I was sold a 2005 F-350. My contract said "inspected". It was not.Took vehicle for "inspection to get tags".Tags were on truck but not inspectedI purchased the 2005 F-350 and was told it was inspected and road worthy.Check engine light came on in 2 days. I was told "you bought it as-is". Pre-sale inspection was not done. They could not get tags until it was inspected. This is finance company telling me this.I was told by [redacted] (XXX-XXX-XXXX)at Nicholas finance "we will do everything to make you happy to keep vehicle". I told her. 1. Fix check engine light from coming on. It needs a bulletproof EGR kit installed. 2. Brake light above door on tool box bed not working and 3. License plate light not working.This was placed over to [redacted] with [redacted] finance (XXX-XXX-XXXX) who told me the same thing "we will make you 100% satisfied".Heister called them and [redacted] called me and said "your vehicle has been inspected and the tags are on it".We went to pick it up Saturday and nothing had been fixed but it did have the tags on it.Kevin, the mechanic for Heister looked in his computer and according to the VIN on the truck it had never been inspected. [redacted] and myself with my wife looked at the truck and cranked it up, it was hard to start and check engine light was still on and the truck sounded bad, making spitting and sputtering sounds. We also checked the lights to see if they were functional and nothing had been done.So now to make this short. They lied about inspecting the vehicle and got tags on it. So between selling me a vehicle that had not been inspected according to my contract and then returning to find the vehicle had not been inspected but had falsely had tags put on it because the inspection had never been done. This is "breach of contract" The mechanic and myself and my wife along with one of Heister's salespeople wrote a list of things to be done. I was assured that everything would be fixed. It is not. [redacted] with [redacted] finance is now on Heister's side and telling me "you bought the vehicle as-is". So they are just playing whatever makes them money and not allowing me to be satisfied with my purchase.I want the contract between myself and [redacted] Heister Chevrolet annulled because they have breached the agreement twice and falsely had tags put on the truck with nothing being fixed and refusing to repair the check engine light being on.As well for the agreement to pay for it with [redacted] Finance. Because they are passive and playing favorites on both sides of the fence and I want nothing of this to be on my credit report.So this means the contract gets annulled as if I never even visited the place and got the loan that is being cancelled as well.I do not trust Heister Chevrolet nor the finance company.I paid $200 down for the vehicle and made one payment of $302.90I would like those returned to me.This would be the best and cheapest resolution in order to not have to litigate this in court.because it is blatant breach of contract.Desired Settlement1) John Heister Chevrolet, the contract is annulled because of breach of contract. My $200.00 deposit returned.2) no contract with Nicholas Finance and my payment of 299.90 plus $3.00 for using my debit card equaling $302.90.3) no negative reports from either party, do not put this on my credit report or anything.4) no further association with either companyBusiness Response Contact Name and Title: [redacted]Contact Phone: XXX-XXX-XXXXMr [redacted] purchased a 2005 Ford F350 from us on 10/6/15. This vehicle went through our shop on 8/19/15 with a check engine light on, our technician did a scan that showed some codes, at that time, we replaced 3 glow plugs, harness and discharge hose. Once this was done, it corrected the problem that the check engine light was showing for. Mr [redacted] took delivery on 10/6/15, once the paperwork was processed and the DMV work was sent for his tag and registration, DMV sent it back because there was not a Safety Inspection showing in their system. We then tried calling Mr [redacted] on numerous times to see if we could get him to bring the vehicle back in or if we could pick it up to have the Safety Inspection done. He would not respond to us. We have 30 days to secure the lien for the lienholder and since he would not take our calls, [redacted] Finance was able to contact him because they needed their title and that is when Mr [redacted] brought the vehicle in and had all these demands for us. We then had our mechanic to do a safety inspection on the truck and sent the paperwork to DMV to pick up his tags. NC DMV will not issue a tag to a vehicle unless a Safety Inspection is done. DMV is linked to all Safety Inspection Machines in NC, so the allegation that we lied to get the tags is false.Mr. [redacted] also stated that the check engine light came on after 2 days of him buying it, then why did he not contact us at that time? We have record that we replaced some parts on file, all we had to do was to pull the service history and see if it was from the same thing. We always try to do what is best for the customer. But we can't fix what we are not told about. Mr [redacted] has not picked his truck back up and won't return our calls AGAIN. We will buy the vehicle back and refund Mr [redacted] his money, we want to make sure that our customers are satisfied with their purchases. Our goal is not to have a dissatisfied customer, but to have them to want to come back to us for future purchases. Mr [redacted] needs to contact us if he wants his vehicle purchased back. Consumer Response as long as I get my money back as promised and there is no negative repercussion from Heister or [redacted] finance I will be happy.... I have a "check in the mail" as I was told during a telephone conversation. on 1/6/15.I have nothing else positive or negative to say as long as my simple demands are met.I pray that the vehicle does well for whomever may purchase it next.Be blessed

Held payoff, documents and disclosures filled out wrong, charged fees without explanationDealer completed documents incorrectly two times and asked me to resign docs to prevent their loss. Dealer never redislcosed finance charges with new docs. Dealer opened an account in my name with an affiliate without my permission. Dealer held payoff on a trade in over 30 days. Dealer stated payoff would be made in 10 days. Dealer sold a vehicle that had faulty wheel bearing and should not have passed inspection. This caused a payment on the old vehicle to draft same week I was paying on new vehicle creating NSF fees and bad history with my bank. I had to go pick up payoff myself to have trade in paid. Dealer failed to transfer old tags to new vehicle creating a fee to me from DMV. Dealer had to be notified that the temporary tag expired by me. Dealer registered vehicle in wrong county creating excess taxes. Dealer sent a bill over 60 days later for net $210 with no explanation of what I was being billed for. Desired SettlementRefund NSF fees to my bank account. Refund interest on the $4200 loan at 12% for 30 days.Refund $265 (net $210) fees charged without explanationBusiness Response Ms. [redacted] son came into our dealership to purchase a used 2009[redacted] with 148,415 miles on it. The customer was explained that the vehicle was sold as is with no warranty and we have his signature on these forms. When we sent in paperwork to the bank for approval, he was required to have a co-signer, so his mother came in to sign the paperwork. The finance manager failed to input an outside payoff that her son requested to be included in the deal. Once that was realized, the customers were called and asked to come back in to sign new paperwork in which we offered to give them more for their trade for their troubles. Only the son came in and resigned the paperwork and asked the finance manager to send the paperwork out to the mother because she lived out of town. At that time the 2nd contract that was sent to her by our driver, she did not accept because she wanted a full payoff amount for an outside lien to be included with the contract instead of the original agreement. A 3rd contract was created including the full payoff for the outside lien and fed-ex'd to her for her signature. Ms. [redacted] held that contract for 2 weeks before she would send it back. In the mean time the truck had an issue and the son had to bring the truck back in for service. John Hiester Chevrolet fixed his truck and agreed to pay half of the repair and the son agreed upon that. Son paid $50.00 the day he picked the truck back up leaving a balance of $210.00 that was sent out as an accts receivable to them. Because customer did not send back the contract in a timely manner, this resulted in her lien to be paid off late which caused the payment to come out of her account. There should not have been 2 payments taken as she has mentioned because the bank didn't even have the contract at that point. Ms.[redacted] has alleged that we opened an account with an affiliate without her permission, this is not correct , she signed a new membership form for [redacted] Credit Union to secure this financing. The son signed the form to receive a new tag instead of transferring the old tag also. We feel that we have went above and beyond our obligation to this customer. Consumer Response Heister' s own clerk stated [redacted] the finance manager failed to ever let them know to send payoff. I had already Made a payment on the new truck loan before heister discovered payoff was still sitting in their office. The loan had booked which makes the above statement incorrect and I have supporting documents to prove it. Credit union themselves stated the dealer did not fill out the paperwork to correctly disclose an account was being opened. I have a copy of the incorrect paperwork. The credit union has since sent a rep to the dealer to retrain the employees because they confirmed the error. I specifically asked [redacted] if an account was being opened and was told no. The second set of finance paperwork was exactly the same as the first which is why it was not signed. The error with the paperwork was not that payoff was not included but that the value of the trade in was doubled from 4000 to 8000. I had no legal obligation to resign documents but out of honesty did so to prevent the dealer from taking a 4000 write off. I have both sets of paperwork from [redacted] which show the trades counted twice on both the first and second set of documents. My honesty and willingness to resign documents that the dealer messed up on not once but twice has now cost me hundreds of dollars. Based on the response above the dealer clearly sold me a truck and did not disclose any info to me. As for the repairs to the truck [redacted] only communication to me was he was happy to help get the truck fixed and he truly hoped [redacted] his sales rep did not know their were issues with it. This was after the truck was repaired. No estimate, conversation, or invoice was provided to me on any "repairs" prior or after. The vehicle was released and no invoice given at that time either. If a balance was owed the service department would not have released the vehicle. A bill was mailed out two months later with no itemization that even states it was for repair work. Common sense states that it is illogical. A repair shop can not complete repairs without disclosing cost nor do they release a vehicle without payment in full. It was my understanding the repair was done out of honesty of the dealer Final Business Response Can you please tell us the amount of the NSF fees that is requested. I see the other amounts but not that one-THX
