I am in receipt of your complaint by Ms***Let me first state, her complaint has no basis in truth or fact.She did not want to go forward with this case from my initial consultation with her in August 2013, as she did not want the father to have any contact with the children.The case had no
action until the father filed for a modification of custody in AprilSince that time, she has had numerous phone calls and emails to me as well as one court appearance where the court referred the matter to a therapist organization, which the court had used before in one of my cases.Her claim that I was not available is untrue and maliciousI have attached hereto my complete billing statement to herShe, when asked for an additional retainer, did so, but then stopped payment on her checkShe was sent a Substitution of Attorney on April 29, She did not return it until the following MondayThe file could not be returned until it was returned to my office as she well knew.She was sent every document received by my and filed via e-mail.She absolutely was consulted about the agency to analyze the reintroduction therapy for the kidsI gave her a detailed bill well over a month ago- to no availI will commence an action against her to collect the nearly $in fees she has refused to pay.I, quite frankly, in my years of practice have never dealt with a more flagrant accusation as this

Review: First, my money was taken and I was not given any kind of a bill showing work done. Then when work was to begin, I couldn't get a hold of the attorney, wouldn't return any of my phone calls or emails before hearings. Wasn't giving me advice or answering my questions. Made an agreement in court without consulting me, was late to court and unprepared. I decided to stop services with this attorney, gave him notice, now I can't get my file from him and he will not sign the substitution of attorney document I sent him first class mail. He's saying he wants money first and I can't get him to sign it or give me any of my documents. I told him if anything is owned to please bill me with a detailed bill of all work done.Desired Settlement: I would just like my file back and my documents and I really need him to sign the substitution of attorney so I can move on with my case.

Review: I hired Mr. [redacted] as my attorney for a divorce case. It's been over a year and it is not final. His phone is disconnected so I can't contact him.

Mr. [redacted] doesn't return phone calls. Does not give total answers to questions on the case. I've been trying to call him because he told me to contact him for a court date to finalize the divorce I am seeking from my formaer wife. I tried all last week and this week his phone is disconnected and he still has not contacted me for the final divorce procedures in court. Very unprofessional. If I would have know my 2500.00 would be use like this I would of gotten annother lawer. It's been over a year now since I acquired him and still waiting on his responses to my phone calls.Desired Settlement: I am seeking some of my retainer fee I paid him to represent me in court. He is not fullfilling his part of the agreement and now I can't contact him unless I drive to his office in which he is never there or so said he is not in because his phone is disconnected. Left numerous messages on his answering machine and with the individual answering the phone for him when his phone was operative.

This will respond to the complaint received by Mr [redacted]

Mr [redacted] hired me t to do a dissolution of marriage proceeding that he fowled up when he asked for a separation. His wife repeatedly evaded service of process. She finally hired an atty who rarely returned my phone calls and she is now represented by another.

Mr [redacted] omitted major assets in the first action for separation, therefore the items must now be litigated.

As to my phone be disconnected- that is an inflation of the truth. ATT erred in my bank acct numbers by one digit in the auto pay. The mistake was corrected in one hour or less. He is dramatic in his complaint. The matter now has to be set for another hearing which I advised him of and to call my office when he got back into CA for the death of his father. He as referred to my office through a referral service that allows their consumers to call them at any time to complain about an atty while not giving the atty time to respond to the client calls. Most of his calls were returned within business standards. Once I received his illegitimate complaint to your office I advised him to sign the Substitution of Attorney form I would be sending him. Two phone calls later and he still has not done so. He basically wants me to represent him without charge which I will not do. If I did not perform satisfactory work- which is certainly the case-he would have sought new counsel. I simply will not tolerate baseless claims and will pursue the matter against him, as he has been advised.

Mr. [redacted] is not telling the truth. I hired him for just what he said dissolution of marriage. My wife got the legal seperation process done. That is whay I hired him to do the divorce. Mr. [redacted] promised me when I hired him that this would not take long to process. I only meet with him 4 times and talked to him maybe 5 times through out this entire process. And everytime we meet he had a plan to get it done but not results. The excuse was that he could get in contact with my wife or her lawyer. It's been one year and six months and I am not close to a divorce as promised. I tried to contact Mr. [redacted] on many occasins when I returned from Louisiana and he was not answering or returning my calls. I finallly got through to him and he told me to come to his office the following Tuesday so we can proceed with what had to be done. Beware now never explain what needed to be done or mentioned that more money was needed for his representation. I called that Tuesday but he did not answer the call or return my call to see what time he wanted me to come in to get the case finalize. I called daily after that trying to get him on the phone but not reply. And the last straw was when I called and his phone was disconnected. I left more messages after his phone was connected and no reply. I finally got a call from Mr. [redacted] stating he was not going to represent me because I put the complaint in through you all. And got another one asking me to sign the paperwork removing him as my attorney. Now if he can contact me for those issues why could'n he contact me on the progress on my divorce in whic I paid him 2500.00 for. I am taking Mr. [redacted] to small claims court to see if I can get back some of my money and put in a formal complaint through the Bar Association to see if they can look into his practice. He has put me through a lot of stress over this period and if you read the reviews on him they are simular to mine. I called the Legal Service that referred him to me and complained to them but they said they only refrer them. They told me that Mr. [redacted] removed his name from thieir list of referrel. So I was stuck with him to finish my case and as you can see it is still not complete after a year and a half. My wife will do a statemment stating she and her lawyer had complied with his request. She said when she talked to him he was really rude to her. So, no I do not aggree with his statement and is taking this to the next level if needed.

Review: Lawyer would not return my emails or return my phone calls resulting in a miscommunication with my ex's attorney.

[redacted], Failed return phone calls or emails to me in regards to my divorce case. I never Could get a invoice of services rendered by him, my ex attorney requested for several documents that he fAiled to give to her lawyer. he also filed court document saying that I was unemployed and now my ex's lawyer is claiming that I Perjured myself and came to court with unclean hands, I was not aware of what [redacted] had told the court In his documents. [redacted] also had agreed to settle my divorce without talking to me, because of his misrepresentation I almost lost my child custody rights.Desired Settlement: I'm requesting the last 1500.00 that I paid to this lawyer back in June of 2013 return to me because we never went to court because he did not like the judge residing over the case

This will serve to respond to the above inquiry.

Mr [redacted] retained my services in a dissolution of marriage proceeding.

His complaint is nothing more than his effort to avoid payment on his case.

He was referred to me by a employee benefit plan and given a 25% discount. My services

started in June 2012. He had no problem with my services until he was informed of the

laws regarding spousal support and demanded (without merit that I pursue support from

his wife because he had a vastectomy.

As the case progressed I obtained a custody arrangement he was happy with after

much negotiation. I did not fail to return phone calls and he has never raised this

allegation until he wanted a refund of his fees. He changed addresses without notifying

me.

The employee plan emailed me several times to attempt to have me write off his debt. I

did not agree and this complaint then ensued.

He signed all of his documents after reviewing them. If an error was made, I should

have been notified and I was not until your letter ensued. Wage stubs were attached to his

filing- it would seem that issue was then moot.

His claim goes on to allege misrepresentations I made. That is false and in fact actionable. I would not nor have I ever made any misrepresentations to the court in any

respect. Mr. [redacted] pattern is to trump up his allegations when he fails to get his

way.

I will be pursuing legal action against him for his failure to pay my fees.

Please let me know if any other information is needed. I have enclosed a copy of his billing recap.

Final Consumer Response

I would like to stop this complaint 65033995 [redacted] and myself have reached an agreement where he agreed to waive the remaining balance to zero and give me a copy of the receipt showing zero balance. Also I will be receiving a refund of 180.00 .
