This letter is in response to *** ***'s complaint ID #***DeMarco Landscaping cannot demand a customer take our adviceWe advised *** *** not to install a patio on a home that is less than 5-years oldWe have no way of knowing how the home was constructed, how much the home will continue to settle, or what type of soil compaction exists*** ***, despite our recommendation, decided to have the patio builtWe cannot be held responsible when we provide advice in good faith based on our expertise and the customer makes a decision that goes against that adviceIf there was a warranty, which there wasn't, the industry standard is one yearThis work was done several years agoSincerely,John D

I am rejecting this response because: The bottom line is the patio should have never been put in with such a new home and ground settlement occuring during the first 5-yearsWe love our patio and the work that they performed, however we trusted the contractorShouldn't we have been told that it's too early to install a patio and we should wait a couple years to allow for settlement? In addition, we are being flexible at spliting the cost to relay the patioWe learned alot building our house and it's scary with the lack of controls in place.......we need better protection for the consumer

This project did not include a warranty.  If they paid for a warranty and there was one included, it would've lasted 1 year.  This project is several years old.

Shouldn't we have been told that it's too early to install a patio and we should wait a couple years to allow for settlement? Review: I had a landscaping project installed in March 2012. As part of the project, there was a one year warranty on all the plants. Six large plants died within the year timeframe and I emailed DeMarco landscaping on February 2, 2013 to inform them and asked when they could replace the plants. I received an email back on February 5, 2013 from [redacted] saying that I would be put into the Spring schedule and that she would inform me of a more accurate date when it got closer. I emailed again on April 23, 2013 asking for a status update and received an email the same day from [redacted] stating that [redacted] was no longer with the company and asking for the details of what needs to be replaced. I gave him the list on April 27, 2013. I have yet to receive any response to my emails and have called approximately 12 times to [redacted], [redacted] and the general voicemail box asking to tell me what the plan was. No one at this company is returning my calls or emails to honor their warranty.Desired Settlement: I would like DeMarco Landscaping to replace the dead plants in the next month as I am about to put my home up for sale. If this cannot happen in this timeframe, I would like a refund for the cost of the plants per the quote on the project so I may replace the plants myself.
