In response to there complaint Wagner's initial list of walkthrough items was written up and completed by the subcontractors needed in a timely fashion as they were rushing to get into the new home Any outstanding items at that time were items that they had not funded in there final draw .For example - added marble shelves in bathrooms There project consisted of a couple of items that we do not recommend or contractors who did not have the skill set to provide The clients made a choice to use the trim carpenter to construct and install there cabinets as they were half the price of our vendor This usually has its consequences as not only did that vendor walk off the job , we had to bring in a different trim carpenter to complete the project Cabinets were different colors, missing pieces , let alone the triple amount of time that the project should take The most difficult part of the project though was the home was being built in flood plain This took a tremendous amount of added engineering to complete with the village and countyWe were responsible for the driveway contractor installing the drive too high and in turn, we had it removed and replaced at our Expense Including the added $in Engineering All this took an additional season to get thru The Wagner's are in possession of all there final bills now and are usually paid from final bonds They still need to pay those out or reimburse us for the ones that have been paid on there behalf These are all standard after close expenses other than the large amounts of engineering based on flood plain and there wanting of all new sidewalks Regards Joel Andersen

I am rejecting this response because: We moved in February of - Joel Andersen has not been back since to complete and resolve punch list items that we have submitted to him on several occasions since that time and he continues to ignore us Homeowners do not know what needs to be resolved until they have lived in the home (for example no sub-floor in one of the showers) Also he is contractually obligated to resolve these issues We used Joel Andersen's trim carpenter to install kitchen cabinetry at HIS recommendation and we have written proof of this He acts as if everything was our fault yet he had a direct contract with them and they were paid through a construction draw (which had to be approved by him). Joel Andersen was well aware of the flood plain issue from the very beginning He did not oversee his sub-contractors as a General Contractor should, or there would not be these constant delays The tremendous amount of "added engineering" was due to him not doing his job correctly If the grading and driveway were completed per the plans, we would have received our Final Occupancy Permit the summer of Instead the job was repeatedly done wrong and the Village would not approve his work Joel Andersen just submitted final invoices last week and is acting as if we are delayed in paying them Some of these were from months ago He is holding funds that we put up with the village "hostage" until we agree to pay Some of these are not for our house and most are for engineering that was required due to his negligent oversight We have been pleasing with him for months with little to no response He is far from honest on most of his points and we have written proof to this effect

This client's punch list was 100% complete upon them taking possession of their new home.  The client was granted a temporary certificate of occupancy until they completed grass and grading with their landscaper.  The bigger issue was the client lost his job and didn't fund the...

$278,000 balance prior to them taking possession and in turn was in breach of his contract as occupancy is not granted prior to their final payment.  A one year warranty is given so future items, as far as adjustments, are part of the one year warranty.  Since there is still an open balance, future service work can not be provided until the balance is paid in full.  Hence a mechanics lien was placed on this project.  If you're in need of any documentation, I am happy to provide it.
