expensesMr [redacted] was told this is not our warranty policyWe have never received the supposedly defective unit to insure that it is one of our unitsOr to inspect it to see why it may have failedWe certainly would not have sent out a replacement transfer case that we knew would fail as insinuated by Mr [redacted] We did quit taking calls from Mr [redacted] after he became very vulgar and abusive with our employee who did answer his calls when no one else was available to take themOur warranty clearly states that we do not cover any any of the things that Mr [redacted] wants compensated forWe have attatched a copy of our warranty with this response along with a copy of his original invoice, and also the warranty deposit invoice and that credit card receiptWe have also sent a copy of the Refund that we did through Pal Pal For his warranty depositIn his complaint Mr [redacted] never mentions that his warranty deposit was refundedThis was NOT another purchase

In response to joes explantion as to what had taken place, some things need to be clarifiedFirst I have no claim or complant as to how the first transfer case issue was handled amd I am aware I recieved my deposit back on the first issue occuring 11-11-second I never stated that I purchased or gave joes any money for the second issue occuring 12-21-i had used a different company to get a transfer case as joes were apperently out of the shop for holidayswhen I did finally recieve a call back on 1-12-from joes I explaned what had happened and asked for a componsation for the transfer case I bought from merchant automativenothing was ever mentioned about me sending the defective unit back for inspection, I was simply told it had no warrenty and it is my problem not theirsafter more discussion and trying to reason with *** (employee I spoke with) I was still getting same response as to they wouldnt warrenty the second oneI had asked *** numerous times about the first transfer case that was defective and if they ever figured out what had caused the problemonly response was he knew it was bad from moving the shifting mechanism but they hadnt had time to look at iti would think after a unit is found defective the company would want to find out the reasons it went bad as soon as possible to prevent any further units from having the same resultAlso the defective transfer case is still in my possesionI was never asked to send it to them and didnt want to pay to have it shipped to joes not knowing if they would warrenty it or not [redacted] will still credit me my core charge if joes continue to refuse warrenty on their producti would be more then happy to send the transfer case back to joes with the understanding shipping from here to them is covered and once they recieve the unit I get full refund from what I paid [redacted] in the amount of 2,on 12-22-I am willing to accept the fact they cant cover the rental car, motel, lost time, headaches extbut the defective unit itself should still be covered I would also like to add since I installed the transfer case from [redacted] on 12-26-i have put close to miles on the truck without one fault, nearly seven times the amount of miles then the transfer case from joes had before it quit working

the first unit was purchased on 11-7-and was not installed until 1-7-even if you consider one year from the purchase date the first unit failed on 11-5-prior to the one year and only because joes wouldnt answer phone calls or return messages I didnt get ahold of someone till 11-7-still prior to the one yearIt was then the following week before they were able to get the case out and I paid them on 11-12-regaurdless of the first issue, the second case was months and months away from one year and it says dirrectly on joes website rebuilt units come with year unlimited milleage warrentyit also states they will go the extra mile to meet customer needsmust be a short mileI would like to know why the second unit for whatever reason didnt include the same warrenty as the orginal unit. I didnt pay any for the second unit only due to the fact the first didnt last for their advertised warrenty periordso what makes the second unit void of warrenty??? possible problems during rebuild process??? possible employee procedures not followed??? I would sure like to know besides just simply deciding not to honor their warrenty as advertised. guess any other customers should know whatever warrenty you think you are getting through joes is no better then the paper you wipe your *** with is what it comes down tooStill have transfer case but never once has joes mentioned anything about me sending the unit to them for inspection and refundguess it is alot easier for them to deny warrenty then cover their mistakesway to go the extra mile joe

In regards to case #***, We (Joes Transmission) covered the first unit that failed when we sent a second unit to replace it even though it was out of warrantySo we were not liable for the first unit because it was out of warrantyAnd the second unit we sent, we returned the money deposit for it back to the customerWe do not cover other expenses incurred such as towing, labor, etcWe are not liable for the expense of the transfer case bought from *** *** We will not warranty the second unit because the money was returned to Mr*** he put down as a deposit on the replacement unitAgain...The first unit was out of warranty, we sent 2nd unit, even though the warranty was expiredWhen we received the 1st unit back, we refunded Mr*** the deposit he put down on the 2nd unit so there is no warranty on the 2nd unitThank you *** *** Joes Transmission
